I am rejecting this response because it is dishonest and disingenuous response.  Everyone understands that Winsor is a training school and does not administer the test. This is stating the obvious. The real issue is that they guarantee passing or your money back. However they are unwilling to give the additional training that is needed to pass the test. They now say they will give 3 hours of training the day before the next test but this is insufficient to pass the test. There is nothing in the contract that allows them to limit additional instruction to 3 hours the day before the test. Moreover although they have the ability to arrange a more prompt retest they deliberately are not doing so. It seems their tactic is to make one wait in the hope that one will go away. For example in my case the retest date is March 29, 2016 although the first test date was on November 20, 2015. Ask them where the contract states that additional training is limited to 3 hours the day before the new road test date. If I did not pass the first test after 100 hours of instruction how will I pass the second test after 3 hours of instruction, not even taking into account the loss of knowledge between November and March. Lastly it should be noted that I told Mr. M[redacted] that I was not ready to take the test in November but he insisted that I take the test although I felt I was not ready.

This client came to our school for 4 hours of training and a CDL road test in Staten Island NY, he received all of his training according to our schools agreement. It takes about 40 hours of training to learn how to drive a Tractor trailer, this client took 4 hours of training anddrove the tractor...

The training course this student signed up for is a guaranteed course. As our contract states we shall guarantee the student to pass their CDL road test, however we are just a training school and are not the organization that administers the test. The Motor Vehicle Commission of New Jersey is who...

gives the tests, and they determine whether someone passes or fails. Due to the fact that we have no control over who passes the test our guarantee states that if a student were to fail we would provide extra training at no charge and truck rental for the road test at MVC until the student passes his road test. That is what the contract states, and that is what the student agreed too.  So that is what we will do.

Review: On June 17th 2015, I paid for two hours yard training with an instructor who supposed to be in the vehicle with me but I only received one an half hour training with no instructor, when I ask the instructor to instruct me of what to do he said I'm ok on my own, so basically I had to train myself.

On June 23rd 2015, I request and paid for one hour road training after paying the fee, the boss told the secretary that I could only get half an hour in the yard and the other half on the road. The boss was fully aware that I was only going to do two lesson and I paid for the road test. The arrangement was one lesson in the yard and the other lesson on the road and I drive the truck to test site on June 26th 2015.

I got no instructions from the instructor for the road training, all he said that I was ready for the road test and I'm doing good. The day of the road test the owner allowed me to drive until he started to yell, shout with foul language at me he said that I was about to hit the toll booth which was not true because I took my time and drive really slow. The owner agreed that I will have to pay twenty-four dollars for the toll. The total toll fee was fifty-seven dollars instead of twenty-four, the owner end up putting the balance of the money, then we continued towards the test site. The owner started to shout at me to drive faster and saying we are going to be late and when I wasn't doing it he was cursing at me and yelling, which at this point got me very nervous and I panicked while behind the wheel.

Which lead me to fail my driving test, because I was still nervous, and terrified of his behavior. After I fail the test he said I should refund him back his toll money, I turn to him and said you should refund my road test money because you were the one who caused me to fail along with poor power steering of the truck. He did not give me any answer but turn his back and walk away.

I did not get the service that I paid for and they were not professional.Desired Settlement: I want my money back for the road test and toll fee. The services that I received was very poor from the lesson to the road test. For someone to hire a company to practice should not be left alone to teach themselves.

Review: Company sold services that guaranteed passing of CDL license or your money back. Took CDL test and failed. Company is only willing to provide limited training (3 hours) day before next test date. Company is essentially reneging on guarantee as this limited training will not result in passing as demonstrated by training to date of 100 hours which resulted in failure.Desired Settlement: Total refund of payment made.
