Review: I signed a contract with Tri State for 103,000. During the course of the project I made payments in cash. There were a few changes during the project that I requested a quote for the amount the change would cost before and after the change was done. [redacted], owner, kept saying don't worry about, we will work it out, it won't be that much, for example to install skylights, change position of a door, windows, etc. In february, I let them know I needed the house done by July, as my wife and I found out we were expecting a baby. They said they will finish. I kept asking how much more to finish. I never received an answer. From April [redacted] to May [redacted], his crew only showed up 3 times to do minor work and he asked for 8,000 in payment, which I stupidly paid since he said it was for materials. No materials were bought, and no work was done over that period. I got really frustrated and asked him how much more to finish the project; he stated 100k-120k more in addition to the 120k I had already paid him. This made me really, really upset, the house was left completely open to the elements, I kept asking him when they would seal it up and put siding on, he said soon, they need to get the materials. Now I have paid him 17k over budget and he states he needs 100-120k more to finish what was supposed to be a 103k job; now is a 240k job. The changes we made cost nowhere near 120k extra. I verified this by several contractors. I just want my 8,000 back from my last payment. My house floods when it rains because there is no siding, no weather wrap, they left dumpster loads of trash all over the yard which they were supposed to cart away. Now, we don't have nearly enough cash to finish. I told him I do not want anyone from his company to work on my house again and they picked up their tools. Now, I have been bringing in contractors to give estimates on finishing and they cited some major flaws in the work done, especially in the framing including one very dangerous beam that was just nailed.Desired Settlement: I just want my last payment of $8,000 back. There were no materials or work done prior or after this payment was made.

Firstly, I’d like to make it aware that Tristate Core Drilling is simply a core drilling company. The company itself was not involved, but through day laborers the work was completed. [redacted] came to me because he was fond of the work my workmen do, as they have completed several home renovations for his family and friends of his family in the past. I agreed to provide him with day laborers. They were being paid every two to three weeks. Money was only requested after work was performed and after materials were purchased.

Additionally, there were a variety of changes being made during the course of the job. There were requests being made to change something every other day and week; these changes can’t be done at the snap of a finger. I wasn’t able to provide a steady price because of the inconsistency. On top of this, the plan was also amended about four times, which created even more delays to the process. The framing inspection, however, was passed on the laborer’s part.

As for the $8,000.00 that [redacted] is asking for, this money went to all the materials that was already purchased and to pay the day laborers for three weeks. There is still $38,000.00 that was not paid for all the additional work that was requested. We ended up doing a complete room, rather than partial, above the garage. Also, instead of a partial master bedroom, we framed a complete master bedroom. This all included walls and the roof. With the recent increased cost of materials, it’s evident why it would cost so much to further complete the framing and roofing of a 4,000 square foot property.

Firstly, Tyvek was purchased partially for a reason. It was to keep workers occupied until their was enough funds to go on with the work. As per windows, [redacted] went ahead and changed sizes. As I said before, he was NOT going according to the plan the architect provided. If I couldn't determine the sizes of windows then, clearly the architect couldn't either because none of these matched the sizes [redacted] went with. As for rafters, inspection was passed when the workers were there so, it's complete lie that inspection wasn't passed. [redacted] is making up anything he can possibly come up with to use against us.
