Ms***-We are not trying to be contentious, however there are a few points we wish to clarifyFirst, I did personally meet you on the job site to address your concerns about the roof repair. Secondly, there were only two pipes coming out of the top of the chimney, both being oversized class A pipes, which are used for fireplace exhaust, not water heater venting. As you stated, you learned afterwards of the conversion of the forced air furnace to the new boiler system. That information was never shared with us. We asked you if the fireplace was in use and you stated it wasn't, since you had removed the fireplaces. The contract stated, "Remove existing chimney, haul away, patch plywood as necessary, install new tar paper, and install shingles over patched area". No mention was made of leaving any pipes in place, nor hiring a HVAC (heating, venting and cooling) contractor to extend pipes up from the lower levels of the home. We did precisely what was outlined in the contract: we removed the chimney and patched the roofYou were aware this was the plan of action and you signed the proposal, indicating you wanted the work done, as specified.Finally, as a gesture of goodwill, we offered to reimburse you for half of the work that we performedWe did not offer to pay half of the contractor's costs that followed us onto the job. Our offer was an effort to find middle ground between efforts we exerted and monies you paid. We express our condolences for your troubles and hope you accept our offer of assistance

I am rejecting this response because: Mr***Please slow down and read this thoroughly because I do not believe you are digesting the information that I am conveying repeatedlyI know that you met me about the roof repairWe met on January 14, I am not disputing thatBut you did not visit the site prior to the work being started, nor did you see it in progressIf you had, you would have seen the two class A pipes (as you describe them)One for unit A and one for Unit BAND you would have seen the separate piping for the hot water heat ventilationI have pictures from both the roof and from inside the units to verify this informationIt is also in the full report that I sent you from *** ***The hot water heaters were NOT vented through the chimney pipesIt was separateI must simply repeat that IT IS NOT MY JOB to know everything about roofing and what it entailsThat is why I hired a licensed professionalBut even I would have stopped what I was doing and investigated that extra pipe if I had removed the chimney and encountered itEvery single roofer that I have called has said they would absolutely know to check thatThey agree that your employee was negligentThen, after the problems began, you never went into the attic and you never went into the basement to investigateYou just repeatedly tried to sell me major overhauls of the roof including replacing the entire east roofI have document everything meticulouslyRegarding the contract I signed that said exactly what work you would doI propose to you a similar scenario that might appeal to your common senseIf I signed a contract asking you to remove a wall in my houseAnd, after removing the drywall, you discovered that it was a weight-bearing wallEven though I failed to tell you it was a weight-bearing wall and I signed a contract that did not include doing was necessary to support the ceiling, you would be expected to figure that out and amend the job as necessaryHomeowners are not in a position to tell you everything that you will find when you start a jobThis is quite shocking that you keep asserting thatI KNOW NOTHING about roofingI simply told you everything I could think of to tell you about the project when we spoke on the phoneI would not have ever imagined that you would do a job without inspecting for yourself what was requiredThe bottom line is that your employee made a mistakeYou were unable to diagnose the mistake and unwilling to keep looking at the problem until it was resolvedAs a result, massive damage was done to the interior and exterior of my houseAnd I had to hire someone else to your workIncidentally, the statute of limitations has not run out on this projectIt has only been months since the job was done and the statute of limitations is two yearsI believe this is another attempt to manipulate meI repeat that I will accept nothing less than a full payment for all damages to my houseI will absolutely not back downIf you would like pictures of the piping, I am happy to provide *** *** Regarding what you offered to reimburse me: On 3/22/you sent me the following message:"how about we take a different tact.........how about we both accept responsibility for the outcome of the work?if you will agree, and would sign paperwork saying you will no longer pursue this issue, we would agree to reimburse you for half of the work." I assumed you meant half of the contractors fee who repaired your damageI apologize that I misunderstood what you were offering

[redacted] contacted us about a leak in August of 2015.  Upon inspection, we found a deteriorated chimney to be the culprit.  [redacted] agreed with us that it would be less expensive to remove the chimney rather than re-flash, re-side and install a custom metal chimney...

cap. [redacted] indicated the chimney was no longer in use since she had removed the wood burning stoves.  With [redacted]'s knowledge and blessing, we proceeded to remove the chimney, and install plywood, underlayment and shingles. Unbeknownst to [redacted] and us, in the original construction, the builder had joined the water heater exhaust flue to the wood stove flue 3 stories below inside the framing of the home.  Not only is this unusual (we've never seen it before or since), but it is against code to join class A vents (wood burning stove pipes) with class B vents (water heater exhaust pipes). Later, when [redacted] called to report drywall staining, we met her at the home in an attempt to discover the root of the problem.  After the piping mishap was uncovered, we empathized with [redacted]'s predicament and offered her $650 to help her fix her drywall issues. This gesture was not meant as acknowledgement of wrong doing, but rather as a gift to help her defray her costs to amend the builders construction methods.  As for making an insurance claim, neither hers, ours nor the builder's insurance will involve themselves as the statute of limitations expired. We wish [redacted] the best of luck with her repairs and hope she will accept our offer.
