Review: On 10-17-2013 I Began a new service contract with [redacted] Wireless through "We R Wireless" premium retailer on 10-17-2013, when speaking with the manager about possible plans/service types of phones were discussed, I was asked what type of phone I currently used and asked if I had ever considered using a [redacted] Iphone, I listened to the manager ([redacted] as he went over over several of the new Iphones and explained their costs for starting a new contract, [redacted] continued to explain that the much newer iphones were having alot of issues with the operating system and an older iphone (iphone 4) that was free with activation of a two year contract was a much better route to go, with alot of down play on the newer phone ,heavy persuasion I went with the free phone with no system issues..

when it came time to finish that is when [redacted] told me the only way to receive the phone for free was to purchase an insurance/warranty plan and an accessory package consisting of screen protector,case and car charger.. I looked around the store and they didnt sell the case or charger I was intending to buy but Was talked into buying a different brand.

The total was more then $100 for these items combined ,when I went to pay it was discovered my debit card had been left in an atm and I wouldnt be able to get it till the following day or later as the bank was not in the area.

[redacted] asked if I had cash and I did, I was asked how much and I had $81..

[redacted] looked at the computer and says Im going to see if I can cut you a deal and drop the price on the items for you and see if you can skip the warranty for now,he went into the back room to "call" his manager,when he returned he explained he did not get a holed of his boss but he was going to do it anyway to help me out..he explained if there were any issues with the phone or the service or I changed my mind I had 14 days to return to the store to cancel my account or exchange my phone, and as long as it was within that 14 days he would even waive the restocking fee.

On 10-18-2013 I had spoken with a [redacted] rep and several more employees of "we r wireless" who informed me there was no such obligation to purchase an accessory package or a warranty plan to receive the free phone.. everyone I had spoken with at [redacted] or associates for we r wireless said a free phone is a free phone and there is no hidden terms.

I returned to the we r wireless location and met with [redacted] again and was informed by him there is such an obligation and it is [redacted] policy in order for them to give the free Iphone.. when I explained I I spoke with [redacted] I was then informed it was "we r wireless's " store policy.. again explaining to him I had spoken two several other we r wireless associates as a new customer looking at the same plan I bought the day before and none of them forced me to purchase anything, even when asking directly if I needed to buy anything in order to receive the phone I was told no, there is nothing more you must do other then sign a 2 year contract.

[redacted] then asked what it was I wanted to do, when I explained I wanted to return the items I was forced to buy under false obligations he smirked and said he couldnt do that and again insisted it was store policy that in order to recieve the phone an accessory package must be bought..

I asked several times to see the documentation for the contract stating the obligation, I asked for any documentation anywhere in the store that says the purchase was an obligation to recieve the phone and he insisted there was no written terms of the obligation anywhere in the store on signage ,advertisement,service agrement or contract and it was "word of mouth..

I had explained again if there was no policy or proof I was tricked with sales tactics into buying items I did not need or want (but was told I had to buy in order to start a contract witht the iphone 4) I wanted my money back.. [redacted] smirked and pointed at the fine print and says "i wont do that,we have a no refund policy"

when I spoke with another [redacted] rep they offered as much help as possible, but being we r wireless is not really a [redacted] company they were unable to force him to comply but offered I cancel my contract as it was within the 14 day grace period and return to a legitimate [redacted] wireless corporate store and start a service contract and get taken care of better and the promotion they were running (a promotion I was talked out of) was an Iphon 4s for 99 cents, and I could get that phone with no other obligation aside from a 2year contract.

when I explained to [redacted] this is what I was intending to do he almost laughed and explained "sure,you can do that..but you have to keep or exhance the accessories cause im not giving you a refund and im going to charge you an 81 restocking fee for the phone"

after going over this issue I attempted to get any information as to who I could talk to at the corporate office for "we r wireless" I was informed I could only talk to him ([redacted]) or his district manager and there is no information for me to contact anyone else..

after trying for a few hours from home to talk to someone I contacted [redacted] again who informed me they would file a complaint with his company and I should probably file a complaint as well with the Revdex.com..

I explained this to [redacted] one last time and he finally agreed to refund the items,despite having payed cash I was told a check for the amount of 81 would be mailed and I should receive it within 2-4 weeks

I was mislead during the sale process and told false information about several products in order for the manager to get what he wanted. the phone he sold me on was through his company and not [redacted], had I bought the newer phone he would not have made as big of a commission ..

The older phone runs on an older slower service then the newer version I was talked out of..Desired Settlement: since eventually the items were refunded there is not much of an outcome I would like other then being able to keep the same service plan I have or 2 years with the newer phone I was talked out of using deceptive tactics and lies. I would like to have the newer phone at the cost [redacted] said it was (99 cents) and not be charged a restocking fee for the phone I was talked into
