On sistMay 21, 2012, I consigned a glass & wrought iron dining table with 4 chairs and a matching glass & wrought iron hutch to Vanguard Consignment. The contract stated I would receive 50% of the selling price.I called from July 2012 to December 2012 asking if my set was sold. I was told there was no documentation indicating that it was, so on December 19,2012 I went into their store with a friend to see if my furniture was still there. We searched the store and did not find the furniture. I then went to the front desk and spoke to the owner, [redacted] who told me the table and chairs sold, but not the hutch. I asked for my money for the dining set and he told me their policy was to have everything sold before he would release a check. I tried arguing the point, but ended up leaving. My friend said to go back and demand the money for what was sold. He got very upset and wrote me a check for the dining set telling me to never set foot in his store again, so I lost out on the money for the hutch, not knowing if it sold or for how much.The fact of the matter is, I was intimidated and frightened to go back. Also I had purchased this entire set from him 5 years before, so I paid on both ends and he made out.... I have heard of others having bad experiences as well. I was vulnerable as I had just lost my [redacted] 5 days prior and was in a very emotional state.Desired SettlementI would like to have his records looked to see how much that the hutch sold for and receive the money I am owed.

Complaint They sold my mother ([redacted]) furniture and are not paying her the money due from the sale$1149.00.Mother is selling her condo. I called Vanguard because they sell furniture on consignment. I figured we could at least get something for the furniture. They came and picked up the furniture which was dining room table w 6 chairs, dining room large cherry hutch, red sofa, white dresser w mirror, white metal headboard. In the contract, it asks to give them 90 days to sell the merchandise. Fine. 90 days have come and gone. They picked up the furniture on June 14, 2013. All the items have sold. I know because they told me and I have an item report showing that. They owe my mother ([redacted]) and 86yr woman on soc. sec. $1149.50.She paid they a $75.00 pick up fee when they came to get the furniture.I have called many times and got the run around i.e. we will get to it. Soon, By next week, etc.I must have called at least 10 times. I did ask them to send the check to me [redacted].(her daughter) I am taking care of all business dealings for my mother.So far no check. There is no reason why they should be holding on to her money. There are expenses involved in selling a condo and she could certainly use the money for this and also to help pay bills. Her husband is in the Holyoke Soldiers Home with severe Alzheimers disease and according to doctors his time is very short. Needless to say she does not need this unnecessary stress worrying about her money. She asks me everyday if the check came.We did our part and trusted them in good faith to do the right thing. When I mention to others about the trouble I'm having getting the money, many people said that it very hard to get your money from these people. Apparently I'm not the only victim.I happen to be talking to our lawyer and she suggested to tell them if they don't pay up that I could put a 93A deceptive business claim. I called and told they I may do that. The owner was supposed to call me back. No call. That is why I am writing you. Someone has to stop these people from cheating people.Desired Settlement Since everything is sold all we want is the money due to us. I don't want to go to court, etc. We just want our just payment for our furniture.Business Response Account was in process. In late November 2013, my husband and I visited the showroom of Vanguard Consignment in Chicopee, MA. We had some furniture that we were interested in selling and we wanted to see what types of items were being offered for sale. We spoke with [redacted] Beratetette, Sr. and arranged for a pickup of our furniture on December 6, 2013. We told Mr. [redacted] that we would be In Florida for 3-4 months, but that we would check In for status reports on our items. Our 6 furniture items were picked up by [redacted], Jr. and one other employee on the date previously arranged. At no time were we consulted as to the prices that would be attached to our items.I began making phone calls from FL on January 6, 2014, to check on our consignment items. No one answered the phone the first time that I called. I called again on Jan. 9 and left a message. On the le, I spoke with [redacted] and told her why I was calling and that I had called twice before. She said she'd pass [redacted] message along. Again, no returned phone call. I spoke with [redacted] on March 20 and inquired if any of the Items had been sold yet. Now about 3 IS months have passed. She said she'd check, but once again, no one returned my 03U.When we returned from FL in April, I began my calls once again (4/15) each time leaving a message as to why I was calling and to please return my call. The messages were to no avail. On 4/231 finally spoke with Mr. [redacted], Sr. and he said that some of the items had sold and that he would get a check out to me soon. Not having received a check yet, on May 7, my husband and I went to Vanguard to see what the status was of our items. At that time we were told that all items had sold except for 2 chairs (Item #1 that they had described as a rattan arm chair) and Item #3, a wood and upholstered arm chair. We said that we would take the 2 chairs back since they had not been sold yet We located Item #3 In the showroom and took It with us, but ltem#1 was no where to be found. Mr. [redacted] said that it was probably in the warehouse and he would look for it and let us know. When we didn't hear anything about the chair or receive a check in the mall, I once again called back on May 16 and was told by Mr. [redacted], Sr. that he hadn't had time (in 10 days) to check on the chair, but that the check for $272 was on his desk and ready to be put in the mall. (Check #3133 written from Peoples Bank) We received the check on or about May 22. tasked that he please check for the other chair (#1) because we woukt like it back.On June 10,1 called once again about Item #1 and had to leave a message. (No call bad() I called back on 6/12 and spoke with [redacted] and she was to leave a message for Mr. [redacted], Sr. I didn't hear from him so on 6117 I called again and left a message to please call me re: the chair. The next day, my husband and I retuned to. Chicopee to see if we could volunteer to check the warehouse ourselves for the chair and be accompanied by an employee. We were told "NO" and that there was more than one warehouse. Before we left that day, I wrote out a detailed description of the chair (Item #1) because I said that I didn't think that they were looking for the "right kind of chair" (if indeed they had been looking for it at all). Mr. [redacted], Sr. put the slip of paper on his desk and said that he'd look and call me back that Friday, June 20.Now 7 weeks later, 1 had not heard one word about the chair, so on Aug. 6, 1 called once again and spoke with [redacted], Jr. and explained the reason for my call. He said that he would "get to the bottom of the situation" and would call me back by 3:00 that afternoon. He said that if I didn't hear from him by 3:00, to please call him back.I returned [redacted], Jr.'s call around 4 PM on Aug. 6 and this time Mr. [redacted], Sr. answered the phone. I told him that I was returning his son's call and he (Sr.) was very belligerent toward me and hung up the phone on me. I immediately called him back and as soon as he heard my voice, he hung up on me againi I was taken aback by his rudeness and his attitude and wondered how and why a man in business for 20 plus years would react this way to a customer, when all I was looking for was an answer to the whereabouts of my chair.About 15 minutes later, Mr. [redacted], Sr. called me back and continued to rant and rave at me. He would not allow me to speak. He claimed that my husband had just called him and given him a "hard time". In fact, the only contact that my husband had with Mr. [redacted], Sr .was during the 3 times that we visited the business in Chicopee. Mr. [redacted] went on to say that the chair that we were talking about °wasn't even worth the $40 price that they had put on it. Then he hung up on me for the third time. I have to say that I was surprised that he called me back after already having hung up on me twice before.As a result of the 3 hang ups and verbal harangue, I contacted the Chicopee Chamber of Commerce to find out how to proceed to submit a complaint rd been dealing with this business for 8 months and I was anxious to resolve my issues with Mr. [redacted], Sr. I spoke with [redacted] on Aug. 6 and she asked me what business that I had a complaint about. I told her Vanguard Consignment and she indicated that they were not a Chamber member. She gave me a phone number and a contact at the Revdex.com of Central New England. I called and received a Customer Complaint Form on Sept. 5. I was also told that there are many other complaints 'but there" against Mr. [redacted], Sr. and Vanguard Consignment House.I have enclosed copies of the original consignment agreement dated 12/6/13 and all the item reports dated May 7 and 15. I've also included a picture of item#1, the chair in question. I am also aware that [redacted] In Springfield interviewed Mr. [redacted], Sr.and also a woman who also had a complaint against Vanguard Consignment.Retrieving the chair (Item # 1) has now become a matter of principle and in addition, it has exhibited to me the poor business practices on the part of Vanguard Consignment House.Business Response I wanted to let you know that we did send [redacted] a payment for $272.00 on 06/02/2014 which left one more chair to be sold at $40.00. We sent [redacted] a check today for $20.00 (Half of what the chair sold for) per all our agreements. Please let us know if you need anything further so that we can resolve this issue.Consumer Response Upon receipt of your letter dated October 29, 2014, I am writing to let you know my position on my complaint. Upon review of Mr. Barthelette's response of October 28, I am not satisfied with a check for $20 in lieu of my request for the return of chair #1.I have been pursuing the return since May 7, 2014, and I sincerely believe that the subterfuge created by Mr. Barthlette refusing to locate the chair and then stating to you that it had been "returned to me a long time ago", only to have it later disclosed that it was "allegedly sold" for $40 long after we had been questioning its whereabouts, is only a feeble attempt by Mr. Barthelette to close the door on this issue.After review of my notes, I find it coincidental that August 6 was the date that I contacted the store, after 7 week's time, to find out if they had located chair in their warehouse(s). It was also the date indicated by Mr. Barthelette for the chair "allegedly" being sold. That morning, I spoke with Ron, Jr. and he told me that he would "get to the bottom of the situation" and that if I didn't hear from him by 3:00, I should call him. When I did call back around 4:00, Mr. Barthelette, Sr. answered. When I told him that I had spoken with his son earlier and that I was calling back to find out what his son had found out, Mr. Barthelette, Sr. was very rude and irate toward me and then proceeded to hang up on me 3 different times within a matter of half an hour.I am certain that Mr. Barthelette knows that the chair is worth more than the $40 initial price tag that he alone placed on it. Even though, bottom line, I'd rather have the chair back, I think that Mr. Barthelette is rather naive in thinking that he can placate me with $20, when he has been stretching the truth all along to fit "his story". He apparently feels that he has "dismissed me and my complaint against him" for a mere $20. He is wrong! I truly don't believe that he has sold the chair.I have enclosed a copy of the original sales receipt for the chair. I fully realize that furniture does depreciate, however, this chair was an "occasional" chair in the living room and was in mint condition when picked up on December 6, 2013, by Vanguard Consignment. The resolution to my original complaint against Vanguard, dated September 14, 2014, was to have the chair returned. If it had been returned, I would have pursued other avenues for sale of the chair, and I'm sure remuneration would have been greater than $20. Thus, I am still seeking return of the chair in the condition that it was received by Vanguard on December 6, or additional monetary compensation in the amount of $75 to $100, which would reflect the "equitable value" of the chair.Personally, I have not made any contact with Vanguard Consignment or have I heard anything from the business other than the receipt of the check on October 17, which, as of this date, has not been cashed.I continue to believe that Mr. Barthelette's credibility is the real issue in this case and, sorry to say, his great lack of honesty and Integrity as a businessman.Thank you again, [redacted], for all your assistance. Final Business Response [redacted],We had her chair for sale at $40.00 since the signing of her contract dated December 6, 2014. In the last paragraph of ALL Contracts it states that "I hereby give Vanguard Consignment House the total control over final pricing of any item(s) I place for sale as result of this agreement." When [redacted] had finally reached our office and spoke with someone regarding her rattan chair we had in fact been looking for it and couldn't locate it in our store or the warehouse it was at that point we had decided to pay [redacted] for the sale of her chair (50% of $40.00). We paid [redacted] regardless that her contract was long over due because we felt that we made an oversight on a sales slip and maybe didn't mark down the correct account number giving her the sale much sooner than when we paid her. Regardless of what [redacted] paid for the chair or what she thinks the chair is worth she signed over the rights to price her furniture accordingly due to the fact that we are furniture specialist and that is what consigners count on from Vanguard. I placed with vanguard consignment x2 tiffany style table lamps, x1 tiffany style floor lamp and x1 medal wine rack for sale in august of 2011. No one expalin to me I was to pick-up my stuff after 90 days ,if it did not sell. I call vanguard in july of 2012 and was told that the lamps had sold ,but the wine rack had not sold. I was told at this time ,Iwould receive payment. Which I did not receive. I call again in june of 2013,and was informed they were checking into this. No one ever call me backDesired Settlement I would like payment for the items ,that had sold.Business' Initial Response Customer was out of contract as we can not store items for 2 years beyond expiration.Consumer's Final Response (The consumer indicated he/she DID NOT accept the response from the business.)I was informed in one of my many phone calls,that the lamps had sold. I never recieved payment for them. If you are no longer a cosignment shop,but are stealing other people property. No one even call me to pick-up my items after they didn,t sell. I am considering call the police to see want can be done, if this cannot be resolved.

Never received payment on furniture as per Consignment Agreement.I have two contracts with Vanguard Consignment House Inc and have never received any payment for the furniture. I went to Vanguard several times looking to see if the items were sold or were still on the showroom. The items were not on the showroom and when I asked where they were no one knew and said the would check and get back to me. I also call several times and no one could tell me where my items where.Desired SettlementMy items returned or payment for their value.Business Response This contract is from 2008. This contract is too old to even justify him making a complaint. We have no records going back that far.

Never received payment or any contact for furniture that was sold on consignment. Called numerous times no respone. Several pieces of furniture were picked up for consignment by Vanguard Consignment on 8/19/11 as we were moving. Term was 90 days, and did not hear from them. Called back and extended the time for sale after the 90 days. Called again to check and they said no one was there to check my account, to the computers were down. After some time, stopped into the store myself and asked to receive a statement. This was June 14, 2013, and it said a boston rocker had sold for [redacted] and a dining ro set was sold for [redacted] Looked around the store and saw the dining room set was still on the sales floor for sale. [redacted] said there was a deposit on it. Said to call back on Monday. Called back person not there. Checked today 6/13/14 because I will be going to the area today and would stop in.Desired SettlementPayment for the sold furniture. My account # is [redacted]

Vanguard picked up bdrm set 4/12/12 and I was never able to get info from them again. no ret calls rec'd from VM and msgs left with emp. tried for 8 m4/13/12 [redacted] picked up antique bdrm set: Vanity with mirror, full size bed with headboard and footboard, wardrobe, dresser with mirror. I was told they would call me with details as to selling price and I would be paid 50% of the selling price. Was told the set would sell for up to $1000.00 because it was in very good condition.I tried to reach them after 1 month. woman who wered phone could not find any info about my furniture, but she said it was her 1st day on the job. she would give msg to owner to call me. I never got a call. tried again in 7/12/12 and spoke with [redacted]. she told me she was new that week and didn't know how accts were found. she tolme she would call back the next day with my information. I tried again in a week and left msg on voice mail. no response. I started calling evy week or 10 days. Never got a live person that answered the phone. In Jan 2013 I again spoke with a female who was new and she would relay the message. Never heard from anyone. checked the website and never found my bedroom set shown. Desired SettlementI would like to know what happened to my bedroom set and if at all possible to receive payment. was it take to Brimfield and sold at the Antique show. it was from the 1920's

I was told there was no documentation indicating that it was, so on December 19,2012 I went into their store with a friend to see if my furniture was still there. We searched the store and did not find the furniture. I then went to the front desk and spoke to the owner, [redacted] who told me the table and chairs sold, but not the hutch. I asked for my money for the dining set and he told me their policy was to have everything sold before he would release a check. I tried arguing the point, but ended up leaving. My friend said to go back and demand the money for what was sold. He got very upset and wrote me a check for the dining set telling me to never set foot in his store again, so I lost out on the money for the hutch, not knowing if it sold or for how much.The fact of the matter is, I was intimidated and frightened to go back. Also I had purchased this entire set from him 5 years before, so I paid on both ends and he made out.... I have heard of others having bad experiences as well. I was vulnerable as I had just lost my [redacted] 5 days prior and was in a very emotional state.Desired SettlementI would like to have his records looked to see how much that the hutch sold for and receive the money I am owed.

This company failed to pay me my share of the sale of my furniture. On 9/10/13 I went into agreement with Vanguard Consignment to sell my dining table, chairs and hutch. In early December 2013 I noticed the items were no longer on their website. I called at that time and was told the sale was in process and I would be receiving a check shortly. I have since made numerous phone calls looking for answers as to where my check was. I have spoken to the owner [redacted] every week for the last few weeks. Each time is one excuse after the other. I spoke to him on Monday Jan 13 2014. He told me the sales of the items was final and a check would be cut that Wed Jan 15. He said I should have it early the following week. When I did not receive it by Friday Jan 24 I called him again. He told me he was to busy to look it up to see if a check actually went out. I told him if I did not receive a call I would have to take further action. He actually said, "Do what you must, do not threaten me" He then promised to call me back later in the day. That did not happen. At this point I wonder if I will ever receive my money.Desired SettlementAll I want is to receive the money due me from the sale of my furniture. I also want to know how much my furniture sold for.

Never received payment on furniture as per Consignment Agreement.I have two contracts with Vanguard Consignment House Inc and have never received any payment for the furniture. I went to Vanguard several times looking to see if the items were sold or were still on the showroom. The items were not on the showroom and when I asked where they were no one knew and said the would check and get back to me. I also call several times and no one could tell me where my items where.Desired SettlementMy items returned or payment for their value.Business Response This contract is from 2008. This contract is too old to even justify him making a complaint. We have no records going back that far.

I placed with vanguard consignment x2 tiffany style table lamps, x1 tiffany style floor lamp and x1 medal wine rack for sale in august of 2011. No one expalin to me I was to pick-up my stuff after 90 days ,if it did not sell. I call vanguard in july of 2012 and was told that the lamps had sold ,but the wine rack had not sold. I was told at this time ,Iwould receive payment. Which I did not receive. I call again in june of 2013,and was informed they were checking into this. No one ever call me backDesired Settlement I would like payment for the items ,that had sold.Business' Initial Response Customer was out of contract as we can not store items for 2 years beyond expiration.Consumer's Final Response (The consumer indicated he/she DID NOT accept the response from the business.)I was informed in one of my many phone calls,that the lamps had sold. I never recieved payment for them. If you are no longer a cosignment shop,but are stealing other people property. No one even call me to pick-up my items after they didn,t sell. I am considering call the police to see want can be done, if this cannot be resolved.

cannot get payment of $174.50 for sale of consigned furniture on 6/20/2013 after inquiring on 7/2, 7/25, promised check in mail by 8/1/2013. On 5/19/2013 I entered a consignment agreement w/ this outfit. Customer gets 50%. Left a cherry corner hutch, & a mahogheny dropleaf cocktail table w/ 3 leaves. Stopped in store on June 29th to see if items we on display. They weren't. Told to call on Monday to inquire w/ [redacted] who wasn't there that day. On July 1 I called him. Said it sold for a combined $350 on 6/20 and I would get payment in July. July 25th I called (& other household member stopped in to speak w/ [redacted].)He printed out the 'sale transaction record" for for her & said 'payment will be cut on 8/1/2013.' We have not gotten a check in the mail. I am concerned since I read onlines reviews of other customers who said he has a practise of not paying folks. If I knew I wasn't going to get paid, I would have rather donated the furniture to Hospice or some worthwhile agency.Desired SettlementPayment in the amount of $174.50Consumer's Final Response to [redacted] -I have NOT heard from the company since filing this complaint. They came and picked furniture up for concignment in June 2013. In July 2013 I was told I could expect a check in 30 days. No check and no response.They picked furniture up at my home at the end of June 2013 in Southwick, Ma prior to my move to Houston TX. I called in July to see if I needed to renew contract, they put me on hold for a very long time and then said they confirmed everything sold they just needed to get numbers togther and I should have a check within 30 days. I waited 6 weeks, no check. I called again was disconnected twice. I wrote a letter and included a copy of the contract requestimg payment. I sent an e-mail using this site as well, no response. Desired SettlementPayment for the furniture they removed from my home as per terms of the contract 50% of what they sold it for plus interest since this has been unresolved since July 2013.
