Review: I live in Virginia hills west in imperial pa. I have had 3 trees the most recent being last night, and I have called the park office about it and they told me that because my rent is behind they will not remove the trees nor will they reimburse me for the trees being removed. I understand my rent is behind but those are my reasons as to why. the tree that had fallen last night is in the middle of my back yard also where a power line is ran on top of the ground and where my kids play. this is more of a safety issue than a who pays their rent and when . also there is a community pool, which is never opened.or if it is open its not open for very long, or its only open to their family or friends or the chosen few. this is an on going problem and something needs to be done. if I am responsible for keeping up my obligations, why are they not responsible for doing their part of the lease? which I have not been given a lease since 2009. also in 2009 a tree of theirs had fallen on my car, and when I took the car and the tree up to the park office, [redacted] told me that it was not her problem, and that I either had to put it under my homeowners insurance or my car insurance. why was this my problem? someone needs to make these people realize they are slum lords and the residents are suffering from their lack of business skills communication skills and also suffering from being put in harmful situations. please feel free to contact me with any questions. [redacted]Desired Settlement: I would like for someone to look into this problem and solve it. I also want to be able to swim in the pool whenever I choose because I am a resident and that is discrimination. I also want respect and an apology straight from MGT!

Ms. [redacted] has been filed on 11 times for non payment of rent and is scheduled to be filed on again today for non payment as she owes over $700 again. She only pays the rent when we have a court order and the constable is called in for possession. As for her lease she did not come in when we redid everyones leases in Feb. of 2011 ( I had 5 meetings at different times of the day and evening so everyone could come in and do new leases) so I have no new lease to give her.

As far as the pool goes the rules of the community state that you must be current on your rent and have no rule violations to use the pool. Since Ms. [redacted] has not been current on her rent since October 26 of 2012 she is not able to use the pool. The pool is open Tuesday through Sunday from 11am-7pm and can be used by any resident who is current and has no rule violatoins (this is clearly stated in the guidelings that every resident received a copy of with their initial lease and a copy of which is posted in the office and kept at the pool). We have log in sheets that the residents who use the pool sign in on, that can prove that many different residents use the pool not just "friends, family, or a chosen few" as she states. In fact my younger children have only been in the pool 3 times the entire year. My 16yr is the lifeguard so she is there everyday that the pool is open, and my oldest hasn't been swimming in the pool once this year. I think if I was making special accomodations for anyone, I would make sure that my youngest children went in the pool all the time instead of just maybe once a month for an hour or two! Not to mention my husband and I have only been in the pool once this year for 15 minutes!

As far as a tree issue in 2009 I'm not sure as to what she is talking about. I know that trees do sometimes come down in high winds and/or heavy rain when they uproot. In those cases I let the residents know that is was basically an act of god and their homeowners should cover it (which it always has). I know there were 3 trees along the side of her driveway that we had taken down due to them looking unstable (we had a tree service come in and do the work). I did receive a call from Ms. [redacted] yesterday in regards to a tree in her back yard that was leaning and I stated that I would need to get a tree service to look at it this week to see what can be done about it. (she did not state it was leaning toward her home or personal property just into her back yard) I know she did take trees down in her yard/hill in the wooded area behind her home to clear a space for her to have a "fire pit" which is against the rules, and it appears that the clearing she did in that area is what is affecting the other trees and the stability of the entire hillside. She did not ask permission to take down those trees, she just took them down.

The electric lines in the community are owned by the power company and our not our responsibility and we can not touch them. If she has an issue with a power line she would need to call West Penn Power to come look at it and make any repairs needed. But I find it highly unlikely that it's a power line since those are buried by the power company when they run the lines and they have to be at least a few feet under the ground. (this is the first time I have heard anything about a power line)

As far as an apology goes she will not get one as we have done nothing wrong to apologize for. We have given Ms. [redacted] more breaks than anyone else. She was technically evicted last month since she did not have the money to satisfy the judgment when the constable came to lock her out and she told him she was going to get the certified funds and would be back in 30 minutes. Over an hour later she was not back so the eviction noticed was posted on her door, but we did not change the locks so she could get her animals instead of us sending them to animal control. She proceeded to ignore the notice and put a post dated check for the rent into our drop box and we accepted it and let her stay. I think allowing her to do that alone shows that we are not disrespectful but just the opposite! If anyone is disrespectful it would be Ms. [redacted]. I did ask her yesterday after I let her know that I would need to get a tree service in, when she was going to pay her rent as I was going to file today (since I did not have her phone number to call her on before), and her response was to call me a "fking bh" and hang up on me. I never once cursed at her or used any foul/abusive language toward her.

I feel that since she is going up for eviction yet again for not paying her rent that she is grasping at straws to try and stop it, as this time we will not be bending any rules for her. We have numerous residents in here who do like the job that we are doing and remark at how well the community looks since we have been here and who also realize that what we do (having to send out violations letters/file for eviction) is just our job and having to do that does not make us bad people.
