I was interested in purchasing a can am spyder motorcycleWhen eiric s [redacted] (scammer)emailed about a bike for sell in portland..he send me information about how close the deal.stating he work out the country etc.he send me a fake transportion company with escrow agent.name ales m [redacted] ..I go on web.it look legit.I had to log in etc..I got detail to send to ales to hold then whe I receive bike .I have days to see if I like ....well I sent money it sound convincing..5k...so they sent me email lettn me know it on the way fake trackn number etc.well weeks went by ..I look in trackn they made it seem like it was on route for deliveryBut I never received bike .they stop emailing and stop answering that bogus business number...so im out of 5,000..that easy

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.[Please note that we contacted *** @ Valdora via phone and did not purchase these via *** The so called lowball offer was in fact a price Valdora offered their other shops as well in order to get rid of their stock Within a couple days after we received the frames we contacted Valdora to question about the play in the seat tube as these frames claimed to be in size but were more like 27.4-which creates play and damages/cracks the carbon insert as well as the tube As noted in the earlier response we were very concerned and questioned *** about the play ***/Valdora assured us it's not an issue as they are beefy frames and will not fracture
The facts are: we addressed the issue within days, this was not an *** purchase as Valdora claims, no real resolution was ever made to correct, these frames are defective & basically Valdora does not care nor honor their own words.]

Complainant is referring to [redacted]h bicycle frames that were exclusively liquidated on [redacted] in September of 2013.  These items were not offered or listed elsewhere.  They were to be liquidated exclusively on [redacted] by the terms set forth on the [redacted] listing.  The [redacted] listing clearly...

stated that these frames were being liquidated below the COST TO MAKE them.  NO WARRANTY EXPRESSED OR IMPLIED.  Returns would be accepted within 7 days of receipt and inspection.  These were liquidated to move them out of the warehouse and make space.  They were not advertised by Valdora because they are [redacted]h frames (not Valdora) and there was no way to warranty an item sold for less than cost to make and one that can not be replaced because it had not been in production for years.  The seller i.d. on [redacted] was not Valdora.  Finding that Valdora had a prior connection to [redacted]h, MW contacted Valdora to inquire as to whether Valdora could facilitate a purchase of the [redacted] frames.   He stated that his lowball offers on [redacted] had been rejected.   He wanted to make a lowball offer for two frames, asked for free shipping and represented himself as a bike shop owner.  He claimed that most likely the frames would be used as show pieces to hang high end components on in the showroom.   A sale of the frames at the lowball price was arranged.  He paid $400 per frame, fork, headset.  This breaks down to: $150 carbon fork, $40 headset, $210 carbon [redacted]h frame.  The terms in place were those of the [redacted] listing.  This product was not listed or advertised anyplace besides where he found it on [redacted].  The [redacted]h frames had to be shipped by [redacted] Parcel since he would not pay for the standard lowest [redacted] or [redacted] service to HI.  To appease him, someone was sent down to the post office to wait in line for 45 minutes to ship his frames.  The frames were inspected prior to packaging and they were in excellent condition.  Approximately 30 frames were liquidated on [redacted] and the [redacted] seller account received no inquiries or complaints regarding any matter. Despite the fact that these items were liquidated: NO WARRANTY EXPRESSED OR IMPLIED, return within 7 days, MW was offered two replacement frames at no cost out of good faith.  The only size remaining to be liquidated at that time were size large.  For a legitimate bike shop, frame size would not matter.  The offer was refused.  
[redacted]As with any item in a similar situation, the item(s) would have been returned for inspection.  Items were never returned for inspection.[redacted]   
 All of the large frames have since been liquidated.  
Bottom line - the terms were expressed clearly in the only place the items were offered for liquidation.    [redacted] NO WARRANTY EXPRESSED OR IMPLIED, Returns accepted within 7 days.  Items were never returned for inspection.  We have no way of knowing if frames were damaged during or after MW assembled bikes. Replacements were offered and refused.  Technical assistance was offered.  It has been more than 6 months, long past the 7 days return period.  A refund will not be offered.  We are willing to offer a non transferrable $420 credit toward the purchase of a Valdora frame at retail cost.  This offer is only valid once the [redacted]h frames have been returned for inspection and inspection results acknowledge a flaw in materials or workmanship.  All shipping charges ([redacted]) are the responsibility of MW.
