In response to "the pool did not pass inspection", and the customer's desired resolution of "I would like my pool to pass inspection": the Building Inspector for Westerly, RI, *** *** (*** ***), has stated that the pool is structurally sound and able to pass
inspection as soon as the client accepts that "door alarm chimes" are required as part of the installation to prevent minors from accessing the pool area without adult supervisionThe client initially had refused to have these "door alarm chimes" installedThe pool has since passed inspection after we worked with the building inspector to resolve the matter in an alternative wayWe are not able to circumvent Rhode Island building codes.In response to "and we never received the winter cover or automatic vacuum.": there was no agreement in the signed contract that states the client will receive a "winter cover", only an "Automatic Cover" was agreed to, and this has been delivered, installed, and passed inspectionA "winter cover" would have needed to been included as part of the signed contract and paid for by the clientThe automatic vacuum in question is listed as a $additional option to which the client did not accept at contract signingNo automatic vacuum will be delivered unless the client had initially agreed to the purchase of the vacuumWe did however provide a handheld vacuum, which is standard and part of our stakitIn addition, we demonstrated operation of the handheld vacuum for the client in person.In regards to the requested resolution of "the stone to be installed on the cover": the cover installed comes with a safety lid, which has been installed and passed inspectionStone lids were listed as "Not Applicable" in the contract which was signed and agreed to by the client prior to the start of work.The disputed amount of $6,is rightfully owed to Elvio and Sons Construction, LLC as all work in the contract has been executed in the manner detailed in the agreement, in best faith of Elvio and Sons Construction, LLC, and has since passed inspection with the Building Inspector in the Town of Westerly, RI.The client has also posted negative reviews about Elvio and Sons Construction, LLC in several places online despite our attempts to resolve the matter

It is not our intention to create ill will or a feeling of dissatisfaction with any clientMs***’s claims that we have asked people to post reviews since her reviews were posted are simply without meritWe are grateful to have clients that are happy to detail their success stories and will continue to service those clients with the respect that we try to afford each and every person we work with The attached and accepted contract by Ms*** details a payment plan that allows the client to extend the cost of the project over the duration until completionWe have developed this business model after years of working with clients and believe that is beneficial to client while also protecting our investment of labor and resources to completing each projectAny change orders or extras were detailed via e-mail between Mr***, a co-signer on the contract, and *** ***These e-mails have been handed over to our attorney who will further work with the client to reach a mutually agreeable resolution As this matter requires a resolution that is satisfactory to both parties, we have been advised by our legal counsel to defer the matter to their firm so that they may work with the client and her counsel to interpret the contract and determine the appropriate course of actionOur contact with the client has been through our attorney for the protection of all involved parties

The length in time it has taken [redacted] to respond to this compliant should speak for itself. Our pool has since and finally passed inspection but not due to any workarounds or deals made, but rather based on the Building Code. [redacted] and team finally provided the necessary information needed for the automatic pool cover to pass inspection. Door chimes are not needed if the automatic cover meets certain standards outlined in the building code. [redacted] and team were unaware of such standards until I brought it to their attention. The Building Inspector asked for that information over a course of several weeks (during the time I filed this complaint, along with several others) before it was provided and ultimately passed inspection. It is a shame that Elvio & Sons are not aware of the building codes in the towns in which they are working, but not shocking that he continues to place blame on the customer. We have paid thousands of dollars above the "contract" to cover these items. It was discussed at length during our initial meeting along with multiple times throughout the process. [redacted] never provided us with any change work orders or updated contract to address any additions and costs associated with. He did continue to ask for additional funds and we continued to pay [redacted] in "best faith" for the additions above and beyond the contract.I have filed numerous complaints with any agency I could in order to rectify these issues. I have tried to resolve this with Elvio & Sons only to be told I am harassing them. I have paid almost 100k to this company and yet they refuse to resolve the issues without additional funds (above and beyond the contract and above and beyond the funds we have paid in addition to the contract.) And yes, I have written reviews outlining the issues with [redacted] and our pool. I will continue to work to get this resolved in any way possible and have taken this approach as a last resort. The Revdex.com and potential costumers should be aware of our experience. Consumers like myself, should be aware of [redacted]. He has tried to threaten me with legal action as a result of these issues. He has asked people to post false reviews in order to counteract his negative ratings. I hope this experience will highlight some areas in which [redacted] can improve or at the very least save others from making the same mistakes we have. Review: The company was called upon to repair a loose hinge on a window in an apartment in New York City at [redacted]. For this minor repair the company charged $1281.89. Here's the invoice details: TNT window basic site visit to secure window $225. TNT window basic service (labor) $475. Sash removal and reinstallation labor $75. Additional stay arm $48.40. Tilt track element $34.50. New top scissor stay $245. Corner drive $74.50.This is an outrageous example of overblown charges and double billing (how many times can you bill for labor in same invoice?) According to the tenant who occupies the apartment (testimony available), this job took a very short time to "accomplish" and was poorly executed (photos available). Two e-mails to the company, addressed to its owner, [redacted], within the last 9 days, went unacknowledged.Desired Settlement: Since WM Industries has a monopoly on fixing windows at [redacted], they bill the building directly and the building's management company invoices the owner - me. I request a refund of $850 to be paid to me directly or to [redacted], which manages the building.

Tilt and turn euro style windows are not an easy system to operate or understand for many people.

I greatly appreciate the tenants candor in their own acknowledgement that they were not home during the corrective action performed.

These windows have over 50 locking and operating components per moving sash, each must be adjusted within 1 mm for correct operation.

The hardware is from Germany and has not been manufactured since the mid 1980s

In effort to provide appropriate service/response to the building, Windowman has maintained an inventory of this hardware for over 20 years.

Lastly, these windows were designed to tilt for ventilation and turn for custodial purposes only.

The only reason that the tenant was able to open the window prior to the repair like a door was due to the hardware malfunctioning.

Now that our company has corrected the problem and replaced the broken components, the window provides safe ventilation.

The building management company is well aware of the operation of the windows as well as the service our company provides.

It is obvious from the tenants letter that the window was and remains operational as intended, accordingly we see no basis for the request of a refund.

We stand behind our work and if there is any operational questions, we are more than happy to clarify them.
