Dear Revdex.com,
This letter is in response to a complaint assigned ID #*** filed against my businessThe following is my side of the dispute
/>
On 5/3/the customer brought his mower in for repairHe stated that the mower needed a complete service and reported that the mower was smoking too muchA repair tag was written up, the customer received a claim check, and we took his mowerThe mower was serviced and repaired at my businessThe customer was called on 6/3/to be made aware that the mower was repaired and was available for pickupThe customer came into my business on 8/18/2014, which was days after he was notified the mower was ready for pick upHe paid the repair bill but the mower could not be foundAt this time the customer admitted he had gotten the message that the mower was ready for pickupThe following day my service repair man returned a call to the customer, On 8/20/the customer returned to my business and we still could not locate his mowerAt this time I offered him a mower valued at twice what his mower was worth and an additional service to another mower that he owned in the name of good customer serviceHe refused the offer and wanted the money returned he had paid for the serviceI returned the money and continued to try to find his mower or a suitable replacementOn S/21/called the customer and said I could not find a suitable replacement and would like the model number of his mower so we could determine a fair market value for his mower
The model number would have been available on the owner's manual or his original purchase receipt
He said he could do that and would get back to meOn the morning of 8/22/the customer delivered a letter to my place of business with his demands
Enclosed is a copy of the repair bill for the service done to his mower and a copy of a sample claim check which states "no merchandise delivered without this check, not responsible for loss by fire and theft, or for goods left over days." The customer received his claim check when he brought the mower in for service, I do have security cameras around my business, Had the customer returned to pick up his mower within a reasonable amount of time we would have been able to follow the transactions that occurred with the mower via video
At this time the mower I originally offered him is no longer availableI have tried to be more than fair with the customer but we cannot come to a reasonable solution
Thank you,

I am writing in regards to the response by Westwood Garden Haven dated 09/16/2014.  He recommends using a neutral person, who has authority, to make a binding agreement.  After speaking with my Attorney, he believes that I should file a Civil Suit at our local Magistrate ([redacted] to recoup the cost of the lawn mower that was converted and recoup the cost of a used lawn mower that I purchased off a friend for $100.00 so that I could cut my grass for the last month.

Miraculously, I get a phone call  late Monday afternoon (09/22/14) from the Owner that my lawn mower was found!  He said it is ready to be picked up and I owe him $77.20.

This guy keeps stating that he is “reasonable” in trying to resolve this issue.  I don’t believe he did anything “reasonable” in trying to resolve this.  He never offered to have someone cut my grass or purchase me a used mower.  I am in the Customer Service Business as well, and I would have bent over backwards if I would have made this mistake.  To top it all off, he still wants to charge me?

I want this resolved as soon as possible, so I am offering to not file a Civil Suit if the Owner delivers the lawn mower to my house at NO CHARGE.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

The bottom line in this dispute is that Westwood Garden Haven converted my lawn mower.  He is trying to use the 30 days as his defense; however, he did not contact my wife on the telephone until 06/03/2014.  The original date on the work order was 05/03/2014.  That is 31 days.  So, at that point, none of his policies are void.  He also claimed that he made me an offer on a lawn mower worth twice as much as my original lawn mower.  That particular lawn mower was not near the one that I had.  It was much smaller.  Also, he is trying to make it seem that I rejected his offer outright, which is not the case.  I was willing to accept the lawn mower as long as I got refunded the money that I paid for the original service on my old lawn mower--which he refused.  Somehow his business can accept money after 30 days?

Review: My Lawn Mower that was taken in for servicing was no longer at the place of Business. I paid for the service work on 08/18/2014 ($77.20), only to find out that my Lawn Mower had disappeared. I was told to wait until the Service guy comes in tomorrow (08/19/2014), "He knows where everything is", was quoted by the Owner. The Service man called as promised, and asked me if I could stop up to see if the Lawn Mower he had was mine? I drove up again after work, only to find out it was not my mower. He said it wasn't "tagged" and must have been stolen, but he was willing to help me--except he had to run it by his Dad (Owner). The solution that the Owner came up with, was to offer me the Toro Mower that they had (the one I had to drive up to see); however, he would not refund my $77.20 that I already paid for. I refused and demanded my $77.20 back because I am not paying for a service that I did not receive. The Owner did call me at home at 6:11 p.m. on Thursday, August 21st. He wanted to know what type of Lawn Mower I had so he could find a replacement. I am not a Lawn Mower expert, all I know is that it was a Toro 22" Lawn Mower. I typed a letter and took it to the Business on Friday, August 22nd, basically telling him that the Lawn Mower was a Toro 22" and that is all I know about it. I also included in the letter that I would need a Lawn Mower delivered to my residence by the end of the day (08/22/2014) since it had been five (5) days since I was up to get my Lawn Mower, or I would contact the Revdex.com. There was not a Lawn Mower at my residence by the end of the day Friday, nor was there any type of message from Westwood Garden Haven on my phone.Desired Settlement: I would like a suitable replacement Lawn Mower delivered to my residence as soon as possible. This is poor customer service when a Business could make a giant mistake like this, and not own up to it.
