This is being sent in response to Compliant ID # [redacted] ? Concerning one [redacted] 4xATV .I have spoken to the associate who had assisted Mr [redacted] the day he had come to California to retrieve his ATVThis associate is also the one he had spoken to over the phone the day he had called Mr [redacted] had been given a breakdown of fees being charged during this phone conversationHe had said he could not come and pick up the ATV until that upcoming weekend ( February 20th -22nd ) There was no other contact with Mr [redacted] until the 23rd of March when he showed up to retrieve the ATVAt this time the associate helping him had the right to not discuss any information concerning the ATV because he was not the legal owner according to the DMV records fileHe had not transferred the ATV into his name once he bought it then it was stolen from him Our associate went out of her way to find an acceptable solution to release the ATV due to his driving hoursThe total due for the towing and storage at that time was yes the This being the Rotation Tow requested by the CHP/ days of storage / and the lien fee We charge the same rate for any vehicle be it stolen/accident/or impounded We do not salvage the titles we are only towing service not salvage yardWe do as the California Civil Code section ccand Vehicle Code section vcinstruct us to do for our lien paperworkThis is the law for any /all towing companiesSo to sum everything up We stand by the actions of our associate whom did her job according to our policy and proceduresShe acted in a friendly manner and again went over and above to try and help due to his failure to complete the required paperwork after his purchase We are not crooks we are just a small company trying to run a professional yet understanding business We are sorry that Mr [redacted] had his ATV stolen but we are a business and to keep our doors open we cannot just do our job for free So with this being said and the ATV still being in our possession it will become a lien sale on the date the registered owner was notified ofThis is our legal right after we completed the paperwork with the DMV/ sent out the mailings of our intent / and waited the appropriate amount of daysWe will consider the amount we receive during the sale payment in full for the towing and storage.We hope this will show we are not crooks and are just doing what we are allowed to do in accordance to the governing lawWe do apologize to Mr [redacted] if he felt our associate was of no helpAnd that this may help to clarify the associates actions to the situation that had occurred.Thank You

The total due for the towing and storage at that time was yes the 2136.00. This being the Rotation Tow requested by the CHP/ 32 days of storage / and the lien fee.  We charge the same rate for any vehicle be it  stolen/accident/or impounded.  We do not salvage the titles we are only towing service not salvage yard. We do as the California Civil Code section cc3068 and Vehicle Code section vc22851 instruct us to do for our lien paperwork. This is the law for any /all towing companies. Review: I had three ATVs stolen about two years ago. Someone just hooked up to my trailer and drove off with all of them one night while it was parked across the street in front of my house in Provo Utah. About three weeks ago I got a call from the local police saying that The California Highway Patrol had found one of my ATVs and that it was at WS Towing in Modesto California. I couldn't leave right away but instead planned a trip three weeks later to go get it. I called WS towing and told them them when I would be coming. When it was time, I borrowed a trailer from a family member and drove 12 hours to California. When I got there WS Towing told me that they needed $2.136.00 in towing and storage fees in order for me to take it home with me!!! (it's an old machine and worth maybe $500.)I couldn't believe it! I told them, "So you're telling me that even though someone stole it from me in the first place that I can't just come get it? That I have to pay to get it back?! It's like you're stealing it again from me! I just drove 12 hours! Why didn't you tell me that when I contacted you before I left? You guys are a bunch of crooks! Can I make you a deal?" They said, "The owner doesn't make deals..." and would not let me contact him. So I called the police (CHP) and ask them what I could do. They said that unless I wanted to pay the fees there was nothing that I could do. So, I handed them the title and said, "Here! Take the title! Keep the machine!" They told me that they didn't need the title. So I took it back and then I drove home with an empty trailer. There should be laws against this kind of thing! What a bunch of crooks!Desired Settlement: I'm not sure what can be done, but I would like my ATV back without a charge. I'm sure that they will just salvage the title and then try and sell it to someone else and get what they can out of it. Can they really just take things that are stolen, store them for a length of time until the storage fees are worth more than the vehicle, and sell them to other people? It doesn't seem fair.
