I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.We still believe that Western Vistas still owes us the $922.35 in dispute, and request that you keep this complaint open until Western Vistas can resolve these issues. Issue #1:  The funds Western Vistas stated in their response that were to have already been mailed to me have yet to be received a week later, which causes me to question the veracity of Western Vistas' response submitted on 7/6/15.  I will contact the Revdex.com immediately upon receipt of those funds and state the amount received.   Issue #2:  Western Vistas stated that “The cancellation fee for ONE property was charged in error”.  We have two properties that are included in this complaint.  Just to be clear, our Management Agreements for BOTH properties do not authorize Western Vistas to charge a cancellation fee for either property --- not just ONE property.  So Western Vistas should confirm that no cancellation fees were collected for BOTH properties.  Since they’ve never provided a detailed breakdown of the $922.35 that they’ve kept, I am unable to confirm this.  I need Western Vistas to provide a detailed Tenants-Ledger accounting and a detailed Owner’s Statement accounting that shows the breakdown of how all funds were applied, specifically, how funds received from the tenant were broken down and applied to specific expenses, such as rent, legal fees, rental admin fee, cancellation fees, and late fees.  The specific dates that these fees were incurred are also required.     Issue #3:  I was very surprised to learn in Western Vistas' response that tenant late fees were owed to Western Vistas, since my Owner’s Statements NEVER documented any expense for late fees (I can produce all records received if additional evidence is required).  In order for me to collect unpaid late fees from the tenant, I need Western Vistas to provide their supporting documentation so that I can verify it and then send it to the tenant.  This documentation should include a detailed Tenants-Ledger accounting and a detailed Owner’s Statement accounting that shows the breakdown of how all funds were applied, specifically, how funds received from the tenant were broken down and applied to specific expenses, such as rent, legal fees, rental admin fee, cancellation fees, and late fees.  The specific dates that these fees were incurred are also required, including all of the dates that the tenant was late with rent and assessed their late fee.   NOTE:  For clarification, I'd also like to correct a typo in my initial complaint:  Our Management Agreement does NOT give Western Vistas the authority to collect late fees from me, the Owner.  This complaint is not resolved.  Please keep it open.  Regards,[redacted]

Western Vistas is entitled to late fees assessed to a tenant per the management agreement. The outstanding balance of the tenants account, transferred to the new management company, would include the late fees. I recently rented a house managed by this company the 1st of june,since then nothing stated in lease as to repairs in house has been honored.I haven't even received a phone call.

Review: We terminated our Property Management Agreement with We Are Residential Management, LLC (WARM) on 12/31/15 for two properties in Litchfield Park, AZ. WARM is now keeping funds that rightfully belong to us. We are demanding that WARM return to us $412.75 for Property #1 and $509.60 for Property #2, for a total of $922.35.

WARM claims that this $922.35 is for late fees that the tenant didn't pay and for a 6% cancellation fee of our Agreement. However, our Agreements do give WARM the authority to collect late fees from me, the Owner. Additionally, our Agreement states that the 6% cancellation fee shall only be collected if we cancel our services within the first year of the Agreement. Our Agreement was over 3 years old, so no cancellation fee applies. We have repeatedly contacted WARM and pointed out that these are violations of our Agreement, and WARM has refused to respond or comply with the terms of the Agreement.Desired Settlement: We want WARM to comply with the legal terms of our Property Management Agreement and return to us the $922.35 that they are retaining without any legal justification.

As someone who also works in property management I can say at a professional standpoint that Western Vistas is a total scam. Refuses to allow any type of animals because of the "Original hard wood floors", yet the floors are in such horrible, embarrassing condition they are beyond repair; replacement would be the only option. Upon signing the lease our oven was missing a handle, which Paul suggested we " open the oven from the side." Excuse me but doesn't that sound quite dangerous and an extremely inappropriate comment. They did replace the stove; when we received it, it was such a mess. I cleaned it with gloves on. I know at the property I work for we make sure the appliances are sparkling clean before a resident even views them. Every time I have to contact them [redacted] is overly rude and short, I am not one to lose my temper but she managed to make me do so with how rude she is. I can not forget to mention how they leased us this home with a window that had a hole the size of a golf ball which was "repaired" with a piece of tape, when we discovered it we could not believe how uncaring these people seem to be. We did put in a work order for our bathroom, which this issue was suppose to be fixed before we moved in; it was not. Well as they stated in the reply to [redacted]; there was mis communication to why it took so long... well after reviewing the work order statement, WE GAVE THEM PERMISSION TO ENTER. Which means regardless if we are home they could have gone in and repaired the issue without us in the home. Which instead of informing us there would be charges for a very simple fix, we did not realize there would be charges till we went to pay our rent. Thanks for that. We would have paid them regardless of when you told us before or after but its very inconsiderate not to inform someone of charges at all, just expecting it to be paid without us knowing? Over all we made the decision to be here and as we do enjoy the area and are pleased with the home we've made we will just have to take it else where to a more customer friendly management.

When I first signed up with Western Vistas the "show face" was appealing. Little did I know they would try and knit pick me for every little thing. The first thing is our dishwasher had a horrible smell so we put in a request to have it looked out. Not only was the service that was provided unacceptable but he stated "nothing looks wrong with It" after 3 minutes of looking at it. Later that month I went to pay rent and they TRIED to tack on a 85$ fee. I called to see what it was for and she stated "it's a service fee". (Although all the appliance are supposedly covered by the owner of the property according to the landlord tenant act) I ended up going round and circles with Paul who is extremely unhelpful. Next they tried to fine us for having a clean up kept bike on our patio when it states in the rules there is allowed to be one bike on the patio in working condition. The third strike was when we were without water for an entire week. First they said it was 2 leaks they found then it turned into 11 leaks. I understand that things happen that repairs need to be made but when I tried to contact them to let them know we didn't stay there for a week it was a too bad so sad explaination I got. Bottom line DO NOT rent from these people or the company. Every one of them I have dealt with is extremely hard to get ahold of and is nothing more then short of poor customer service.

I have been renting a property with Western Vistas for about six months now, and every step of the way sense signing the lease I have been treated by this company very poorly to say the least. Their customer service is very is not up to a common professional standard, often I am treated rudely or made to feel unwanted with my service. They perform in the bare minimum of what the legal stipulations are for renters rights, and cannot perform requested action correct the first time around or in a timely fashion. This company is comfortable with sneaking in hidden fees to services that should have been performed upon signing a lease with them. The basic appliances that cane with my lease were all in unsatisfactory conditions, either not functioning correctly or in a presentable manner. When replaced finally the new appliance was in poorer shape than the original. When asked to spoke and treat faulty conditions of our rest room that were inevitability going to need work, we were promises it would be taken care of before the set move in date. (They were not), then when asked to repair the said issue we were charged an additional fee for the service. Normally I an not the kind of person to leave such negative feed back about a company, but I find this to be unacceptable and would not want anyone else to have to deal with these same complications. This is a company that is indefinitely not looking for their clients best interest. I will not be leasing with them again and I hope no others will have to deal with my same misfortunes.

I have been renting a property managed by Western Vistas since May of 2012. At first, they seemed friendly and helpful and although they were slow to respond, eventually repairs did get made. Then they slowed even more and changed from a contracted maintenance person to in-house. The dishwasher racks were rusty and were getting rust on my dishes, I was told that parts were on order, then that a new dishwasher was on order, then after the maintenance switch, their guy came to fix some other minor issues and looked at the dishwasher, drove to home depot and purchased the cheapest one he could find and came back to install it. When I complained about mold growing under the clear silicone caulking in the shower, one of their agents took white caulk and went over the silicone instead of removing the silicone and the mold and properly re-caulking the shower. Now the caulking is coming apart from the silicone and the mold is still there. He also removed the silicone where it was coming apart in the kitchen and never returned to replace it. I had issues with the freezer leaking water and forming icicles inside. After several calls and emails to Western Vistas to alert them to this problem and after personally defrosting the freezer and detecting the problem myself and alerting them that it was a leak in the water line, they sent their guy who unplugged and re-plugged the refrigerator and that was his way of repairing the unit. I finally sent notice to Western Vistas that I was going to have the unit fixed and deduct the cost from the rent. I had a certified repairman out to repair the unit, he informed me that the leak was not only problematic inside but that it was also leaking into the unit on the door that dispenses ice and water and that it could have failed at any moment flooding our home with water. After paying for the service and sending a photo of the receipt along with an email that I was deducting the repair cost from the rent for November and December (he had to come twice because of ordering a part), I received a notice of eviction lawsuit for nonpayment of rent. I called and demanded to know why I would receive such notice when I did everything within my right under the Arizona Residential Landlord And Tenant Act. [redacted] said he would look into it and get back to me. He has never responded to me on this issue, 8 months later. Yesterday we had raw sewage back up onto our front lawn and water leaking in the bathrooms so I attempted to contact Western Vistas by phone, text, and email. It was a Sunday but there was no option to contact an after hours emergency service. I did text [redacted]'s cell phone and there has still been no response. It is now 9 am on Monday and I am going to proceed with my own remedy and will likely get another eviction notice. The only time this company has responded promptly to any request I have sent for repair has been when my lease was up for renewal. This has been the most stressful experience I have had in dealing with a property manager.
