Review: I am doing a travel nurse assignment in the area and moved to Westwind Apartments July 1. I had been speaking with the Assistant Manager before moving to the area. I send an email to the assistant manager to let her know when I was on the way the day of my move and let her know that the furniture company should be there anytime to move my rental furniture in. She replied stating that she hoped not because the apartment hadn't even been cleaned yet. Upon arrival, it was almost closing time so the process of signing a contract was rushed. When entering the apartment, I was hit with such a strong cigarette smell, it was unbearable. I tried contacting the office, but it was closed. I brought in only necessities because I didn't want to ruin my things. I could even smell the smoke through my shampoo while showering. I was at the office the time it opened the next morning. The manager was there and said she could not offer to fumigate the apartment until after the holiday weekend, offered the suite, and I told her that would not work, as I have dogs. The manager would not let me move to a different apartment either. I informed her that I have allergies and have to take allergy shots weekly, and also have been diagnosed with migraines and take migraine medicine. She stated nothing could be done for about a week. I started my new job within 5 days of arriving, and wanted to be settled in before beginning. I decided to move out of the apartment due to their lack of help and not wanting to risk flaring up my allergies/migraines/breathing in the smoke all the time. I'd been there less than 24 hours, and the manager would not work with me. She still charged me for all of my deposits ($540), 2 months rent ($780/month), 2 prorated days, plus $1000 termination fee. My dad has tried to contact the corporate office with no returned phone calls. My rental furniture also smelled so much like cigarette smoke, that after paying another $170 for another delivery fee to my NEW home, they had to bring me new furnitureDesired Settlement: My father had my bank stop the check I wrote to them that included the termination fee ($1000), 2nd month's rent ($780), and 2 prorated days rent ($52) - a total of $1832. What money they still have is $540 of deposit money, and $780 for first month's rent - a total of $1320. I would like to get back my $1320 and I'd also like to know that the $1832 is cleared and that none of this will be held against me since I did not even live there and left for health reasons. During the week leading up to Ms. [redacted] move in here at WestWind Apartment Homes she contacted the Asst. Manager question if she could move have the furniture delivered and set up before she arrived. The Asst. Manager explained that the unit was not ready that it still had not been cleaned. She also so explain that she was not comfortable with having the say on where Ms. [redacted] rented item were placed. As [redacted] as explaining that cleaning was scheduled for morning hours on Friday, July 1, 2016. On Friday, July 1, 2016, Ms. [redacted]’s furniture arrived it was set up in the unit. Asst. Manager called to see what time Ms. [redacted] would be getting here to move in and she stated that she was not sure maybe a few more hours this call was mid-day at 1:17pm, on Friday. The unit had been cleaned and was awaiting Ms. [redacted] arrival. Ms. [redacted] did not get to the office until after our business hours which was after 5:30pm that day. Ms. [redacted] stated that she just wanted to get everything signed she wanted to just move in. The Asst. Manager went through all the paper work with Ms. [redacted]. I have attached a copy documents in question and the emails. Documents:I have attached a signed and initialed copy of the lease stating all of our policies and requirements. I have also included a copy of the signed Vacating Options that speaks to the Early Termination policy and it’s fee and terms. I have also included a copy of our Transfer option with in WestWind Apartment also. Both the Lease and the Vacating Option require our resident to give a 60 day notice before leaving. The Vacating Option form state that if you end your term early before you lease expires we require a 60 day notice which make you responsible to pay the rent for these 60 day also a $1000.00 Buy Out Fee is required. All of this was discussed during her signing and giving copies of everything she signed on Friday, July 1, 2016.Saturday, July 2, 2016-Day after MovingOn Saturday, July 2, 2016, I meet Ms. [redacted] as she entered the office advising me that her apartment smelled like smoke she also explained that she is highly sensitive to the smell and she could not stay in the apartment with that smell. I offered Ms. [redacted] our nightly suite which is located her on the property at “NO” charge that is fully furniture with only one stipulation her two large dogs could not go into our nightly suite. I also offered to find her a local dog kennel since the dogs were not allowed in our suite. I then advised her that since Monday, July 4, 2016, was a holiday it would be Tuesday , July 5, 2016, that I could get the my vendor on property to place the clean air machine in unit to take care of the smell. I asked if I could come to the apartment to see what she was talking about. Ms. [redacted], left the office. She called and told me I didn’t have to come to the apartment. Then she returned to the office and advised me that she didn’t want to stay in the suite nor put her dogs in a kennel. She refused any option to try and fix the matter resolve the problem that she was experiencing. She then asked me what she needed to do to get out of her lease. I state Early Termination Policy , $1000.00 plus 60 day notice as stated in our policy that Ms. [redacted] signed on Friday, July 1, 2016. We discussed the amount that she needed to pay and wrote a check for the amount advised me that she would get all her stuff out I told her what time I went to lunch since I was the only person in the office (1:00pm) and what time we closed for the day (5:00pm). Around 4:00pm she brought the keys to the apartment back.PaymentWhen Ms. [redacted] check was processed the following week for her 60 days of rent and $1000.00 Buy Out Fee that she wrote on Saturday, July 2, 2016, our bank was notified that it was being disputed and would not be paid. FurnitureI understand that the rental furniture that was taken out the apartment on Tuesday, Friday 5, 2016, was indeed delivered to her current address and was not exchanged. Ms. [redacted], still has the same furniture that was taken from WestWind Apartment Homes in her new home. There have been no exchanges due to the smell of smoke. I tried to work with Ms. [redacted], she just didn’t want to stay and wouldn’t allow us the opportunity to fix the situation at hand.
