Complaint3/15/13-C [redacted] (CF) sent $400.00 rental reservation deposit (with signed Rental Agreement)to [redacted] dba Western Mass RV Rental to reserve 38' Winnebago Adventurer for 10/24-1027 2013. Check cashed by Ms. [redacted]. 7/10/13-CF went on web site and noted that Winnebago Adventurer RV no longer listed as being for rent and Proprietor is now [redacted] M [redacted]. 7/11-CF wrote to Ms. [redacted] and to Mr. [redacted] (his e-mail was now on the web site) asking about the status of the RV reservation. 7/11-Mr. [redacted] responded that the Winnebago had been "given back to the bank" and that he is a relative of Ms. [redacted] who has taken over her RV rental business. 7/15/13-CF signed a new rental agreement for a 31' Jayco RV for 10/24-10/XX XXXX and sent additional $277.50 to Mr. [redacted] (check was cashed)8/30/13-CF wrote to request that the 2013 reservation be rescheduled into 2014 (as allowed in the rental agreement)and Mr. [redacted] wrote that reservation deposit could be used in "One year or five years". 4/15/14-CF requested reservation of Jayco RV for 10/23-10/XX XXXX and Mr [redacted] stated that was "fine". 8/26/14-CF wrote to Mr. [redacted] to confirm 10/23-10/26 reservation and Mr. [redacted] responded on 8/29 that "he was not sure about those dates". 9/29/14-CF wrote again to confirm October RV rental dates and Mr. [redacted] responded "not sure those dates were locked in" and he would "get back to me". 10/7/14-No response from Mr. [redacted] and CF wrote to request refund in full. 10/8/14-www.westernmassrvrental.com web site non functioning (Web Page not Available shown on screen when IP address typed in). 10/10-CF filed small claims action at Westborough District Court against Western Mass RV Rental 10/14/14-www.westernmassrvrental.com web site not opens, [redacted] now shown as proprietor with available rental RV shown as 31' Jayco (identical to the one rented through Mr. [redacted]).Product_Or_Service: RV RentalDesired SettlementI would like a full refund of the $677.50 RV Rental deposit paid to [redacted] and [redacted] M [redacted] plus the $50.00 I paid to file against Western Mass RV Rental in Westborough District Court

Security deposit was not returned to me upon return of the vehicle. Still has not been returned and it's been 4 months.On 3/21 I signed a rental contract with Western MA RV Rental owner [redacted]. In the contract it states that from 5/15/14 to 5/19/14 that 7 people, including myself would be traveling to North Carolina. The total for this trip was $2450 which included a security deposit of $750 to be returned upon return of the RV. I sent the first $1275 to Mr. [redacted] by money order, which he received because he had to call me for information on how to cash it. The rest of the money was due at pick up. On 5/14/14 Myself and 2 other went to Mr. [redacted] home on [redacted] St, [redacted] MA XXXXX. We met Mr. [redacted] at his home, he collected our money, gave us a quick walk through and said our deposit would be returned within 15 days us returning the RV. He said this would be no problem as he "doesn't like to mess around with peoples money." We left for our trip the next day and once we arrived in NC we parked the RV in an RV park and picked up our rental cars. We drove home in the RV late Sunday and called Mr. [redacted] to inform him that the RV would be cleaned and ready to be picked up by 12:30 PM. We went through the RV making sure to thoroughly clean it as this had been a part of the contract. It was spotless! We had absolutely no problems with the RV the whole time it was in our possession and as discussed with Mr. [redacted], it was only driven by 2 people who held licenses to drive heavy equipment and were, in my opinion, the 2 best suited to handle the bigger vehicle. We parked it facing out of the driveway at [redacted] St, [redacted] MA XXXXX so that Mr. [redacted] would have ease of exit from the driveway. He took 3 day to come and retrieve the RV, which was an inconvenience to me, as I had to check on it daily and lost the use of half of my driveway. We returned it with a half of tank of gas, as that's how we had received it. The only part of our signed agreement that I did not live up to was that I did not empty the waste tank. I told Mr. [redacted] before we left his house that I would most likely be unable to do this. I told him that we were fine with losing the $50 from the security deposit for failure to do so. It has now been nearly 4 months and I have made repeated attempts to retrieve my security deposit from Mr. [redacted]. He is always unresponsive, never at any point citing reason for delay as he will not respond to e-mail, text or phone calls.Desired SettlementI would like the full refund of my security deposit back and if possible payment from Mr. [redacted] for storage and safe keeping of his property while in my possession for and additional 3 days. If we had returned the RV 3 days late, we would have paid a penalty, I would the same should apply in reverse.
