Review: Ever since Walnut Capital has taken over my apartment building the services have been subpar and going down hill. The heating issues have been ongoing and for a week last year we were without heat causing them to take $20 a day off of my rent totaling $100.00. I have called numerous times to complain without resolution. I pay my rent on time each month even as the rent has consistently increased each year. My apartment is freezing and with temperatures dropping to negative high's this is a dangerous situation. The solution the company has given is to provide small space heaters, which doesn't compensate for the lack of efficient service. My complaints have fallen on deaf ears because they do not have to deal with being cold personally. I have to vacate my home because they refuse to hire individuals who can take care of this issue. When the on-call repairman came he said he could not bleed the radiators so he couldn't help. He called the maintenance man ([redacted]). The message was relayed to me as him saying they have tried to fix it but can't get the heat up there leave her a heater. He doesn't care, Walnut Capital doesn't care so I will be deducting $20 from my rent each day I am without proper heating as the company did last year when we were left to freeze. Additionally, there has been a big hole in the floor on the lower level for roughly about a year that has been covered with boards (another issue). The back door needs repair and I have called in about this security issue which went without repair as well. This organization charges high prices but fails to keep the quality of living high for tenants. This is by far my worst experience living in one of the more affluent communities of the city.Desired Settlement: I am requesting reimbursement of my hotel expenses (if applicable), reimbursement of the days I paid for without heating, mental anguish because this has been an ongoing stressful situation. I work every day, pay my bills on time and to be treated as though not having heating is not an issue is discouraging. My electricity bill has gone up because I have to use small heaters and have to keep them running for hours. I have not been able to enjoy my home for quite some time.

Review: I had signed 12 months lease that will expire by the end of April, 2014.On June, 20, 2013 I lost a job. I informed Walnut Capital that I would like to break a lease and move out July, 27, 2013. July, 27 I moved out to the State of [redacted] and paid for the whole August, 2013 and left to them my security deposit. In the lease they did not have "Early break lease" policy, and the informed me and requested signature that I have to pay for the apartment until the lease will expire (up to April, 30, 2014) unless someone rent the apartment.I believe that this is not fair: normally if you under contract and would like to brake it you pay penalty fee for one or two months (Examples: other apartment leases, cell phone contracts, Cable/TV contracts, etc). I would agree to pay such penalty but paying for the apartment another 8 months, I believe, is not fair.Could you help me with this issue, please?Sincerely,[redacted].Desired Settlement: I am ready to pay penalty (that should include payment for additional month, August, after I moved out and left security deposit), but not until the lease will expire.

This is in reference to complaint ID [redacted].

Walnut Capital entered into a written lease with the complainant, which was renewed for another year - ending April 30, 2014, on January 23, 2013. The renewal clearly stated (right above the signature line) that:

"I understand that all terms, conditions and remedies set forth in my Lease Agreement shall remain in full force and effect."

He notified us in June 2013 that she wanted to "break her lease". We have the same policy for all of our tenants for lease breaks. We do not make exceptions, or special deals. All are treated the same, as described in our written lease. He is responsible for the rent on the apartment until we find a new tenant. This is what we told him, and what is in the written lease she signed.

He also signed our "lease break" form - copy attached, which clearly states our policy as well.

Apparently, he feels that some other arrangement should be made - contrary to our written policy in our lease and in the lease break letter. No reason is given, other than this is what he had with a different landlord in [redacted]

We have told him this and that we treat all our tenants the same.

At this point, there is nothing further we can do to resolve this matter.
