Review: On May 11, 2016,I spoke to [redacted] of Villages of Garst Creek and was told she did not know anything about returning the May rent because

it was sent to F & W Management since it was an exceptional case. Also, she said maintenance did a walk through of the apartment and found

nothing wrong - normal wear and tear so the deposit would probably be returned.

On May 11, 2016, a message was left for [redacted] of F & W Management asking for a return call. On May 12, 2016, I received a call from [redacted] of

F & W Management and was told I should be talking with someone from Village of Garst Creek because they handled this.

Again I spoke with [redacted] and was told it was up to corporate to make a decision. I again left a message for [redacted].

Well I was out, someone from corporate left a message (they did not leave their name) wishing my stepson a good recovery and so sorry it happened.

Also thanked me for my patience but never gave any answer to whether the May rent or deposit would be returned or when.

[redacted], manager, of the Village of Garst Creek, according to [redacted] has sent the paperwork to corporate to take handle but corporate is saying

it is being handled through the Village. I feel we are getting a run around and would like to know how better to handle this. I would also like this letter to be a complaint against F & W Management and the Village of Garst Creek. This matter has been discussed since April 25, 2016. I have done everything asked of me by getting the doctor letter requested and paying May rent as well with the clear possibility of getting it back even signing a 30 day notice as asked "for his file".Desired Settlement: Refund

However, due to [redacted] medical reasons, he was granted a 30-day written notice to vacate Villages at Garst Creek. Written notice by Mr. [redacted] was given to the Villages at Garst Creek office on 4/25/2016, with intent to vacate on 4/30/2016. Payment is required through 5/31/2016 to comply and accommodate with the 30-day written notice for medical reasons. A full refund of the security deposit ($200) was returned via mail to Mr. [redacted], to the address provided to Villages at Garst Creek, on 5/12/2016. Thank youF&W Management

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I disagree with the decision made regarding May rent. I feel they are being unfair after doing what was asked of me; believing the $545.00 was to be returned within 30-45 days, according to the lease. This matter has been discussed since April 25, 2016. I have done everything asked of me by getting the doctor letter requested and paying May rent as well with the clear possibility of getting it back, even signing a 30 day notice as asked "for his file".

A full refund of the security deposit ($200) was returned via mail to Mr. [redacted], to the address provided to Villages at Garst Creek, on 5/12/2016. Review: I moved into a townhouse at this complex in May of 2013, signing a one year lease that would end May 30, 2014. At the end of a lease, you are required to submit a 60 day notice upon move-out. The move-out date came and passed, as I decided to keep my lease for a few more months. I went to the leasing office to file a 60 day notice that I would be moving out, at that time, it put the end of my lease at September 30, 2014. On September 28, 2014 my fiance, our almost 4 month old son, and myself moved . I returned to our townhouse on the 29th to clean, and leave the apartment in a tidy manor. I left my two keys belonging to the townhouse in the drop box at the leasing office, since they are not available on Sundays. I called on Monday, September 30, got no answer, so I left a voice mail, leaving my name as well as my phone number and requesting a return phone call. I never received a phone call, so I pursued them once more. I was calling to let the office know that my keys were in the drop box, as well as provide them with my forwarding address so that I could receive my security deposit back upon inspection of the townhouse. Once more, I never received a phone call back. October 17 roughly, I spoke with [redacted](leasing agent) at the office, let her know I had been trying to reach out to someone to give them my forwarding address and to let them know my keys were in the drop box. I was informed that I would receive my security deposit via check within 30-45 days. I received my check within 2 weeks, only to find out I had been charged a few days rent due to the leasing office not knowing who's keys were in the drop box. I called to explain I had left voice mails that went unanswered, and have phone records to prove that I had called multiple times. The staff was rude with me, expressed that they would not be returning my money to me, and that it didn't matter that I had proof that I had called. I have never in my life dealt with leasing staff of that nature, and there are a few women that do not deserve to have the jobs they have. I would never recommend this company. Also, upon calling the office for the sixth time after I did not receive a phone call back from the property manager like I was promised, a woman who's name I do not recall was extremely rude, cutting me off as I mentioned why I was calling again, I was handed off to [redacted] once again, who was polite, she was relaying what I could hear the property manager saying in the background. Apparently she refused to get on the phone with me to discuss anything regarding to my call.Desired Settlement: I would like a refund of the money I was originally supposed to receive.

Ms. [redacted] signed a one year lease with the Villages at Garst Creek on May 5, 2013. Within this lease it defines the procedures for termination of lease, move out procedures, and inspection of residence for deposit refund requirements. Ms. [redacted] submitted a "Notice to Vacate" on July 14, 2014. This is a (60) sixty day notice to move that is only accepted at the first of each month. Within this notice it states the requirements for returning resident keys to the rental office.

Ms. [redacted] did not return her keys as defined within the move out notice. Her keys were discovered unidentified and unmarked on a black generic "hair tie" within the property correspondence box. A message was left for Ms. [redacted] on October 2, 2014, in an attempt to confirm her move out status, as no identifying information was given to the rental office after her move out notice was received. On October 21, 2014, Ms. [redacted] called the rental office questioning a deposit refund she had received. It was explained to Ms. [redacted] that her full deposit of $200 was not able to be refunded, as she did not return her apartment keys appropriately and as requested within the notice to vacate. The unmarked keys remained anonymous until October 15, 2014. Ms. [redacted]'s final account statement was then generated and as a courtesy reflected a "back date" to October 2, 2014. Ms. [redacted] then received a deposit refund check to reflect an additional (2) days of rent for the unmarked apartment keys.

The Villages at Garst Creek values all of its residents. We strive to go above and beyond when considering resident concerns. Several exceptions and accommodations were given to Ms. [redacted] during her move out process. At this time the Villages at Garst Creek will not be able to refund her any additional funds based on the information at hand.

Review: I went to the Villages on 3-26-2015 to fill out an apartment application. Before my arrival I had spoke to a woman in the office named [redacted] she told me to go ahead and bring my app fee and deposit to get it out of way. Prior to my arrival I ran to [redacted] and got a money order in the amount of $225, $25 for my app fee and $200 for my deposit. I still have the money order receipt if needed for prof of funds given to [redacted] on that day of 3-26-2015. I then arrived filled out all necessary paper work and before I left the complex [redacted] gave me my unit number and wanted me to go check it out on my way out and assured me everything was a go. In my excitement the following day I called [redacted] on my lunch break to check in and make sure I was still getting my keys when I got off that evening. That's when [redacted] informed me that I made to much and wasn't gonna be able to move into the complex and that she was sorry. I naturally wasn't happy of this news and felt I was done wrong. I asked about my deposit of $200 she told me that it would have to be sent from corporate and it would be 2 weeks before received. I asked why they couldn't just cut me a check where it wasn't even 24 hrs. She said the accountant had left for the day. Much to my dismay I said ok.

2 weeks now have gone by, still no check. I called the villages and spoke to [redacted] and she told me to give it a few more days. I gave it way more than a few days with the way I work. I then go to the complex seeking answers and well wanting my money. I got the run around and that someone would contact me which they didn't. I called left message after message no on I mean no one returned any of my calls.

The last time I spoke to an actual person was on 5-8-2015 the lady assured me that she was from corporate and my check would be cut and mailed on that following Monday. The woman never gave me her name, I then asked for cooperates number because I have heard this for almost 2 months now that my so called check is coming. She said I quote, Ma'mm I am corporate you don't need the number, I chuckled and said thanks for your time.

We are now at 5-19-2015 still no check and I have called the complex office and yet again no one answers or returning of my calls.Desired Settlement: I just want my refund back of $200.

A check was processed to Ms. [redacted] on 4/16/2015 and mailed to the address provided by Ms. [redacted]. The check was never received. After speaking with Ms. [redacted] on 5/8/2018, she verified we had the correct address, we stopped payment on the first check and reissued a new check on 5/8/2015. That check was also never received. We have stopped payment on the second check and reissued a third check. Ms. [redacted] picked up the check personally on 5/21/2015.
