The customer purchased a “Paid in Full” one year membership. “Paid in Full” memberships are sold at a discount when compared to a monthly dues membership. While a “month to month” dues membership at Victory MMA costs more, it may be canceled at any time, without any additional costs. Conversely, the “Paid in Full” membership is cheaper, but isnon-refundable. This is due to the fact that a discounted “Paid in Full” membership is basically a “sale item.” This is specifically delineated on the first page of the customer’s contract, directly above the signature line, in large bold type. It states “Canceling a “Month to Month” membership only requires a day written notice. “Paid in Full” memberships are non-refundable after days.” Nevertheless, I spoke to the customer personally and informed her that I would be more than flexible, and that I would make an exception and allow her to transfer the membership to a non-member, in which case she could keep whatever proceeds she received from such a sale. This position was not mandated by law, or the agreement the customer signed. In fact, the contract specifically delineates that the membership is “not transferable” to third parties. So my decision to allow such a transfer was purely a courtesy to the customer. At present, I am still happy to extend this courtesy to the customer. I would hope that a fair review of the facts delineated herein would lead the customer to realize how exceptionally well she was treated during her approximately three years at Victory. In fact, every membership the customer purchased over a three year period at Victory was at a deep discounted “Paid in Full” sale rate. She was even given a free membership for an entire year, from March 13, to March 13, The total monies spent by the customer and received by Victory was $1,350.00. Given the customer chose to join another local facility and leave Victory MMA around January 2015, the windup was that she ended up training at Victory MMA for approximately months. That means that she paid about $a month for the months she trained here ($1,divided by = $41.00) That is $a month cheaper than our monthly dues membership, which is $a month. So the customer stillreceived a deep discount, saving about $over the months by buying the “Paid in Full” discounted memberships, and she still has about two more years of “Paid in Full” membership privileges here at Victory MMA, that she can still use, or sell to a non-member. In conclusion, I recognize that even though the customer was afforded significant discounts throughout her time here at Victory MMA, and ended up paying only $a month for the months she trained here, and further can easily see that the contract provides for no refund on “Paid in Full” memberships, and that memberships are “non-transferable,” it is still distasteful for her to leave two years of membership privileges unused. However, I do hope that her uninfluenced and sincere review of the facts will highlight that she enjoyed months of membership privileges at a great and friendly club, all at a significant discount to the standard prices, namely about $less than if she were to have paid the $a month rate. Nevertheless, as an additional courtesy to the customer, who I remember to be a friendly, fair, and honest person, I will extend the period within which she can sell the two year membership. At present the two year “Paid in Full” membership she purchased has a start date of March 17, 2015, and an end date of March 17, 2017. If that membership is sold now, or in the future, it would be for a term less than the full months. But as an additional courtesy, if the customer was to sell the membership within the calendar year, I would be willing to permit a sale that affords the new member a complete two year term, which will enable the customer to maximize the price that she can sell the membership. And the customer should know that if a sale is not consummated for any reason, that she is always welcome back at Victory MMA, and would be afforded the same time extension delineated earlier. Lastly, due to what appears to have been some miscommunication and/or misleading influences that have led to our present situation, the consummation of any arrangement, and the coordination of details of any arrangement, must be made by the customer directly with me As was the case when we verbally discussed this matter previously, although Victory MMA is under no obligation to issue a refund, or to allow a transfer of the customer’s contract, I am still open to allowing the customer to transfer the membership for her own personal gain. In addition, the customer can still be assured to be treated with the utmost respect, to be afforded an abundance of courtesy, to receive a truthful depiction of the facts and representations, and to get a very fair deal. Review: I was a member at this gym for about 2 years and I paid for gym membership about 6 month in advance . It was for 2 years $600 . The reason I agree to this is because they offered me a deal which is way cheeper then usual. During that time , they told me that they are giving me this deal because I I'm going to pay for something in advance. After cuple month I found out that my job location will be changed and it will be hard to keep going to this gym . My schedule will not match their class schedule. So I asked if it possible to have a refund for those 2 year since I haven't used yet. When I asked them for refund it was 3 month before this 2 years membership starts. They told me they won't accept any redound and only way I can get my $600 back will be to transfer this membership to someone else.

My co- worker who is already a member there offered that he can take that 2years $600 deal . But when I went back and told the gym about this they told me they won't accept this since it has to be someone new to the gym . Even offered to pay $800 for 2 years ($600 to me and extra $200 to the gym) they didn't accept it . Do have this conversation, I was trying to talk to the manager in person . But when I see him he goes "I'm going to take my dog for a walk " and left . So he chose to walk his dog instead of talking to the customer . And I ended up emailing him about this issue.

I am very upset about this becouse 1. I paid for something way in advance (6 month) and this was unusual situation . 2. they are refusing to pay me back something that I didn't even get service. 3. I understand to their unusual situation and corporate but when it came to my side of unusual situation they do not show any effort to meet the agreement . And also I didn't get any explains that there's no redound or it has to be non member to transfer the membership when I agree to pay in advance . 4. Bad customer surviceDesired Settlement: I think they need to be more flexible about customer service . By this matter , I felt that this place will too anything to make them self profit but when it comes to customer service, our customers desire they will not accep anything else.

That is $18 a month cheaper than our monthly dues membership, which is $59.00 a month. So the customer stillreceived a deep discount, saving about $600.00 over the 33 months by buying the “Paid in Full” discounted memberships, and she still has about two more years of “Paid in Full” membership privileges here at Victory MMA, that she can still use, or sell to a non-member.
