5/26/2019 My home was hit with a category 1 tornadoe in Crumpton MD. I filed my claim on 5/28/2019. I contacted Windsor Mutual Joy on 02/15/15 that my father passed away and to change policy into my name. I sent ID cards and all requirements. The policy was finally updated after numerous calls I placed and emails. It is now 07/12/19 and I still have no clarity on my claim, no check. I had to move my family out of residence of claim for no electric or AC or refirgeration for food. We have been stay a family members shore home in NJ waiting for Windsor Mutual Joy to do help. I'm a disbaled veteran of USA ARMY, combat service injuries and we have a 10 month old daughter. Living in NJ is expensive and we have no AC their. This whole ordeal has takn way too long. Today I asked claim rep to email documents so I can review and sign to help expeditite this process. It seems he insist on mailing paperwork to keep delaying my claim. Then he stopped emailing and clocked out at 3:30 pm. It's embarrasing visting your home on the weekend and all your neighbors homes have been repaired months ago by very professional insurance companies. Is this your companies standard procedure of operations? Claim Rep: J. Gallagher I had no choice to fillin review rating at 1 star. I can't select no stars.

however allow me to respond from our perspective.We
approach claims settlement in the same manner each time which is to say we
assess the facts of the claim and review the individual policy forms for
coverage applicationWhile each claims and the facts surrounding it do vary,
the coverage forms do not and they are the guiding principal behind determining
if coverage can be afforded or not.In **
***’s situation the coverage question at issue is whether or not the cause of
loss or the proximate cause was snow load or windOur research revealed there
were moderate winds on the date of loss reported to us and gusts of up to
MPH were recorded in the insured’s area***’s policy carries a specified
wind/hail deductible for damages suffered as a result of the perils of either
wind or hail.Given
the weather data supports the fact that there were mild winds with gusts of at
least MPH, whether directly or indirectly was one of the actual causes of
lossOur policy specifically states that the specified deductible will apply
regardless of other causes or events that contribute to or aggravate the loss,
whether such causes or events occur before, at the same time as, or after the
loss.Based
on our findings the wind deductible is warranted and the specified deductible
must prevailI should also note that at every renewal of the policy these
forms are listed and supplied to each insured so that they are aware of the

Review: I own a single family home in the [redacted] area of [redacted], Maryland. A heavy wet snow storm hit the area on or about the 25th of March, 2014. My home in [redacted] is a vacation home so I was not present when the damage occurred, however, it was reported to me on the 26th of March that several large tree branches had broken off of a large pine tree during the snow storm and had fallen onto my deck, yard and roof. The deck received most of the damage as only residual branches fell on or scraped the roof. I was sent several pictures of the damage and subsequently reported it to my insurance company on the 26th of March.

My insurance company contracted an independent adjusting company, [redacted], to review and report on the damages. [redacted] Adjuster, [redacted] (###-###-####) visited my home shortly thereafter and provided me with several companies who she said she would work with on the estimate for repairs. A construction company by the name of [redacted] looked at the damage and provided **. [redacted] with the estimate for repairs. **. [redacted] later said that she reviewed the estimate and had submitted the information to Windsor Mount Joy adjuster, [redacted] (###-###-####, ext. 225). **. [redacted] reported to me in an email on April 24, 2014, that she had reviewed **. [redacted]'s report and had issued a check in the amount of $10,929.52, which represented the estimate minus the $500 policy deductible and a recoverable depreciation of $825.41.

I personally inspected the damage the weekend of April 26/27 and discovered a hole in the porch roof that did not appear to have been captured in the estimate. I reported this information via email to all involved parties on Monday, April 28. On April 30th, I received an email response from **. [redacted] advising that she would discuss this "new development" with **. [redacted], and said that she additionally had reviewed my declarations page and noted that I had a wind deductible of $10,000. She said this amount would now be deducted from my first check for damages. I responded with photographs of the tree limbs sitting on top of the damage, pointing out the snow that was clearly visible in the picture and explained that the tree branch had dropped straight down onto the deck directly below it. I explained that the snow was heavy and this could be verified through newspaper articles and pictures. She responded by saying "perfect, I will discuss with upper management and get back to you". She responded again on May 13th advising that she had discussed my claim with "upper management and they are maintaining the position that your $10,000 wind deductible would apply to the loss. The day in question had significant winds which could have caused this branch to fall". I promptly called **. [redacted] and requested to speak to her supervisor. She said she was sorry but the decision was made at a level even higher than her supervisor and that my only recourse at this point would be to file a complaint with the Insurance Commission. I am therefore filling this claim in dispute of their findings.

The major portion of the damage suffered is to my deck. I contend that this damage was caused by the weight of snow. The branches that fell were too large to be affected by wind, which I believe averaged 8 mph on that date. The branches which caused this major damage to my deck fell from a location on a tree directly above the area if impact. They fell in a straight downward trajectory onto the deck. There was no variance to the degree in which the branches fell. The other smaller branches which caused some minor damage also fell from locations directly above the house. I have been insured by Windsor Mount Joy since 2004. This was the first and only claim I have made. I believe their conclusion that wind was the probable cause of the branch breaking is arbitrary and capricious, and an obvious effort to cheat one of their insured members out of repair costs they are legally responsible for.

I am deeply concerned that a company that I believed had my best interest in mind all these years, in reality only cared about coming up with a solution of how to unfairly avoid paying their obligations. I have photographs that will support my beliefs and findings. I also believe that **. [redacted]'s initial review of my claim was accurately submitted and that her unbiased belief was that this damage was caused by branches breaking due to the weight of snow. Her objective and fair analysis was demonstrated in her initial email which stated that she had established the deductible to be $500. I believe **. [redacted] corroborated this in her initial report to **. [redacted]. **. [redacted]’s report was later changed by someone up her chain who sought out a way to unscrupulously avoid paying the claim, regardless of the absurdity of their justification and reasoning. I believe this is a true insurance company scam and if they are permitted get away with this unfair tactic, they will undoubtedly use it again and again to cheat honest unsuspecting people. I respectfully request that you review this matter to assist me with my claim and to prevent this company from acting in this manner in the future.

Review: This home owner insurance coverage company has been the home owners insurance for my property since the house was build in October of 1993, for over 20 plus years. With no claims the company is quite okay with taking the insurance funds from this property owner. Unfortunately with in the recent 3 years there were 2 small plumbing incidents with water damage of approximately four thousand dollars. Since then, this home owner insurance company will not renew the policy, making it most difficult for me as a property owner, loyal customer to get other home owner's insurance. It appears that this insurance company is only about profit and for themselves and not loyal or just or fair to their long term customers. There was no negligence on the part of this home owner. This insurance company should be penalized for its unfair acts, whether that be a fine by the Commonwealth of Pa or re-enstatement of home owner insurance coverage. Additionally, it should be noted that this insurance company has a history of doing this to home owners.Desired Settlement: home owner insurance coverage at reasonable rate for the current property and an apology for their premature dismissal for unjust denial of renewal of insurance.
