Please read below for the most amazing example of an incompetent business owner I have ever dealt with. For over 2 years, he has attempted to repair my transmission, and it is still not working. This started with a used replacement paid for by my 3rd party warranty, then a rebuild about 15 months later, also paid by 3rd party warranty. That rebuild lasted about 6 months, at which time Westboro Auto Repair agreed to fix it under their own warranty this past [redacted] I picked the car up about 6 weeks later, and made it about 10 miles before complete transmission failure. The car was towed back to the shop, and I was assured it would be fixed again. I have not seen my car in over 2 months, the owner of the shop does not call me or explain what is going on, and seems to just have my car sitting someplace. Basically, it seems he took on a job that he was unqualified to handle, and is now unwilling to do anything about it. In my last conversation with him, over 2 weeks ago, he seemed to be explaining that he tried, but cant fix it, and he isnt going to lose any money on this!I was initially going to go to small claims court myself, but I have since gotten the impression that he wants to pass [redacted] to his insurance and make them settle it. Therefore, I think an attorney is appropriate. Please help me! The following letter was sent to the shop owner late [redacted] 2015, by registered mail. [redacted]451a [redacted] XXXXX(XXX) XXX XXXXApril [redacted] 2015Westboro Auto Repair Inc.24 East Main StreetWestboro, MA XXXXXDear Merchant:Under the provisions of [redacted] I hereby make written demand for relief as outlined in that statute. Beginning on or about [redacted] 2012 and continuing to today, the following unfair or deceptive act occurred:I purchased a 2002 [redacted] in [redacted] of 2012. In [redacted] I brought it to Westboro Auto Repair (W.A.R.) for regular service, including a transmission fluid change. After the fluid was changed the mechanic, [redacted], informed me that the transmission was not working properly and needed to be replaced. I had purchased a warranty from Route 66, and they covered the cost of replacement with a used transmission. I was charged approximately [redacted] by W.A.R. for fluid, gaskets, tax, etc.11/12Replacement by ** WarrantyXXXX XX/12Charges by [redacted] transmission was definitely an improvement, but soon after began to develop shifting problems. Within a few weeks, it was shifting a bit hard, but not to a point where I would have an issue with it. Within 10 months it was beginning to slip on downshifts. I had the car in for service at (W.A.R) [redacted] and was told they noticed no problems. By [redacted] of that year, it was noticeably slipping and needed replacement. I spoke with the [redacted] people, and convinced them to pay for a rebuild. I was able to borrow a family members car for the first two and last three weeks, but W.A.R. had my car for a total of over 10 [redacted] 4 [redacted] months later, I began having problems and had it diagnosed at WCD garage in Northboro. They found the transmission needed replacement again.[redacted] 2015. Diagnosed at WCD Garage. Transmission needs replacement. ESTIMATE: [redacted] returned the car to W.A.R., and they agreed to rebuild it again. I did not wish to bring it there again, but had no other options financially. I picked up the car from them on on March 12. During this repair, I rented a car as seldom as possible for shopping, [redacted] I picked up the car, the message BRAKE FAILURE. STOP WITH CAUTION and brake light were both on. Also, the heater fan would not shut off, so the mechanic had removed the fuse so the fan would not drain the battery. Within a couple miles, the brake, ABS, and traction control lights were also on. Within 10 miles, the car would not shift down from 5th gear unless I pulled over and shut the car off. By the time I reached home, the check engine light was also on, and the message transmission service urgent was on.At this point, I brought the car to C & C Motors in [redacted] a used car dealer specializing in [redacted] The owner, [redacted], has diagnosed that the transmission needs to be removed and repaired, AND the computer control module is damaged. It is now [redacted] and I have no car, and no way to get a car. I have been laid off from work, and cannot afford to replace or repair the car on my own. Now, [redacted] XX XXXX, I still have no car and no word of when I will have it. [redacted] 2 [redacted] Staff at Westboro Auto Repair is obviously unqualified to repair this transmission, and never should have accepted the work the first time. This unfair or deceptive act or practice is, in my opinion, declared unlawful by various parts of [redacted] 2 of [redacted] as well as other statutes, as [redacted] and [redacted] of [redacted] law, you have the right to have shoddy work repaired at no charge.A repair shop must fix any repairs it has made on your car that were not repaired in accordance with trade standards. [redacted] 5.XX (X)XXX CMR: [redacted] MOTOR VEHICLE [redacted] is an unfair or deceptive act or practice for a repair shop to make or authorize to be made in any manner or by any means a statement which it knows to be or, in the exercise of reasonable care, should know to be untrue or misleading including, without limitation, the following types of statements: (a) That repairs are necessary or desirable when such is not a fact; (b) That a vehicle is in a dangerous condition or that a customer's continued use of a vehicle may be harmful to the customer or others when such is not a fact; or(c) That repairs have been performed on a vehicleProduct_Or_Service: Transmission replacement>rebuild>rebuild>Desired SettlementI will be filing in small claims court for the maximum allowed of [redacted], and requesting triple damages for [redacted] If this is settled within the next couple weeks, I will cancel the suit and accept payment of $[redacted], which is far below what this issue has cost me. He had purchased third party extended warranty coverage on the vehicle, and the extended warranty company authorized that the transmission be replaced with a used transmission. I removed the damaged transmission and replaced it with a used transmission. I delivered the car to him 10 days later. I gave him a one year warranty.That transmission lasted a year and a half, after which it stopped working. Mr. [redacted] came back to my shop. The car was still under the third party extended warranty. The third party warranty company agreed to pay for another, rebuilt transmission. This time, we removed the transmission and sent it out to a transmission specialist [redacted] Transmission) to perform the rebuild, after which I reinstalled it in the vehicle. ** Transmission gave him a one year warranty on that transmission. When the job was finished, I billed the third party warranty company. Mr. [redacted] did not pay his portion of the bill that is not covered by the warranty company (the deductible, fluids, gaskets and replacement of a rear wheel bearing) which came to approximately [redacted] Neverhless, I gave him the car in good faith. He paid me [redacted] of that bill eight months later, and has never paid the balance. Eight months after we installed the transmission rebuilt by ** Transmission, he came back to my shop a third time and told me that the transmission had once again failed. This time I sent the car directly to ** Transmission. They did further work on the car. Ten days after he picked the car up, he dropped off a letter to me dated [redacted] 2015, telling me the transmission had again failed on the day he picked the car up, and that there were other error messages and problems, and that the car was at ** Garage. I immediately called him. I agreed that I would have the car towed from ** Garage directly to ** Transmission. I also offered to give him one of my cars, at no cost, to use until his car is ready. He refused the offer of a loaner car.** Transmission took the transmission apart and ordered a used part for it. The replacement part did not solve the problem, so ** then ordered the part new form the [redacted] dealer. The new part also did not solve the problem. As this went on, at the end of [redacted], 2015, Mr. [redacted] stopped by my shop and offered to sell me the car, just to solve the problem. I offered him the blue book value of [redacted] which he refused, and told me he wanted [redacted] because that is what he owed on the car, because he had paid for an extended warranty. I pointed out to him that this is far more than the market value of the car, but he would not sell the car for less than what he owes on it. When we could not agree on that, I agreed to purchase another used transmission, with an extended warranty, at my cost, for the car. I purchased that transmission and it was delivered to ** Transmission on [redacted] Transmission tells me that the car will be ready by [redacted] During this entire process I have been following up regularly with ** Transmission. I have paid for another used transmission, at my expense, to be installed in the vehicle. According to his statement, the car had a bad transmission when he purchased it. It is possible that something else is going on with this car, that after replacing the bad transmission it came with, he has gone through so many other transmissions in such a short period of time.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)In 2 1/2 years, my car has been in the possession of Westboro Mobil for a total of over 8 months. Currently, they have had the car since [redacted] In that time, they told me it was done, and I was able to drive it less than 10 miles. The car was not back to him 10 days later, and was not at [redacted] garage. I talked to him 4 days later, and it was at a used volvo dealer I know. The car has not been at [redacted] since before I dropped it at the Mobil in [redacted] The fact that he is now saying maybe the problem is something else simply demonstrates that this is a job that his business never should have taken, as it is beyond their abilities. Now, 2 [redacted] years in which Westboro Mobil has received over [redacted] for the same transmission, and I still have no car, have no idea where my car is, and have not heard from the Mobil in over 2 months. He has had the opportunity to make good on his commitments, and I do not accept simply picking up the car (which I doubt is truly fixed anyway) and leaving the situation at that. I have been unable to work for 3+ months, I have spent thousands on rental cars as needed, and for the money he has received from both myself and the warranty company, I could have had a transmission installed at a [redacted] dealership and been done with it over 2 years ago! Instead, I have been strung along, lied to and at times simply ignored for 2 1/2 years. Please don't worry about it, as I know you have no clout over him. I simply wanted to make sure you are aware of the unacceptable business experience I have been forced to go through.
