False advertising
I bid and "won" an auction for (34) 10' 4x4's when I was given 33 I asked for the missing beam and Craig the woodland rep said, "I miss counted. Sorry". After arguing with the guy instead of giving me the beam he gave me a refund that did not include the 10% sales tax or their 15% buyer premium. The icing on the cake was finding split and cracked beams in the center of the bound stack that was hidden from view. 4 unusable beams that are "as is" left us short 5. Given what we paid for 34 beams and only had 29 It would have been cheaper to buy them from Home Depot which would have thrown in delivery given the cost.

West auction is wrong in their answer and I have proofI kept a tape from the operator that I called at 1:50pm telling west auction I don't see any yellow sign out front.I got out of my truck walk up to the ownerwhile I was talking with the owner west auction leave me a message saying " their worker went home a half hour earliy but, the owner will help load the item" that was at 2;03pm So I was standing in the business before 2pm as soon as the owner notice the west auction workers not thereHe lock the gate jump in his truck drive offI called back to west auction they said they will contact the owner call me right backwhen they called back said business owner not answering, I know he drove off I said I wanted to talk to who ever in charge at west auction and that where they come up with 2:48pm time that not when I arrivethat stuff about given me a refund was another lieI paid with visa card and I had to call them to get my money backwest auction didn't want to give me my money back.what about what it cost me to get to the auction siteit was an hour and half drive in my truck pulling a trailer that rented for $plus $for helper and food an what not.cost me over $I sent west auction two notice that I wanted this money back also with no responseIf nothing comes from this complaint then they leave me with no choice but take them to small claims court and sue for full cost of that auction what I ended up losingwhich was a meat looker storage unit with tools boxes stoves, and other items worth over $I also notice they removed this auction from their past sale list why? the things is I followed all there rules or terms, I put my bids in on time, won the auction, paid in full on timeshowed up at the auction site on time before cut off time.and I have paid thousands of dollar for other auctions with this company with no problem at all and when I need there help they give me the cold shouldernot only thatbecause I complain they black listed me forever not aloud to bid on any more auction againIf that's how they want to treat their best customer, fine I'll see them in small claims court and sue for the full $

This customer bid in a court ordered bankruptcy auction. All bankruptcy auctions on our website are governed by specific terms which are displayed for each auction. For this particular auction the removal period displayed on the auction page as well as on each invoice was July 16-17,
from 8:00am to 2:00pm. By the customer’s own admission he showed up after the removal period was over at 2:48pm. Our employees had already left the premises. At the time that we leave the building on the last day of removal, we no longer have control of any items left inside. This is why we expressly state in our auction terms that if the buyer does not remove an Item within the designated removal period, the buyer will be deemed to have abandoned the item and the buyer will have no further rights with respect to the item. This customer agreed to these terms when he registered to bid in our auctions, and again when he bid in this specific auction. We did attempt to get the owner of the building to cooperate with the customer for a late removal of the item. The owner refused to do this and we were left with no further recourse. As stated in our user agreement, due to his late arrival the customer did forfeit his rights to the property. We were not required to refund the purchase price of the item, however, we did give this customer a full refund on his item. This customer stated in his original complaint that he arrived on-site at 2:48pm. Unfortunately, as expressly stated in our removal terms, removal was over at 2:00pm. We did attempt to help this customer to still retrieve his item As he arrived after removal was over, we were unable to obtain cooperation from the building owner. As stated earlier, we did give this customer a full refund on his item on 7/22/13. In reference to this customer being blacklisted from bidding on our website, we felt this was necessary to prevent any further problems. He did not comply with our auction terms, which he agreed to prior to participating in the auction. He did not show up on time to remove his item. We did give him a full refund. However, he was still unsatisfied with this solution, and we did not want to have a recurrence of this issue on any future auctions. For his reference, this auction is still available to view under past sales. The auction did take place almost two years ago We have had many auctions since then, so it will be several pages back

I am rejecting this response because: The business has failed to
address the complaint. Their response that basically their system failed so they therefore relisted the item, is not acceptable given the facts. The problem is, this was a no reserve auction......they don't have that right. In addition, Why do they need to relist? They confirmed they had all of the bids and proxies, there was no reason to relist other than they knew that our proxy was over 100% more than the bid that we would have won the auction at.In addition I find it interesting the business will not respond in regards to the "phantom bidder" on the second go round. This is straight up shill bidding, it is clear that the business does not want to respond as it shows clearly the type of operation they are running.If it were my business I would be doing everything in my power to make it clear, thru the Revdex.com, that there was no funny business going on with fake bidders, etc. With the business response it tells me everything I need to know

Review: West Auctions online auction system crashed and they admittedly awarded the auction to a bidder that placed their bid PRIOR to our Bid and for 50% Less than our bid. This is not physically possible to happen in an auction.After repeated calls, they re-run the auction. However seconds before the second auction closes a NEW BIDDER places a bid $50 less than our proxy bid......ballooning the price of the auction over 100%.They made no attempt to safeguard the equipment after the auction. Upon arrival the windows are beat out of the equipment, lights smashed, body damaged, etc. Site manager says he is sorry but it is common for ex-employees and losing bidders to do this type of vandalism on their auctions. (If this is common, then why would you leave a piece of equipment in a location that is OPEN TO THE PUBLIC, and not take measure to safeguard the property you are selling?) He offered 15-20% of the actual repair costs in a credit against the auction. ($650)This was a NO Reserve Auction, and the Terms and Conditions of West Auctions Does not cover what happens in the event THEIR system fails. In this case, they need to review the bids that they confirmed they had, and make a legitimate auction award based upon the bids and proxies that were actually placed.They were not willing to do that and instead re-ran the auction where a last minute bidder increased the price to $50 below our previous proxy bid. This clearly appears to be Shill Bidding and we would encourage West Auctions to let an independent party verify that the "phantom bidder" actually placed these bids.Desired Settlement: West Auctions admits they have the original time stamps and bids placed on the original auction. We want the award to be based upon that information. This was a no reserve auction, and the West Auctions terms and conditions do NOT cover this.Failing that, we would like someone to independently verify the identity of the "Phantom Bidder" that bid $50 less than our original proxy bid. On paper, the events around the auctions bidding are HIGHLY IMPROBABLE and very clearly indicate a Shill.

Review: July 2013 I won auction for a meat locker type of shed. When you win one of these auction they make follow rule. then you go pick up your item by a set time. So won auction. paid for item. few days before pick up time.Item was about 75 miles away. So I rented a trailer ask a friend to help I told him I would pay him. Gas truck up bought some fast food for the ride. pick up time was by 3PM on a Thursday. I shoulded up at the business at 2:48pm I even call west auction to let owner of auction stuffknow of my arrivel time. young lady answer phone she said she would relay message .. She called me right and said"which I have all this on tape." Our worker left early but owner would help load item. So my helperwent to park my truck and trailer. As I walked up to business time was like 2:59pm which it's good. but owner came out real fast with a chainand a lock said you lose it's 3:02pm lock gate. and drove off. so I called west auction a older sounding woman answer, she said be she would get right back to me. few minutes gone buy. the auction people called back said you lose forfeited money. I called west action so to get mymoneyDesired Settlement: I wanted all my money back. Item was $519 which was returned to me. but not use of trailer I rented $150 Gas was $70 helper $40 food $25they pay all this considered closed. I've sent a couple of letters asking for my money. with no response. If I take to small claim I will ask formoney's to replace meat locker shed and all items that were part of theauction. which would be over $3000 worth. it up to them. I follow all rules paid on time. was at pick up spot before deadline. I have a tape.

After reviewing the photos of [redacted] it is apparent that your crew damaged the roof moving it from the small yard to the larger one.
Your employee should have advised me of this, I would not have accepted it with this damage devalues the trailer a lot, This damage devalues this trailer by a couple of thousand dollars easy...
My intent is to recover damages through the court system, since [redacted] your employee has basically said I'm lying and tuff thats the way it is. Great customer service...
