I signed up for a free class for my child. We arrived at the class and she took the free class with an instructor and at the end of the class they asked if I'd like to sign my child up for ongoing classes. I was told my child could attend 3 classes per week, there was an $97 initial payment and $147 monthly. I accepted because my child seemed very interested and I was hopeful it could help with discipline and focus as I'm a single parent and could use all the help I can get. I paid and signed the contract. Please note that it was at the end up the free class and my child is excited about what was learned, so I'm focused on keeping a 5 yr old quiet while I'm trying to discuss details with the program manager. Later on I wanted to pull my child from the class because our schedules weren't allowing her to attend regularly and I feel like I'm wasting $147 a month. I reached out to the program manager and explained our situation. At first, I was told they could credit a month at the end of the year program. Then when I asked to remove her from the class, I was told they could not stop the payments. If I wanted to cancel the contract there would be a 90 day period until the contract was actually cancelled, and I would have to continue paying the monthly fee during that time. She explained that this was outlined in the contact I signed. At no point, did the program manager mention during that initial conversation that I was locked into the price for an entire year and that if I wanted to cancel the contract I would have to wait 90 days after I submitted the cancellation request for it to actually be cancelled. It's bad business and ethically wrong to withhold this major information when asking someone to sign a contract knowing their child is in the room and you can't 100% focus on reading through a contract. If you can communicate the pricing/services, then you should be able to communicate the major points of the contract. I feel like I'm being taken advantage of. Business Response The information around cancellations is covered in both the contract itself, which the customer receives a copy of, and is reviewed by the program director during the initial lesson.From discussions with the customer we explained that we had to follow this as it was in the contract itself. however we offered her a 90 day gift certificate to use once her schedule cleared up.Upon further discussion we have terminated her membership with 30 days notice and have notified the customer of this fact.Consumer Response The information around cancellations was not reviewed with me during the initial session with the program manager. I was only told about the initial and monthly payments and the number of classes per week that were offered. When I spoke with Mr. [redacted] he did offer a 90 day gift certificate to use once my schedule cleared up. However, I was not happy with that because after being blindsided by the 90 day termination clause it left a bad feeling about the business overall. With respect to the last statement: "Upon further discussion we have terminated her membership with 30 days notice and have notified the customer of this fact." I'm not sure what this means. The last time we spoke, I was told I would have a 90 cancellation period where I still had to pay the $147 a month (meaning I would continue to pay through October 2016). They offered the gift certificate but I declined that for the reason above. I wasn't contacted about the termination of my membership with 30 days notice or does this mean the same thing? Will further payments continue to be drafted from my account through October 2016?As I mentioned before, it's bad business and ethically wrong to withhold this major information when asking someone to sign a contract knowing their child is in the room and you can't 100% focus on reading through a contract. If you can communicate the pricing/services, then you should be able to communicate the major points of the contract such as the termination clause.
