WTPI installed a lesser and cheaper furnace than contractually agreed (twicefirst a 92% efficient rather than 95% and then 60K BTU instead of 80K!)The written contract which I agreed to with WTPI specifies Gibson model [redacted]. As attested in several emails, the WTPI owner [redacted] to install a 95% efficient unit with 80,000 BTUs, to meet the MASSsave requirements and because I live in a cold lake house, with plans also to eventually install heating outlets upstairs. (I also specifically needed a quiet unit because of a sensitive ear, and that was the one we chose for the contract.) I then paid half the price to Mr. [redacted]$2514.07 by credit card. When I came to check the work the first time, I found that his company had installed only a 92% efficient unit, completely different from what we agreed. Mr. [redacted] said it was a mistake by his helpers. He then said he ordered the correctcontractually agreed onunit. I trusted him, unfortunately. He and his helpers came to install the replacement furnace on Tuesday, Sept. 9th while I was away working, and then on Wednesday without my authorization charged my credit card for the second half of $2514, before I could even look at the unit and see whether it was in accordance with the contract. On Friday (Sept. 12th) when I was back at the house, I called him to arrange to meet with him and pay him the balance (not knowing he had already used my charge card numbers without my knowledge). I then found out he charged me and that he had in fact installed a different unit than agreed, one with only 60,000 BTUs (the furnace he actually installed has the model # [redacted]). I never authorized anyone to approve the work on behalf (Mr. [redacted] says he spoke to the guy who mows my lawn who was in the house then, but of course, he did not approve the job and was in no position to do so. I can submit that helper's testimony, if needed.) I need the correct unit to be installed for many reasons, apart from its being contractually mandatedfor my heat loan, as authorized by MassSave, to be warm enough here in the house, and for the future planned expansion of the system to the upper floor (which Mr. [redacted] knew about) and possibly the basement. In any case, I was not consulted about the change in models and did not approve it either time. (I was always available by cell phone throughout this period, but was never once called by Mr. [redacted].) Mr. [redacted] said he was "strapped" for money. This is no excuse to deliver cheaper goods or to charge my card without my having seen the work. Further, when I requested earlier today that he install the correct unit as contractually agreed, Mr. [redacted] hung up the phone on me. I will also need his signature on the furnace replacement form to get my $1000 rebate from MassSave. And I will need proper service on the correct unit and on the installation for the warranty period. Mr. [redacted] refuses to answer phone calls and refuses to install the contractually agreed unit.Desired SettlementI need the correct unit installed asap. I have to get it in place soon to be eligible to collect my $1000 rebate from MassSave, and in order to be warm enough in my drafty lake house with the cold weather coming shortly. The present unit is inadequate and is not what was required contractually. After the work is done, I need Mr. [redacted] to fill out the form for the rebate, and I need good responsive service, if required, during the entire warranty period. The unit that I need is specified contractually and is available from Gibson. It is [redacted]Business Response I, Mr. [redacted], am responding to a dispute filed by [redacted] regarding changing out a heating system to meet the contract that consumer has signed. Heating system has been changed to meet the consumer's expectations. I am also meeting with the consumer on Saturday, September 27th to sign rebate paper work and to make any adjustments that need to be made.
