Whom It May Concern:We have received complaint number ***
asserted by *** and *** *** against our Company, Wolf Creek
Properties, LLCOur Company's response is substantially the same as the
email provided as an attachment to the ***'s Complaint.The ***'s are requesting
our Company to pay for rodent problems at their honse under a
Builder's Limited Warranty provided in connection with the construction of thdr homeAs stated in our
prior email, such rodent problem is not a situation covered under our (or any) Builder's LimitedWarranty.The ***s' home was constructed in conformance with ail plans and
specifications, according to code, according to the terms of the contract executed by the ***s, and in accordance with all
appropriate inspections by government
officialsIn fact,
the ***s had their own independent inspector inspect the property prior to closing on their house, and there were no exceptions to
the construction of the home or indication of any "gaps" as now
alleged by the
***s.The ***s reliance on subsequent "home
inspectors" are merely the pest control company and insurance adjuster which are not qualified to asse1t
any alleged construction defects in contravention of the numerous governmental officials and our
company which built the property in a good and workmanlike manner, not to
mention the ***s
own home inspector chat did not
raise any of the now complained of alleged "defects".Simply put, the ***-s' home was constructed in
conformance with aH good and workmanlike construction requirements, and rodent access to their property
through whatever means a wild animal chooses is not a construction defect, nor is it an item
covered under any Builder's Limited Warranty.Our company cannot guarantee wild animals will not access property, and mere subsequent access does
not give rise to any construction defect regardless of what the ***s "believe".Our Company at all times has acted in good faith in attempting to resolve
all of the ***s concerns regarding the construction of their home, and
in fact have gone above and beyond tying to resolve all conflicts with the
***s regarding the construction of their homeHowever, as to the rodent
access to their property, our company is simply not responsible for the same
and no payment will be made

I am rejecting this response because:Part of our contract for building our house was that the builder was supposed to provide us for one year a warranty that covered any mistakes/ over sites in the building of our houseWhile we had a list of things that needed to be repaired prior to closing we also had a list of things that had to be repaired post closing. Caulking around both bathroom tubs.Fencing replacementSealing around kitchen sinks. Sealing between countertops and back splashHoles left in the walls in both a closet and the kitchenChunks of wood coming out of drawer frontsDoors that needed to be adjusted so there weren't gaps between door and door jamb.All of these things were errors in construction repaired by Wolf Creek employees post closing as per our warranty.As for the rodent issue, we were dealing with it ourselves for quite a while without involving Wolf Creek builders (and have not asked for compensation for this part) until we were told by multiple sources that the rodents were getting into our attic through gaps in the construction (which we have photos of the gaps in various places around the home and sent copies of those photos to Wolf Creek) When we informed Wolf Creek of the gaps, we were still under our year warrantyWolf Creek did not seal the gaps, did not offer to seal the gaps, and did not offer us money to allow us to seal the gaps by someone elseTherefore even though the gaps still fell under warranty, we had to pay money out of our pocket to have the gaps sealed and have the rodent situation rectified because of those same gaps
