Failure to provide pay off of sold boat/trailer to bank to facilitate transfer of title to new owner.The property in this case is a boat that belonged to my mother who passed away in October 2013. In the summer of 2013, she took the property to Wooten's Marine in Rocky Mount, NC with the intent to have the boat sold on her behalf. My sister and I assumed the responsibilities of her estate and informed Wooten's Marine of this. In May 2014, I called to check on the status of the boat. I was told that there was a potential buyer and to make the sale process smoothly, I was sent title release forms, which, when signed by both my sister and me, would provide authorization for the bank to send the title directly to Wooten's Marine so they could handle the transfer of title to the buyer. With that completed, we were under the assumption that all of our affairs were in order to facilitate the final sale with no further issues. Over the next few months, I was told that the sale was still pending. On November 14, 2014, I was contacted by the new owner, who informed me that he purchased the boat in June of 2014 and had the boat in his possession at his home in Virginia and he still had not received the title. I had still not been notified by Wooten's Marine that the sale had been finalized nor was I informed that the boat had left Wooten's Marine. I called the financial institution for the loan and they had not received any payment from Wooten's Marine. I then contacted Mr. Wooten and asked why the payoff had not been sent. He informed me "we had to settle our accounts" before he could send the final payment out and my parents had an agreement with him that the boat would be sold for the payoff amount at the date of the sale. I was not aware of this agreement nor did I have any paperwork in my parents' files outlining this agreement. He said in order to finalize the sale and transfer funds, I would need to pay a repair bill and a broker's inspection fee. I requested the invoices for these repairs and the broker's inspection prior to paying the amount. After receiving the invoices, the repair and broker inspection fees ($1,278.22) were paid to Wooten's Marine. Important to note here was that the invoice noted the agreed upon selling price was $21,036.84, but the new owner actually paid $23,500.00, which equates to a difference of $2,463.19. I do not know where that money is, nor was I informed of this excess money verbally or in writing. From this point, I called at least once a week to ask about the payment being sent to [redacted] On December 12, 2014, I left Mr. Wooten a message saying that if the payment was not sent within the next week, then I would have to take legal action. The following Monday, December 15, 2014, Mr. Wooten called me back and said that he would have the check sent out that week. However, on January 2, 2015, I called the bank for the payoff and it was still not completed. I left Mr. Wooten another message informing him of this and once again, telling him that legal action may be required to ensure the transaction was completed. He called me back on January 5, 2015, informing me that he was not sure why the check was not cashed and that he would cancel it, and send another one. I asked him to do so, and supply me with a tracking number for the check once it was sent. As of Monday, February 9, 2015, I have not received a response, nor has the Bank received payment. In the interest of fulfilling my legal obligations, my sister and I have to finalize this transaction. In short, the boat has been sold for close to eight months now, with the money from that sale still not in the Bank's hands. In addition, my sister and I are still paying the monthly payments on the boat to the Bank out of our own personal money to avoid further complicating the process. Since June 2014, this equates to over $2,900.00 of our personal money. As I am unable to settle this issue on my own through oral communications, I am deferring to your office for assistance in this matter.Desired SettlementProvide complete pay off for the boat, trailer, and engines with pay off date that matches the date of the sale (June 2014) to financial institution, NOT the current pay off amount. Once pay off is complete and titles are recieved, they must be transferred immediately to the new owner to finalize the sale of the property.
