In our terms and conditions for our contracts #clearly states that unless the service we are to provide is in writing it is not part of the contract The only thing our contract states is that we are to remove and haul away 174' of 6' wood fence with growthGrowth includes the ivy/vine that is on the fence at the time of the removal of the existing fence This does not include any ivy, vines, or other items growing around the fence It is only what is on the existing fence when we tear it down Nothing else was included per the written contract

November 15, Case #*** To Whom It May Concern, *** *** did contact us about her issues on her fence. We waited to receive photos of the issues she was telling us about so we could see exactly what she was talking about over the phone. We received the photos in August and wrote up her warranty to get it scheduled. A warranty is put back into the schedule as it is received with the new projects we receive at the same time. We went out there last week as it was finally time for her to be scheduled. The Foreman met with and spoke to her at her house to discuss how we are going to fix the fence. She agreed to how it will be fixed and she is being scheduled to be done before Thanksgiving Sincerely, Western Fence Company

Attached is the signed contract and terms and conditions of the contract.  There is no date on the contract to start by or have it completed by.  At the time [redacted]'s husband ** signed the contract (signed on 5/20/16) we were approximately 2 weeks out to start the project.  This is...

only an approximation as it varies daily as more projects are turned in every day.  From the time we start a project we were approximately 1-1/2 to 2 weeks out to finish the project.  Also attached are the emails for the last couple of days between ** and Tony (sales estimator).  As you can see he has answered him and has not brushed the customer off.  We apologize for being 1 work day behind on the start of their project according to the time frame as we have had some issues with the construction manager.  We did start their project on Monday 6/6/16, we were out there again yesterday (6/7/16) and finished the tear out of the old fence and dug the post holes & set the posts.  It will be a few more days before we can finish the fence and they will receive a phone call just like before letting them know that we will be out there again.

I am rejecting this response because:
It is interesting that the contract is open to interpretation as to what the "w/ growth" portion means. We were verbally told that your company could (and would, as there would be additional fees for the removal in our contract) remove the vine/ivy. We would have not signed the contract if we were not told that, as the vine/ivy is excessive and we wanted to hire someone that could rip it out when the fence was being replaced. Therefore, we were under the impression that the "w/ growth" meant that your company would be removing the vine for 1' on each side of the fence, so we signed it under than understanding. At this point in time, we feel that our contract is misleading and also feel that we were lied to.
