I hired this company in 2013 to build an addition onto my existing house.I met with the owner [redacted].At the start of this he claimed that he could save time and money by drawing up the plans for the addition himself as he said even though he didn"t have the academic creditials he was skilled at it and had a computer program that he used.After my paying him thousands of dollars for a very poor/unusable unsuccessful set of plans [redacted] he produced a small set of plans and said his engineer would complete the rest of what was needed.He went ahead and started digging and ordered the windows and [redacted] forms.As things continued with him still not producing satisfactory drawings and I was getting very concerned as to his ability I took the drawings he had provided to [redacted] where [redacted] reviewed them and expressed deep concern that these were totally inadequate.When confronted with this finally admitted that he had no experience with this prior to my job.He apoligized and [redacted] said he would make it right by hiring [redacted] to redo the drawings and gett them properly engineered.So I agreed to give him another chance.At this pointalso with the ground dug up and supplies already on my property and so much money already paid out I felt compelled to continue.Constuction during this was also delayed due to the need for [redacted] needing to move my power meter.At the time of signing the contract with him ,he told me that Walnut construction only hired 3rd year apprentices and full carpenters.that from start to finish it would take them 3 months as would be his priority to get it completed,that [redacted] his second in command would be on site running the job dealing with any of my day to day concerns and making sure everything was done correctly.when things were finally able to go ahead at the end of December unskilled laborers were sent.[redacted]Product_Or_Service: construction workDesired SettlementA refund of missing material that I paid for.refund of money for unskilled laborors instead of appentices,refund to pay for all the incorrectly done work Business Response [redacted]Much of what the client has outlined in her complaint is accurate. There are some details that I remember differently and they are as such:Drawings1) The drawings that I provided were adequate for construction (the municipality approved a building permit based on them) however I was advised that it was risky to proceed with less detailed drawings with this particular client after speaking to several associates who had experience working with her. This combined with my clients concerns prompted me to accept the $5000 loss and have new drawings made. I accept the poor decision to provide the drawings myself, remember my motive, I was trying to save my client money. In the end, I provided drawings that were professionally drawn at my cost.Skill of Staff2) At the time of signing the contract, I didn't say we only hired 3rd year carpenters and higher. I said we only hire Journeyman Carpenters and tradespeople, and staff who are serious about an apprenticeship. We don't hire casual labourers. This is still true today. After the signing of the agreement with my Client I did hire a returning staff member who had previously worked for Walnut Construction who was not an apprentice. I hired him because his history with the company was good and he was dependable. I will take responsibility in not informing my Client of the hiring of this individual.Management3) The intention was to have my Project Manager work onsite with the staff to ensure a smooth construction process. Shortly after construction began our company was called upon for emergency disaster remediation due to flooding. This spread the company thin and we hired and placed a Site Manager to work onsite while reporting to the Project Manager. What we were unable to prepare for was the relationship between this Site Manager and the Client.[redacted]The Client changed the design of the project from an early stage: exterior finish, floor plan, window location, etc. We adapted to the changes and moved forward, despite the confusion it caused. I believe we were accommodating to the whims of the Client.Shortly before the building was framed the Site Manager told us we were changing products for the air barrier. He spoke to the Client and they decided without speaking to management. The Site Manager does not have the authority to make such decisions or to suggest them to the Client. In so doing they undermined our ability to manage. We spoke to both the Site Manager & Client about coming to us first in the future. Management at Walnut makes the decisions with the Clients, not a Site Supervisor. We moved forward thinking this was now clear. The project proceeded with no complaints from the Client. I never received any correspondence from the Client indicating any issues with the work. I had informed the Client at the onset that should any issues arise that I be contacted. I am ultimately responsible for the actions of my company and I need to be notified at the first sign of trouble. [redacted] However the project proceeded without ant correspondence from the Client regarding serious concerns.[redacted] The next morning the Project Manager received a text from the Site Manager, demanding that we remove our tools and equipment from the job site, that my Client was cancelling the agreement between us, and that the text was his final notice and resignation from Walnut Construction. My Project Manager, & I were surprised. Up to this point we were unaware of any event to warrant such a reaction. Further the Site Manager has no authority to cancel agreements Walnut has made with its Clients. At this time we were installing the roof and siding. The roof metal that was installed over two days, one side one day, the second side the next. We sent a carpenter with experience installing metal roofs & he instructed the onsite staff. The second day the staff worked without the carpenter. One of the apprentices did not listen to instructions and caused dents in the metal. Another carpenter was installing siding and was having equipment malfunctions causing some siding to be installed poorly. I knew about these two particular issues and was in the process of working out solutions. [redacted] When the Site Manager resigned, I tried to get a hold of the Client. I sent two emails that went unanswered and then a third. In all three I reminded the Client that I needed to be informed about any issues and would like to discuss as soon as possible. The response I finally got was simply "No!" to all my requests, & that I and my company had let her down. [redacted] After the Client refused to discuss solutions I began doing more investigating into the project and its issues. Each staff member that worked onsite was interviewed and asked for their testimony as to what happened, their responses were documented, and the full story began to come to light. [redacted]In conclusion, as I have requested many times previous to this, I would like to reconcile our differences, before either party begins to incur legal costs. Currently the Client has an outstanding invoice for $49,746.39. The balance owing has put tremendous strain on the company directly resulting in layoffs, unnecessary costs, and undue stress. I recognize that the roof and the siding were unsatisfactory. My preference is that the Client enables us to finish the job we started, and rectify these issues. If the Client is unwilling to have us return we could perhaps credit her, as requested in her complaint, for the repairs needed to the roofing and siding. My stance is firm that mathematics be used to determine an acceptable amount for the Client to hold back from the balance owing for this work. I expect the remaining balance to be paid. [redacted]Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)in response to the above.1)as it cost me close to$ 5000 for the drawings you provided I don"t see where you thought it was a savings to me.2)In regards to the staff I distinctly remember [redacted] that walnut only hired 3rd year apprentices and carpenters that justifed what you charged and why you could get it done in such a timely manner.[redacted]3)the fact that you choose to take on more work then your company could handle is no excuse for the poorly supervised construction job that you ended up doing at my place.In regards to the site manager that you put in place ,he told me himself he"s not an apprenticed carpenter.that wasn"t his expertise.[redacted]
