On July 19, 2013 we contracted with Tony W[redacted] from Veterans Waterproofing (PA Lic# [redacted]) PO Box [redacted] PA [redacted], ###-###-####, to waterproof our basement. After examining the basement he gave us a price of $6820 to waterproof it. The contract has a lifetime warranty. My father was concerned about water filling the cellar well in the front if the house that was allowing some water to come in through the window, so W[redacted] also agreed to dig out the cellar well and add stone for drainage and added that to the contract. Also added to the contract was putting in a jiffy drain by the basement outside door. We gave W[redacted] a check for $3410.00 (The terms were for 1/2 down and 1/2 when the work was completed) to waterproof our basement. The work was scheduled for July 26, 2013.

After signing the contract and giving W[redacted] the check he announced that he would be going into the hospital in the next week for hernia surgery, but that it would not affect anything concerning our agreement to have the work done because he himself does not do the work, he employs a team that does it. I was concerned about who to call if we had any questions or problems while he was in hospital and recuperating, so he gave us his personal cell phone number (###-###-####) and said to call him if we had any issues.

On July 26, 2013 his team came in at 7 am as scheduled and performed the work. It took them less than 5 hours to complete the job and we paid the remaining $3410.00.

We questioned why the pipes that were installed to the sump pumps to push the water outside were laying on the lawn instead of connected to a drain and buried and were told that they do not bury them because they might freeze in cold weather. As they were, the water drained into the lawn and turned it into a swampy mess. They said that the pipes were detachable so that the lawn service could remove them when they mowed the lawn. We told them that the setup was totally unacceptable and they would need to connect the pipes to a drainage pipe (which is already there) and bury the pipes.

We were not given any paperwork for the two sump pumps, which carry a warranty, so we had to request to get them.

The sump pumps did not have any alarms or indicators to show us whether they are working or not, so we requested they put alarms on them because sump pumps are normally installed with that feature. They refused and said they don't provide them.

We were told to contact Tony W[redacted] about our issues.

They came back and connected the sump pump drain pipes to the outside drain and buried them, as we requested. We were given the booklets that came with the sump pumps. They did not put alarms on the sump pumps.

A week later it rained and the basement flooded again. I called several times and left messages for them to call me. I finally got a call back and a worker was sent to check and repair the problem. It flooded again August 9, 2013 and as of August 19, 2013 we had not had any success with getting a hold of W[redacted] to send someone back to do the repairs.

After leaving several messages to Tony W[redacted] to call me and schedule a time for the repairs to be done, I left a message that said that I would be contacting the Attorney General and the Revdex.com if I did not hear back from him. I did not hear from him so I initiated contact with the PA Attorney General’s Office and the Revdex.com on August 19, 2013. I put in a complaint, but since he subsequently contacted me and arranged to do the work, so I did not pursue my complaint.

The subcontractor that did the work (Jim Williams ###-###-####) has been back several times to fix the problem and has acknowledged to me and my nephew Matthew Lovell (###-###-####) that there is a problem but he cannot figure out how to correct it. June 3, 2014 Jim called back and said he would try for next week. (The week of June 8-14, 2014).

Water is still coming up under and around the steps where they tore up the concrete floor and put in drain pipes.

I called again on June 12, 2014 because we hadn't heard from him.

I also called Tony W[redacted] to let him know that the work still needed done and we hadn't heard back from Jim. Also because W[redacted] is the owner of the company I felt it was necessary to keep him informed so he could not come back and claim to not know what was going. After being belligerent to me he said that he and Jim agreed that the water was coming in from the windows and he then told me to contact Jim directly because he (W[redacted]) didn't want to deal with me any more. I then called Jim again and left a message telling him what was said in talking to W[redacted] and that W[redacted] wants me to deal with him (Jim) directly and I asked him to please return my call.

I did not get a call from Jim so I called him again on June 19, 2014 and left a message stating that there is still water coming up around the steps and it is not coming from the windows as we had the windows sealed shut and have had heavy rain since we sealed them and there is no water coming through. I asked him to please call me and let me know if he was going to resolve the issue or not, and I also informed him that this was the last call I was going to make to them. As of August 31, 2014 neither Jim W[redacted] nor Tony W[redacted] has called us back or have had any other communication with us.

Problems:

Water is still coming up under and around the steps where they tore up the concrete floor and put in drain pipes. (There is not now nor has there ever been water coming down from the first floor.)

After a heavy rain water breaches the jiffy drain that they installed and flows around it into the basement.

It is wet in both corners where the sump pumps are installed.

We have not yet received the Lifetime Warranty papers. W[redacted] said he sent them. I told him we did not receive them and I've asked him several times to please resend them.

Resolved Issues:

Any water that did come in from the windows has been resolved. We sealed the windows shut.

Any condensation coming from exposed pipes were resolved with insulation.

The water heater split (the workers had to have seen it but nobody told us) causing some wetness but it was replaced as soon as we discovered it.

W[redacted] has been belligerent to me every time we talk. He comes up with excuses about where the water is coming from, always blaming something other than their work. If it was they certainly would not have come back several times a to dig up the floor again to do repairs.

He came to our house unannounced and proceeded to call me a liar because I said we had not received the warranty papers, and then he accused me of pouring a bucket of water on the basement floor. He also accused me of using a hose to fill the outside cellar step well as if I was being malicious! (When, in fact, he, his workers and my nephew were here and they ASKED me spray water in there while they were watching to see where the water was coming in from and diverting from the jiffy drain!) His belligerence, accusations and excuses upset and angered my dad so much that he asked W[redacted] was to leave the house.

At no time did anyone here EVER say anything about water coming down from the first floor. I have no idea where he came up with that one. (He wrote that in response to a letter from the Attorney Generals office)

W[redacted] is still using the excuse of his hernia surgery whenever I try to talk to him about the issues we still have. He has been nasty to me ever since because I will not accept his surgery as an excuse- he assured us that the surgery would have no impact on the work his company was paid to do. He also keeps saying that I have to agree that it is 99% better. No, I do not agree. We paid him to waterproof the basement and it is still wet!!!

My phone records for my cell phone and the landline show that I placed 36 calls to either Tony W[redacted] (###-###-####, ###-###-####) or Jim Williams (###-###-####) since July of last year to try to get this resolved.

My dad will be 89 years old on August 2, 2014. It’s been over a year since the work was done, so having to deal with this situation for so long is taking it’s toll on him as well as me.

We have retained an attorney, Jonathan Bach from Mathers & Stapp (###-###-####) to intervene by writing a letter to W[redacted]. However, we want to see if there are any other avenues that we could pursue to help us resolve this without having to spend money on lawyers and lawsuits.

[redacted]Desired Settlement: At this point, since it has been more than a year, we would prefer a full refund so we can hire a different contractor to complete the job. Otherwise I want the work that they were paid in full on July 26, 2013 to be completed and in a timely manner, and that they honor the lifetime warranty.

Review: We contracted and paid 1/2 down to waterproof the basement. The contract has a lifetime warranty. Work was done on July 26, 2013. Contractor was paid in full after completion of the work on that day. A week later after a rain the basement flooded. After several phone calls (over several days) a worker was sent out to check and repair the problem. It flooded again August 9, 2013 and so far we have not had any success with getting the contractor back to do the repairs. We talked with owner [redacted] several times. He assures us that he will "take care of it" but neither he or any of his workmen have been here nor have they given us a date that they will be here to do repairs. They also put pipes out on the lawn (above ground and not connected to any drains) for the sump pumps to pump out water. I questioned the placement and was told that it is always done like. After talking to other contractors I find that it is not so, they should be buried and connected to a drain. We have not recieved any warranty paperwork, no manuals or paperwork on the pumps that they installed, no alarms on the pumps to warn when they are not working. **. [redacted] said he would come and look at it and follow through with making sure all work was done properly and that we are satisfied. He has not come to check any of the work that was contracted and he has yet to set up a time to come himself or send his men out to do the repairs. [Shortly before we contracted for the waterproofing we had a company ([redacted])come in and clean and paint mold rdent on the walls and wood. They could not complete the job because of the water problem and are waiting for the basement to dry so that they can come to complete their work. They were paid in full and hopefully will honor their promise to come back and finish the job.] This ongoing unresolved situation has been especially stressful and frustrating to my dad, [redacted]-the homeowner, who is 88 years old paid for the work. We both signed the contract.Desired Settlement: The work is warranted and paid in full. We are asking that they make repairs and complete the work that they were contracted to do in a timely fashion and not be continually putting us off.

In reference to [redacted] &[redacted], This complaint was resolved we were out and took care of water issue that was not in wall area. It was under steps. we still took care of water problem at no charge. We also redirected Discharge lines to make customer happy. I hope this resolves this issue

I am rejecting this response because: The issues are not resolved. They finally responded to our requests and came back and did some repairs, however, it did not fix the problem as we are still having water issues. I called to report the problem and have as yet not recieved a call back. I do not understand them saying in their response to the Revdex.com "we still took care of water problem at no charge". The work that was contracted, paid in full and has a lifetime warranty is for basement waterproofing. We have had issues since the original work was completed. I expect the repairs to be done correctly and in a timely manner.
