This has to do with Boulder creek apts in reno Nev own by fpi management.concerning of security deposit[redacted] manager of boulder creek apts has charge me $ 1352 for replacing a damage carpet that was done by the previous renter when I move in 3-12-15 the carpet was already damage it smelled of smoke had cigarettes burn in the back be room and the carpet was split from the seams. I have tried to get a hold of Shannon dill of the fpi management office many time and will not return my call so my complaint is that they are making me pay for something that I didn't not damage and asking to have my deposit refunded to me of $400.00 thank-youDesired SettlementTo have my deposit return and for u to check out the company there have been many more people who have lived there and have been charged Business Response To whom it may concern, [redacted] Fernandez, previous resident of unit D120, has a significant balance due to Boulder Creek for a number of reasons:1) [redacted] chose to smoke heavily inside her apartment, causing significant damage to the walls and carpet. The smoke odor cannot be removed through simply cleaning it. Our lease terms are clear that damage caused by smoking inside will not be considered normal wear and tear. She was charged for the replacement of the carpet, in addition to a full paint for the unit due to this damage. The charge that she incurred was reduced by the wear and tear expense that is calculated based on the install date of her carpet and the generally accepted useful life of carpet. Her move-in walk-through sheet noted only heavy wear on the carpet. There were no stains, burns, or other deficiencies. I had the pleasure of being in her apartment with her on a number of occasions to address noise complaints and am personally able to verify the heavy smoking in the unit.2) [redacted] is a client of the Reno Housing Authority on the Section 8 program. The guidelines of the program stipulate the the housing authority will only pay rent to one landlord at a time for each client. [redacted] provided a different vacate date to the housing authority than she provided to Boulder Creek. The housing authority only paid Boulder Creek up to the date that she gave them, but stayed for some time after that. She is responsible for that expense.When [redacted] originally contacted me about concerns with her move-out statement, I explained the reasons for the charges and referred her to the collection company that we use for any disputes. I had received a verification email from this company confirming the receipt of the collection, but [redacted] still claimed that the company told her they have no record of her. This increased her frustration level. At that point I referred her complaint to my Portfolio Manager, [redacted], who also advised her to contact our collection company. After that our previous resident stopped by the office to voice her displeasure with her move-out cost. [redacted] was quite irate and clearly did not comprehend the charges indicated on the disposition form that she was mailed. I calmly explained in detail what these charges are for to both her and her daughter, but after roughly ten minutes of yelling, she gave up and stormed out of the office. Every possible avenue to rectify this situation on our part was taken short of simply removing the charges.To her credit, she did clean the apartment well and the damages to the apartment from smoke was non-existent. She was charged the absolute minimum that could possibly be charged given the condition of the unit at move-out. I can send the move-out statement for your reference if desired. But did for march I do have proof of this and as far as my stay of 7 days longer I had requested that and he said that was fine and I have him a written request.as for him say I spoken with [redacted] she never called me.all I'm asking is for them to be investigated for this has happen to other tented that have lived there and I want my $400.00 deposit back for I have been told that he cannot charge me for replacing the damage carpet that the previous renter did also check to see if he charged other tented who have move out between Dec. and March who's carpet was replaced there where about 3 or 4 in my area.so please check into this it Thank-you [redacted]Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)first of all I did not smoke in my aptfor a year as I said I smoke in there for a couple of months and not heavily for I am not a heavy smoke and two my grandson has asthmas and that is why I smoked outside. you was not the one that did the walking inspection with me when I first moved in that place smelled like smoke and I mention it to [redacted] and she said that you can smoke in the apt which at that time I told her we smoke outside and the cigarette burn was there already you are just trying to get me to pay for damage that was already there.plus at the time I was told that you was thinking of putting new carpet in which you didn't and I had to wait three extra days to move in which cost me more money for the [redacted].also if you knew that we were gonna be charged for the smoke damage then why did you smoke in my apt when you was standing there trying to hear the noise up stair and this happen a quite few time and I believe you was in the wrong of smoke in tenents apts.And as for the pay I paid you from the 1st to the 13th which was in the amount of $68.90 and it you take my rent of $164 and divided by 31 days that is what you come up with and as for housing paying they didn't pay my rent for [redacted] until March 15th and I move out of Boulder creek the 13th so you should of been paid and you should of contact them when I asked for a extinct. please be advised that the carpet was damage when I moved in and I have proof. I just waned to say that I cannot believe that you would try and get other tenents to pay for previously damages that was there when they moved in. I don't want to keep argue with over this but I will keep fighting for I know you are in the wrong and i'm in the right this is just downright fraud to me that's just my opinon. Final Business Response I have a Disposition of Security Deposit and the Move In- Move Out Inspection Form. This is a law binding document signed by the resident. I can provide this document upon request but cannot attach it to this response.

Moved into [redacted] Apartments last week. Was told when signing thelease that we could install [redacted] TV service. When we tried to install [redacted] there was no TV jack in the livingroom. We were then told that we had to pay to run the wiring into the apartment as well as pay for the installation of cable. We rented the with the expectation of having cabldewiring in the livingrooytm. Other apartments are equipped with cable in thelivingroom and they misrepresented that apartment. Inquired as to a complaint process and was told that they do not have a process for registering a complaint by the manager [redacted]Desired Settlement We want a cable wire run into the livingroom cable box which is there but without the wiring. This would meet our expectations when we signingthe rental agreement. We would like to settled this complaint without taking this complaint any further. We spoke to our Maintenance Supervisor who advised that the cable wiring is usually in the storage closet outside the unit.One 11/6/15 our Maintenance Supervisor went over to the unit and found the cable wire in the storage closet and ran it underneath the building and then connected it to the outlet in the living room. The living room did not have the cable but had the face plate for the cable. The cable was just not connected so once this was discovered the residents were all set to have the install through the cable company [redacted].Thank you, [redacted] Community Director Evergreen Park
