WESTERN TURF & Hardscapes

Picked up a pallet of grass from Western Turf on 06/02/2016. The pallet was loaded into the back of my truck by one of their employees with a forklift. Upon being loaded into my truck, the forklift completely scratched my tailgate. The scratches are very deep and cannot be touched up with paint. Contacted the office and they told me that they are not liable for damage done. Spoke with [redacted], and explained to him that I would like it fixed, and he told me again that they are not liable and will not pay for the repair.Desired SettlementPay my insurance deductible to have the tailgate repaired. So I can investigate this further?In the interim...Due to the nature of material being loaded all customers sign a disclaimer, that is printed boldly on our invoice's that Western Turf is not responsible for any damage done to vehicles in the loading of material.This is contruction material yard consisting of rock, soil and sod.We also have large signage with this same disclaimer in our office and upon entry into our yard.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The sod was paid for over the phone and when I picked up I did not sign any invoice. I will get you a copy of the invoice. It is not in my name it is my friends name. That's who the sod was for, I was just there to pick it up.
