I am rejecting this response because:
I have stated in many e-mails sent directly to World Class, in my meetings with them, and in my responses via the Revdex.com that all the items that need to be fixed that were caused at the time of installation by World Class as per the inspection report need to be addressed and need to be addressed immediately.  I have not heard from World Class; they have not called me or e-mailed me to schedule the appointment to have this completed.   My roof is under warranty, they are the roofing company that caused the problems; they should have been out to my home immediately to fix the issues.  I will send them an e-mail to schedule the appointment, since they never contacted me to do this, which is their job to do so.   The issue with the low pitch roof is not just due to the skylight issue as per the inspection report.  As I stated previously, I am having the skylights replaced, and I do not expect World Class to be responsible for the skylights.   The repairs to the roof need to be completed before the new skylights are installed. However, they were supposed to have fixed the flashing around the skylights and they didn't; they used existing flashing to do this, and the inspection report states there was debris, etc. in the flashing.  What I do expect is for them to honor their warranty that covers the entire roof, and clearly the inspection report states that "the back elevation showed several nail pops.  These nail pops were causing interior leaking right now but will need to be addressed at some point".   The inspection report also states that the shingles are not laying flat and flush, including around the skylights. This combined with the low pitch roof is allowing wind driven rain to access the shingles and back in behind them to the interior.  This is a completely separate issue  and a completely separate way that water is getting into the interior.  World Class installed the roof.  And, because World Class should have never installed two layers of roof on the low pitch roof to begin with, never informed us about ANY potential issues or leaks that can be caused by installing 2 layers on the low slope roof, as a matter of fact, they said it was perfectly fine to do so, current leaks can be coming from other places besides the skylights and the flashing, and as per the inspection report, other problems caused by installation are also contributing to the leaks.   World Class never offered to help in any way with the leak issue, nor did they offer to perform a water test to pinpoint exactly where the leaks are coming from.  Is World Class willing to incur the cost of having an independent roofer perform a water test to pinpoint where the leaks are coming from?  World Class knows very well that this needs to be done.  Because of the lack of cooperation from World Class, because they will not honor their warranty, because they will not do what needs to be done to stop ALL the leaks, because of their faulty and incorrect installation of my roof, I have water coming into my home and will continue to come into my home.  World Class has not done one thing to correct or stop this, and I have 7 years remaining on my warranty.  They are the roofers that installed my roof, my roof is under warranty, they need to determine where the leaks are coming from.  And, I provided the inspection report to them as a courtesy and they are not acknowledging what the entire report states; they did nothing to help determine where the leaks are coming from, and the inspection report is not a full report regarding the leaks.  Instead, they are using a portion of the report regarding the skylights to try to not honor their warranty.  I didn't  have to give them a copy of this report, but I did, to be fair, honest, and open, and World Class has been anything but fair, honest, and open and refuses to honor the warranty.   World Class knows very well that the inspector was not sent to my home by my insurance company to determine where the leaks are coming from; they were sent to my home to determine if there was any storm damage to the roof that was causing the leaks, and there was no storm damage.  Again, they did not inspect where all the leaks were coming from, they were there to inspect for storm damage, and noted what was obvious.  Now, I have to incur the cost of having a water test performed to determine where all the leaks are coming from.  I should not have to incur this cost, World Class should be incurring this cost, and the cost to replace the entire roof if that is what is needed.  I will wait for an answer from World Class if they are going to pay for the cost of having an independent water test performed; we will see how much they are willing to solve this issue once and for all.

As we stated in our earlier responses, we reached out to Ms. [redacted] via email and advised that we are willing and able to do the repairs (related to the warranty) as stated on the inspection report.  
Again, the issue with the low pitched roof is due to the skylights.  We did not install any skylights so no warranty exists with our company.
Ms. [redacted] continues to reject our responses pertaining to completing the repairs covered under the warranty.  We are waiting on Ms. [redacted] to advise if she would like us to come and address the warranty work.

I am rejecting this response because:
I have all the e-mails and documentations of discussions.  I have told World Class numerous times via e-mail, face to face meetings, and via the B.B.B. that they need to contact me to resolve all of the issues as stated in the inspection report and that I needed to have those items fixed.  This, however, does not address the faulty installation of the low pitch roof, which World Class continues to ignore and not take any responsibility for.

Review: World Class workers did not replace my roof correctly or to a level consistent with the contract. i.e.: ice and water shield and underlayment were not put where it should have been and was omitted, flashing was omitted and old materials were reused, shingles were reused and / or substituted for ridge shingles, etc. March 13, 2013 roof was installed - I discovered a multitude of problems such as: Permit was never obtained until August 9,2013 (5 months after original start date!).Ridge vent not properly cut into peak sheathing Attic fan cut out and was not properly covered with replacement sheathing Live electrical wire from attic fan was cut and left hanging. Bathroom vent duct left hanging into attic insulation Roof shingles that were taken off to correct problems were reused a second time.Sections of roof requiring flashing had been ripped out and left missing without being reflashed and other sections had scraps of used metal put in as flashing.My first story sunroom ridge vent was missing shingles.The garage ridge vent was half covered with regular roof shingles substituted for ridge vent shingles.Rain gutters were dented and buckled from overzealous shoveling also causing them to be pulled far out from the fascia.Rain downspouts were smashed flat. Tarp pieces were left hanging from the gutter hangers.Gutters were left loaded with shingle pieces, plastic, nails, etc. failing to remove all job related debris as per contract. Gutter guards were never put back onto gutters.Vinyl siding was cracked in at least 3 different areas Missing vinyl siding pieces from the chimney chase. Corner of chimney chase vinyl piece badly broken.Exposed and UNSEALED nails on roof and vent stack covers Vinyl siding was put on by face nailing in areas Skylight removal debris (sheetrock, nails, wood, and saw dust) was all put in hole to fall inside of house covering floor and furniture and was not cleaned up as per contract. Received letter of demand for final payment although job isDesired Settlement: continued: unfinished and incomplete. Roof leaks and did not leak prior to new roof. Company cannot and now refuses to fix by blaming siding issue! Repairs resulted in additional damage, they failed to issue updated contract for repairs, did not abide by the agreed work as stated in contract, website misrepresents workmanship, ability to perform work, states 100% customer satisfaction and company does not honor these statements. Roof FAILED FINAL INSPECTION as per Building Code of Ocean County government of Toms River. It goes on and on but proof to my claims is the Failure of Inspection from the township of Toms River. I will only be satisfied to get my money refunded so that I can hire a competent contractor to redo the work required from start to finish the correct way it should have been and will enable me to obtain the new contractors warranty. Contractors do not want to "fix" another contractors defective workmanship. World Cls claims over 22 yrs exp they shd know better!!!

Ms. [redacted]’s complaint regarding poor workmanship is unfounded. She is consistently and continuously trying to defame my business through many avenues and has been unsuccessful to date. We were contracted to replace her roof, we have completed the job in its entirety and have yet to be paid for our services. Ms. [redacted] admitted to knowing, after we went back to her home on several occasions, that she can see that it is a siding issue causing her leak but wanted to blame that on us as well. I do understand there were some valid issues early on that we addressed and corrected immediately. Mr. [redacted] was released from my employ and I personally took over on the repair issues for Ms. [redacted]. Ms. [redacted] is well aware all the materials used were new. She received a copy of the invoice from the materials being dropped off by the supplier to her residence. As far as failing the inspection, we were notified by the Township that Ms. [redacted] “told” the inspector her roof is leaking so they had no other choice but to fail the inspection. The township did not see a leak or even go up on the roof. This matter is already being rectified.

I have attached a timeline to prove many instances where we have gone above and beyond to satisfy Ms. [redacted]. Unfortunately, there are some people that will never be satisfied unless they get something for nothing.

Let me reiterate again that Ms. [redacted]’s invoice still remains UNPAID. She tried to have her credit card company reverse the initial deposit charge but after we submitted our documentation to prove we did our job, they denied her request.

I thank you for the opportunity to respond to the complaint. The timeline is as follows:

2/1/2013 – Ms. [redacted] was emailed an estimate for a roof replacement in the amount of $8995.00.

Ms. [redacted] then went on our website and read that customers who refer other customers can receive a $300 discount for any roof job. Ms. [redacted] stated she wanted this discount because she was referring herself. She also said this to my administrative assistant. Mr. [redacted] responded to her stating you cannot refer yourself. She was adamant that she wanted the $300.00 discount, so Mr. [redacted] went ahead and authorized it. This was not omitted from the estimate as Ms. [redacted] claims, her request for the “referral discount” came after the estimate was drawn.

2/28/2013 – Ms. [redacted] signed the contract with the hand written discount of $300.00 . Ms. [redacted] called my office to pay her deposit via credit card to my admin, [redacted]. That payment was processed and an invoice reflective of the $300 discount and the deposit was emailed to Ms. [redacted] (see Item 3). Ms. [redacted]’s claim that we used a pressure tactic to get her to sign stating prices would go up is absolutely false. We did tell her that March 1, 2013, there would be a 10% increase in materials.

3/12/3013- My admin called Ms. [redacted] to confirm that World Class would be there tomorrow to start the job with our subcontractors, weather permitting. This was going to be a minimum two day job.

3/13/2013 – Roof Installation began. Ms. [redacted]’s claim that they ran out of supplies is correct. We immediately went to the supply company and purchased what we were short on.

3/15/2013 – My admin received a phone call from Ms. [redacted] stating the roof was complete and that she would pay the balance via credit card on March 18, 2013. She also asked my admin, since we had her credit card information on file, if we automatically charge her credit card. My admin stated we do not do that without her authorization. This should attest to our professionalism since we still have her credit card information and have not charged her for the balance.

3/18/2013 – No payment from Ms. [redacted] as promised.

3/20/2013 – Ms. [redacted] reached out to [redacted] with some concerns regarding the attic fan and some visual issues with the roof. Nothing remotely what she put in the complaint. Nevertheless, these were taken seriously and Mr. [redacted], from World Class, was scheduled to go to Ms. [redacted]’s home on March 26, 2013. Ms. [redacted] requested we not have him come out until after Easter. We rescheduled for Mr.[redacted] to go out on April 1st.

4/1/2013 (I cannot be 100% sure of this date due to bad weather) – Mr. [redacted] and Mr. [redacted] determined her complaints were valid and that the roofers would be back out there.

4/9/2013 – We received an email from Ms. [redacted] requesting we use new materials (see Item 5). We always use new material unless the homeowner asks us to save them money by reusing good material. The roofers along with World Class went back out to correct the problem.

4/12/2013 – My admin left a message for Ms. [redacted] at 3:35pm. No response from Ms. [redacted].

4/15/2013 – Again, my admin left a message for Ms. [redacted] at 8:35am and 3:10pm. Never received a call back.

4/16/2013 – I received an angry email from Ms. [redacted] complaining there were still leaks (See Item 6). I immediately contacted Ms. [redacted] and informed her I would come out personally, which I did.

4/22/2013 through 5/20/2013 – The attached emails between myself and Ms. [redacted] clearly show the communication and also reference the many visits I made to her home to address the issue (see Items 7 through 22.) Ms. [redacted] was present with me when we ran a hose directly on the area she was saying the leak was coming from and there was no leak. She saw it for herself.

5/22/2013 – Our representative, [redacted], met with Ms. [redacted] and showed her, with exact certainty, that the leak was coming from a siding issue, not the roof. I sent an email to Ms. [redacted] reiterating the findings and asked for the balance due us.

5/24/2013 – I received an email from Ms. [redacted] stating that, although she is aware the leak is coming from the siding, we should have alerted her to a problem with her siding. She also states in this email to forward her a corrected invoice and that she would remit the remaining payment. A repair history is not part of an invoice.

5/28/2013 – We emailed and mailed a letter to Ms. [redacted] stating we were contracted to do a roof installation, not a siding installation.

6/18/2013 – I received an email from Ms. [redacted] claiming her past requests have gone unanswered and that her roof remains unfinished. Her roof is complete as even she stated in her email of 5/24/13. When I received this email, I realized Ms. [redacted] still had no intention of paying us. This is when the process began on our part to begin litigation.

Ms. [redacted] never reached out to me again from the time period of 5/24/2013 through 6/18/2013. I think I have more than proved we went out of our way to make sure the job we were contracted to do was completed. From day one we accommodated Ms. [redacted], even with her frivolous “referral” to get the discount. Ms. [redacted] still owes us $4,150.00.

I hope I have provided you with enough information to support my response to Ms. [redacted]’s allegations.

I am rejecting this response because:

World Class Gutter Cleaning, Roofing and Siding including

owner [redacted] practice misleading and deceptive advertising as I have claimed

and can prove with photos and documentation.

World Class did not perform their contractual obligations and refuse to

take responsibility for defective and incomplete workmanship on my home. Code

[redacted] under the Administrative Rules of Law and Public Safety codes still

exist as of this date due to defective workmanship on my home from World Class.

World Class advertises 22 years staff experience in the

construction field on their website. That should prove that omitting the

cutting of a ridge vent in the attic sheathing and just making it look like a

ridge vent was installed from the outside was done purposely and intentionally.

Substituting different and/or used materials during their job and fixes on my

home were/are unacceptable to me as I have let World Class know this fact

numerous times but to no avail.

World Class [redacted] claims he reuses material to save

the consumer money (see his timeline date response of 4/9/2013 statement). How does this save me money when the contract

is the price it is and is not changing??

He is not refunding the difference so it only saves World Class

money!! Closely check the copies of

purchase orders World Class has provided as they contain credits for goods/merchandise

returned!! [redacted] has contradictory

answers for everything in his desperate attempt to cover up his deceptiveness.

Omitting the ice and water shield around entire perimeter

of roof as contained in the contract and not obtaining a permit prior to

starting work is a code violation 13:45A-16.2.10.i. I also

never received a copy of this permit as I should have which is another

violation of code 13:45A-16.2.10.ii.

Work was performed March 13, 2013 and the permit was obtained August 9,

2013 (5 months later!).

The roof inspection failed for multiple reasons including

NJAC 5.23-6.5b and with a notice of imminent hazard. I have documents and photos

to prove all.

The World Class web site also advertises 100% guaranteed customer

satisfaction which is insincere, deceptive and falsely disparaging considering

they refuse to acknowledge their defective and incomplete workmanship which

caused the leak in my roof; I am definitely NOT satisfied at all. The website

also claims “superior workmanship” which as the photos I have and the failed

township inspection clearly and prominently discloses as quite the contrary to

that claim.

Their website claims $300 off any roof job period and

they did not want to honor that ad when I mentioned it to them. World Class knew I was correct and gave me

the discount otherwise why did they give me the discount? I did not sign any agreement in

writing before the start of the roof job but did give a written consent to the $300

adjusted invoice to secure the job and provide the credit card payment.

On [redacted]’s 3/12/2013 timeline that he sent to Revdex.com,

he states that the roof job on my home would be a minimum two day job. This absolutely SHOULD have been a two day

job instead of the 7.5 hours that was spent doing this job, and then perhaps

this job would have been done correctly instead of rushing and omitting

materials and bypassing the necessary work that was also in the contract.

I responded to every email and telephone call from World

Class and have dated phone logs and sent emails to prove it. [redacted] PROMISED

me that my roof would not leak but it does, my roof remains incomplete, my

siding is damaged along with damages to the rain gutters, downspouts, screens

and garden lights among other things. I

had to personally clean out the gutters of the roofing debris, nails and also

fix the pulled out gutters and smashed downspouts. Again the contractual

obligations and advertised “superior workmanship” were not met.

The representative named [redacted] that World Class sent to my

home gave me estimates to repair everything at an additional cost from his own

company! Since [redacted] was sent from World Class it is no surprise that he will

side with World Class in saying my roof leak is a siding issue. I believe this

was intentional and a conflict of interest at the very least. This is part of the games that World Class

plays with consumers. I can provide copies of these estimates. [redacted]Note: If

there was no damage and the roof is complete as World Class maintains, why

would I be able to obtain estimates pertaining to and consistent with

damages/fixes/rework to my roof from multiple other independent

contractors?? Why would the failed

inspection report state these defects? These

estimate copies can also be provided.

June, 2013 World Class sent me a Letter of DEMAND stating

roof is complete and to remit full payment immediately which by doing so before

a completion of a job is in direct violation of 13:45A-16.2.6.v.

At this point World Class has refused to honor their warranty

on the contract and the issues concerning my roof. Their repeat visits and attempted “repairs”

only worsened the problems with this roof job.

They are not able to fix the damages caused by themselves so they blame

it on a siding issue! Their website promises “100% guaranteed customer satisfaction”. There is 0% trust in this World Class

Gutter Cleaning, Roofing and Siding Company and 0% customer satisfaction for

me.

*Note the latest letter that I received dated September

25, 2013 is one stating that it is World Class’ understanding that I have

complaints that my roof is leaking. I

have been communicating this complaint to World Class since March 2013, for

almost 6 months now and they have been denying this issue since their botched

repair attempts failed and worsened the leak.

This letter should also show the games World Class is playing and how

unprofessional they truly are.

I can provide many photo's and documents to backup my claims if needed.

This

is in response to Mr. [redacted] World Class misinformation that he is giving the

Revdex.com in his desperate attempt to cover up his violations and wrong doings.

The

complaint to the Department of Consumer Affairs concerning World Class and

myself was definitely NOT DISMISSED as Mr. [redacted] stated and would like you to believe. The Department of Consumer Affairs has given

World Class Gutters Roofing Siding/ Mr. [redacted] numerous code violations that he needs to correct or he will be fined. A copyof these violations

sent to Mr. [redacted] and his company World Class Gutters Roofing Siding

is attached to prove this.

WORLD

CLASS GUTTERS ROOFING SIDING DID NOT FULFILL THEIR CONTRACTUAL OBLIGATIONS for

this roofing job and therefore IT IS WORLD CLASS THAT IS IN BREACH OF

CONTRACT. They omitted important

materials that are listed in the contract along with work that should have been

performed and was not. This has caused

damages to my home that did not previously exist.

The

roof did not leak before the new roof but the roof leaks AFTER the new roof was

installed. Most homes get a new roof because the roof leaks so that after a

complete new roof is installed – THE ROOF SHOULD NOT LEAK. Proper installation of a roof that adjoins a

wall requires proper underlayment materials and

proper flashing. THIS WAS NOT DONE. As a

roofing business that advertises “extraordinary” and “superior workmanship”, Mr.[redacted] should know how to install a roof correctly.

His attempts at incorrect and quick

fixes for this problem resulted in worse leaks and damages to my roof. He then blames the leaks as a “siding

issue!” The leak is in the roof coming

in the ceiling and not the wall. Mr. [redacted] sent a “construction friend” claiming to be

an expert to look at the leak problem only to have his friend named [redacted] agree

it is a siding issue (how ironic!) but who also

gave me an estimate for additional hundreds of $$$ to fix the leak.

This

is scam like and I find this practice along with World Class Gutters Roofing

& Siding ethics appalling. I have

several estimates from separate independent roofing contractors all consistently

stating the leaks are from incorrect roof underlayment and damaged or missing roof flashing.

I

have been more than fair and patient and have taken more time than anyone should

ever have to with World Class Gutters Roofing Siding in order to correct these

issues. Mr. [redacted] did not act in good faith at all

and advertises falsely. I

have allowed Mr. [redacted] of World Class Gutters

Roofing Siding many chances to correct all problems caused by his company to no

avail. His warranty according to the

contract says 10 years workmanship which is not in good faith if this is his way

of handling this warranty. Furthermore

the World Class Gutters Roofing Siding Website

states 100% satisfaction guaranteed. I

am NOT satisfied at all.

*Note:

Mr. [redacted] obtained a permit 5 months AFTER this

roof job because it was in the contract and the Dept. of Consumer Affairs forced him stating he was in

Breach of Contract. By obtaining a permit a job will be inspected by a Building

Department Municipal Government Township Official to insure the work was

correctly done to code. I did not tell a Government Township Official Inspector

how to do his job as Mr. [redacted] is

insinuating. The inspector came to my

home, asked me questions, walked around all four sides of my home noting roof

problems that he pointed out as an experienced inspector. MY ROOF FAILED INSPECTION ON MULTIPLE

ACCOUNTS INCLUDING THE LEAK as just one of the problems. (Copy attached) This is

further proof that World Class’ installation of the roof on my home is incorrect

and defective.

I

will be more than willing to provide any and all additional documents, photos

and correspondence necessary to support and prove my claims.
