Review: I booked an adult party on February **, 2012 with the merchant. A $260 charge was provided with my Discover Card. Unfortunately, one of the guests broke her limb, which caused a credit to my account. When we were ready to reschedule in April, I contacted the company to reschedule, I received an email stating that they were no longer at Palisades Mall, which was the closest location to us. On May **, I received a reply that they moved to [redacted], quite a distance from our home, which our guests were not willing to travel. I was told that a new location would open in the Palisades area, but never received a response. Therefore, tired of waiting, I sent an email requesting refund on December **, 2012. I received the response below on 12/**/2012: "We are very sorry for the inconvenience. When was your event originally reserved for and please verify your deposit amount. We'll be happy to issue you a refund."

All of my communication has been through email and I have all the emails saved. I provided the merchant all required information.

Merchant: "[redacted], our facility closed the last week if March of 2012. We took all reservations held prior to March [redacted]. We will contact our credit card merchant services to verify your charge"

1/**/2013- I sent an email following up with the merchant about verification

Merchant on 1/**/2013- "Hi [redacted].. We have not forgotten about you. It is taking a bit longer than usual due to the fact that we don't have a merchant account with Discover any longer. Our Merchant service provider is looking for the transaction. Is there a way you can contact Discover to see what they can do to credit this on their end? You can have them contact us for confirmation... That may work faster.. At any rate, we'll get to the bottom of this.."

A credit card dispute was opened with Discover:

"We've completed our investigation regarding a transaction for $260.10 from [redacted]. During our review, we considered all documentation we received from you and we attempted to obtain transaction records from [redacted]. We regret to inform you we have not been able to validate the details of your claim. Accordingly, we consider the charge to be valid. The charge will remain on your account and the temporary credit we previously applied to your account will be reversed."

I sent another email to the merchant questioning why they did not confirm the charge and called them from July-October.

Merchant 10/*/2013: "Hello [redacted], Sorry for the inconvenience. We did not receive a notice from Discover, for in this sort of occurrence we would have. Is there any way you would be able to send the notice you received to us?"

When I contacted Discover, they informed me that the merchant can issue the refund, since the notification was sent back in July.

Merchant 10/**/2013-"[redacted], thank you and we will issue the refund as soon as we receive a notice on how to do this from Discover. We never received the notice. Please have them sent it to our mailing address and/or company email. These are:[redacted] I am sure they sent notices to our old address at the palisades of which it will get lost. "

When I contacted Discover, they informed me that the resending of the letter would have to be done directly by the merchant. This information was sent to the merchant:

"Good afternoon,It seems that the letter might have gone the old address and only you can request the letter to be resent at merchant services at Discover:###-###-####.Otherwise, I have to go through the process of reopening a dispute charge.This has been a frustrating situation and I thank you in advance for responding and trying to work with me.Dispute Case #[redacted] "

A follow up email was sent on 11/**/2013 about the matter. The auto response was received:

"Please note that we have closed our doors at the [redacted]. We are planning on continuing our business by offering mobile events - we come to your venue to host tactical laser combat events. Paintball will be discontinued until further notice. If interested, please reply to this email, or visit [redacted] for more information. Thanks again."

I contacted Discover and opened another dispute. I submitted all of the email conversations, but was told that the time lapse was too long and they cannot retrieve the funds. I emailed the merchant again explaining the situation and requesting the a refund check back, since services were NEVER rendered and they no longer participated with Discover card.

Since then, I have not received a response back.Desired Settlement: I would like to receive the money I paid for services that were never rendered. The merchant agreed to repay me, but never did. Again, I have all of the emails saved as proof.
