To Whom It May Concern: In answer to the complaint registered by *** *** ** *** *** *** *** *** *** *indsor Medical Center offers the following explanation for the funds withheld from his mother's security deposit at WindsorUpon admission to our facility, we require a
security deposit to hold the room and to ensure that the room is returned to us in the same condition as it was receivedThe residents and sponsor are told that in the processThey are encouraged to hang pictures and make the accommodation as much like home as possibleHowever, we inform them that we will paint clean and make any repairs as necessary to return the room/apartment to the condition that it was receivedFurther, the contract reads as follows: "Windsor herewith acknowledges receipt of $1,which is to retain as a deposit for Resident's faithful performance of this rental agreementWindsor is not obligated to apply the deposit on rents, other charges, arrears, or damages caused by Resident's failure to perform the duties as defined in this rental agreementWindsor may apply the deposit, at its option and right, to possession of the premises for nonpayment of rent, or for any reason shall not, in any event, be affected by reason of the fact that Windsor holds the depositThe deposit, if not applied toward payment of arrearage or damages as therein provided, is to be returned to the Resident when the Resident has vacated the premises, delivered possession to Windsor, and informed Windsor of Resident's new addressIf Windsor repossesses the premises because of Resident's default or breach, Windsor may apply the deposit on all damages suffered to the date of the possession and may retain the remainder to apply on such damages as may be suffered thereafter by reason of the default or breach." In the Termination Clause it states: "Following the completion of the initial month of this rental agreement, Resident may terminate this rental agreement upon fifteen (15) days notice to Windsor." The Resident's unit was put back into the condition it was delivered (spackled, painted, and deep cleaned), the resident gave no notice, and moved to another facility, and Windsor charged only the agreed upon fees to return the unit to the condition it was receivedNo fees were charged for the no noticeIt is Windsor belief that this Resident was treated more than fairly, and that this is an unreasonable requestThis is our formal answer to Complaint N** *** SincerelyWindsor Medical Center, In** *** ** *** ***
