I am responding to the complaint about the color of the basement floor I personally put the color in the cement trucks when they arrived on the job as I always do for people when they want something colored So I know that the color was added! Yes, Stelter Concrete, Incdoes charge to wash the trucks after putting the color in the barrel, so it doesn’t affect the next load of concrete The Kohl’s were aware of this charge When my crew left the job, the client, [redacted] Kohls, replied to me how “great” and “wonderful” the floor looked and it did The floor was colored tan and black swirl The floor was clean After I left the job the sheetrock people, carpenters, electricians, plumbers were on the concrete floor, doing their work I do not know if they covered the floor and I will assume that they did not and this is how the floor got so dirty The color does tend to fade over time (I have no control over this – and the Kohl’s were aware of this) , but not in six months, usually takes many years and that is when it is outside in the elements I stopped times between March and July to look at it, and no one was home Not sure if the extensive cleaning (I don’t know if she used any chemicals or what exactly she cleaned it with) had any affect on the color I feel it is not my fault that the floor got dirty When I left the job, the concrete color looked the way it should have and they praised me for the work The cost of the color was $and trucks cleaning was $100.00, so a total of $which was discussed with the clients before the job, so they were aware of the charges before I did the job Thank you, [redacted] , President Wayne’s Walls, Inc

I have reviewed the response made by the business in reference to complaint ID *** and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
[To assist us in bringing this matter to a close, we would like to know your view on the matter . This response from Waynes Walls is a flat out lie. We NEVER once said we were happy or pleased with the floor color. It never was black and tan swirl - ever. I will be taking this matter to small claims court and letting a judge decide with the pictures I have of proof of what the floor looked like. I also have witnesses and my drywaller contractor to prove that the floor never ever turned out black and tan and that the floors were always covered in paper. *** *** is a lier. He never showed up ever to see the floor until this July 2014. I work from home and am always there. He is a flat out liar that he made attempts. Funny if that was true that he never tried to then call me or RETURN any of my phone calls. I can provide those phone records as proof as well. *** *** is going to have a difficult time proving that the floor came out black and tan swirl when it did not and I took pictures immediately proving that. Guess we will let the judgedecide. Should be a no brainer. And we were NEVER told that color fades over time, mater of fact Wayne told us he has black and tan in his basement and that it turned out beautifully. Don't understand the need to lie about this when it's clear we did not get the product we paid for. How convenient that he refuses to return a phone call or stop at home to see what happened and then trys to say that we were aware the color could fade. He is lying. I am not going to accept this. We will be going to court. Pictures and evidence don't lie
Regards,
*** Kohls
