on the utilities in the last couple of months when she became late on her rent It is very disingenuous for her to claim she had no notice when she has been paying for over year We can find more ledger cards showing her utility payments in prior periods if necessary.If there is any doubt as to the veracity of this response, the claimant left a voice mail to our regional manager cursing and swearing at her and making threats We have kept copies of the message in case we need to take other action. Our client did not buy the building nor did Westcal manage until May 27, 2016.2. The first notice of any...

issue was a call from our answering service about 9:30 on July 14. Regional Manger and our maintenance man both went to the apartment and observed wet towels. We offered to have someone some and open the ceiling and make repairs at that time. She said everyone was asleep and we should handle in the morning. 3. July 15 maintenance made a temporary wall repair, but noticed that copper pipes needed to be repaired. We gave the tenant notice for July 18 to complete the repairs.4. July 18 the repairs were made and we made arrangements to have wall replaced and painted. 5. July 29 painter returned to unit but told there was a leak the previous evening. Unit was inspected by maintenance and no leak or water was evident. Water was run in the upstairs unit to determine if leak.6. August 5 tenant reported no more leaks at 12:25. She asked us to now repair dry wall but wait until 8-16 to 8-20 as she would be out of town.7. August 8-9 ceiling was replaced along with wall behind the toilet, baseboards were replaced along with the exhaust fan in bath. The tenant is reported to be happy with results.Please include in your notes that Westcal nor our client assumed ownership until May 27, 2016. Review: I placed a 125.00 holding deposit down with Stonegate apartments, and I would like a refund, but am having trouble receiving it from a man name [redacted]

I went into a Westcal management property on 9/3/13 and applied for a 2 bedroom apartment at the stonegate apartments on mack road, in Sacramento, CA. Shortly after I applied, I received a call from a lady named [redacted], letting me know my total move in costs. The next day, a man named [redacted] called and left a couple of voicemails informing me that if I came in with a holding deposit for 125.00, a place would be ready in approximately 2-3 weeks. I went in and placed that 125.00 in [redacted]'s hand via money order, and I still have the receipt to prove it. After a couple of weeks, [redacted] called me and said he wanted to schedule a move in date of 9/25, and I agreed under the circumstances I could view the apartment before I make a final decision. The 25th of September came, and I went to view the apartment, but no luck when I got to the property. [redacted] informed me that the place was still being worked on, and that I could come back Friday 9/27, so I did. When I arrived on 9/27, [redacted] showed me a place in apartment 220, I was not satisfied, and requested my holding deposit be refunded, but I was asked for a callback number and told they would call me when the supervisor came in. Monday 9/30/13, I went into the office of stonegate apartments around 12:30 pm, and spoke with a man named [redacted] he informed me that it could take 21 days to receive a check for my refund amount, and I asked him if there was someone at Westcal I could speak with to possibly help me out in a more timely matter due to my urgent homeless situation. ** then locked the office doors when I left out of the office to retrieve my cell phone from the vehicle, further frustrating me, as I am 8 months pregnant with no extra funds, and desperately need to find a place to live. ** would not speak with me, or let me know anything about my 125.00 money order. The police was dispatched for mediation, and ** still refused to let me know when I could actually expect a refund. I am disgusted by this situation, and the level of rude these people were to me. I finally made contact with Westcal management via phone and email, but had no luck speaking to anyone. Please help meDesired Settlement: 125.00, plus my gas costs in the amount of 40.00 for my failed attempts to see the place I was promised to ready on the date I drove out to Stonegate apartments in sacramento, ca from North highlands, CA. Total of 165.00

This letter is intended to explain the events that took place on September 30, 2013, when prospective tenant, [redacted], came to view an apartment at Stonegate Apartments, located at [redacted] Road, [redacted] CA XXXXX; a property that is managed by our company, Westcal Management.

[redacted] was approved to rent a 2-bedroom apartment at Stonegate Apartments, albeit with a higher security deposit. Westcal Management uses a third-party leasing service called On-Site to process ALL rental applications. [redacted]'s security deposit is based on the rating that On-Site provides us, and she had agreed to pay a higher security deposit to secure the unit. The $125.00 holding deposit secures the unit and effectively removes the unit from the list of available units for rent; it also goes toward the total security deposit owed. [redacted] wanted to move into the unit one day before October 1st - so the supervisor for this property, [redacted], told [redacted] that he would need to collect the balance of the entire security deposit, plus first month's rent, in order for [redacted] to receive possession of the unit, which is Westcal Management's company policy for all properties. We do not issue keys to an apartment without receiving all move-in monies in certified funds, before or on the day of move-in. Should any employee stray from this company procedure, that action could violate CA Fair Housing laws, with respect to treating all tenants the same - so ** was not able to make an exception for [redacted] in this case.

[redacted] indicated that she did not have the total move-in monies to gain possession of the unit and demanded that ** give her the $125.00 back immediately. ** said that he could issue the refund, but that the holding deposit was processed when it was received, and by law, our company has up to 21 days to process all security deposit refunds. This policy was not satisfactory to [redacted], and she became angry and verbally assaulted [redacted] she also kicked in the door, and subsequently, the door frame, to the rental office. She threatened [redacted] asking him if he understood what area he was in and asked him if wanted to get shot over $125.00. The police were notified and escorted [redacted] off the property.

[redacted] continued to harass our corporate office the day of the incident, calling so often and with such malice, that our front desk operator was forced to turn the switchboard off to avoid her calls. [redacted]'s check was processed for $125.00 on 9/30/13, check [redacted] - the day that this incident took place - which is 21 days before we were legally obligated to return [redacted]'s monies.
