W *** PROPERTY MISMANAGEMENT and EMBEZZLEMENT BY Blue Peak Realty and WC Equity Group
Blue Peak Realty and Kurt W. have been defrauding us in the following manner. They
charged us for the services that were not performed, provided fake receipts to support the charges, permits have not been pulled, tenants neglected, owners not notified of the issues at the property. The property manager lied, the Portal showed bogus expenses, the property value declined due to the fact that they did not perform the job they were hired to do. Besides charging us almost $29,000 for repairs and services, which were not done, the building is now bug infested, mildew spread to many areas, most units are in the condition where a no human can live. We were charged for a new roof. Upon inspection, most units still have leaks, which proves the fact that money charged for a new roof were stolen from us. As we found out, most apartments in the building still have leaks and still are without water. Upon termination of the Property Management Agreement, we found out that Roto Rooter has not been paid for over 30 days and that the company is putting a lean on my property and sending it to collection. Unit 5 renovation was paid for, but upon inspection the place is inhabitable. Ceiling caved, mildew spread to many areas on the walls, etc. When contacted to resolve the issues, Kurt does not answer his phone, promises to call back, but never actually does. I know there are other clients that are affected by this scheme. The lawn care was never done, the utilities are inflated almost double of the actual cost, security deposits of my tenants were not refunded upon contract termination, the account was not settled. The company owes us money they took from rents and did not use for necessary repairs and services.

Settling my account and refunding what is owed to us.

This is misinformation by a serial thief trying to circumvent good practices in an effort to not pay her debts. We have clear evidence of invoices, utility bills, agent manuscripts, and tenant reports. This customer has outstanding debt to our firm, among other vendors, and is attempting to use this platform to get out of paying what she owes to everyone. She is facing a judgement lien on her property and our attorney's are handling the matter. Our name and reputation speak for themselves and we are confident a retraction or private apology will be offered by this short-lived customer, once the lien is attached to her property.

I do not know the level of due diligence this customer completed prior to the purchase but perhaps it was insufficient if she is now dissatisfied with the purchase, its location, or its management. We've been able to do exactly as projected: increase income, decrease expenses, and increase value (we have generated over $100,000 in equity for this customer at this property).

Further, in an effort to capitalize on the good name of both companies, this internet bully has attempted to name two separate, distinct, and unrelated companies. Blue Peak *** managed her property, efficiently and expertly. WC Equity Group has never dealt with this customer, once. Kurt Westfield has no relationship to, nor role in, the matter.

We offered to mutually terminate this customer's management agreement and even waive the cancellation fees, in good faith, but she has declined. Any further communication from this point will be handled thru our legal team unless she agrees to sell the property (in which case we will withdraw the judgement lien). We have offered to assist with this matter as well, in good faith.

Every penny has been evidenced, reconciled, and advised to the customer who has a blind paranoia coupled with buyer's remorse that is causing this propaganda. Someone should have told her what libel and slander will cause because her debts to us will exceed the value of this property shortly.

Provided is a spreadsheet of account reconciliation.
All debits and credits are shown in this statement. The alleged repairs were not done, and there is a sufficient proof of that. Not only that they are not done, they caused more subsequent damage to the units. I asked for proof in a form of cancelled checks and they were not provided. The roof charge was $6500, when permit shows only $1200. The roof was supposed to be replaced and it was not, as all of the upper units are still leaking. These leaks have caused damage to walls and floors. Some floors have caved in. If you ever go to this building, you will see the mess it is in now. It did not appreciate in value as you are claiming, it depreciated in value. Take a close look at what you have done !!! The building was at a threat of being shut down when I took it over at the end of July. And yes, I paid for the boilers that were not installed properly and now need to be reinstalled. I have documented proof from licenced professionals.

This is further evidence of the Owner's naïveté and lack of diligence with her property. Roof repairs require permits, which come at a cost. Repairs also require labor and materials, which come at a cost. Materials and labor are not free. All new valleys were built and the entire roof was torch sealed. The claims of improper work are baseless and have been refuted with evidence, repeatedly. Our firm explicitly uses licensed professionals for such roof work. We do not personally perform the labor. It is leaking because of the stucco separating from the building, not because of the roof.

Here are the facts:

- Owner was promptly advised of damage to the exterior stucco of the property, not the roof (which was properly repaired as evidenced by recent photos from attic showing entirely dry space), and advised by the property manager it needed immediate attention.

- Owner refused to have it repaired along with other urgent items (water heaters, etc).

- Owner's negligence and unwillingness to address the exterior damage caused new and additional damages inside of the property which she is now falsely using to assert work was never performed.

These are the consequences of the Owner's decisions. In spite of her ill-advised inaction, this property has gained significant value because of the work we had completed during our tenure as the management company. The Owner was aware of, and agreed to, an initial budget of $40,000 in renovations to get the property to a high-standard and increase its value. That budget has yet to be reached. Owner was provided the opportunity to have us sell the property at a profit, which she also refused. The relevant theme here being the Owner refusing to take action; she is her own worst enemy. We will not be scapegoats for an absentee owner who is trying to run from her debts and the consequences of her decision-making.

We have remained steadfast in our efforts to champion a lasting relationship and to assist her in, either, disposing of the asset, at a profit, or continuing to properly manage the asset, to no avail.

It has been a pleasure working with Kurt and his team. His wealth of knowledge and expertise has been indispensable for us as investors and we take his advice very seriously when it comes to real estate investment. He is very patient and detailed when he provides us with ROI analysis on any property we are interested in. We have benefited greatly from his knowledge and look forward to many more investments down the road!
