federal and state statutes as well as the contract terms.  In the present case Mr. [redacted] returned a settlement release form which was forwarded to the movers for processing and payment. The release form contained the following disclaimer in close proximity to Mr. [redacted] notarized signature: “Anthem Claim Management does not issue checks.” Mr. [redacted] was advised that he should contact his moving company to inquire about the status of payment.  Rather than doing the reasonable thing and contact the movers, Mr. [redacted] though it best to send threatening emails and submit a complaint to the Revdex.com.   We have spoke with the moving company who confirmed that payment was being processed and will be mailed out soon. Mr. [redacted] should follow up with them if he has any questions. Thank you.

the mover’s Bill of Lading contains the following with regards to Filing of Claims: “Carrier shall not be liable for the loss or damage of the good unless claim is made in writing supported by proof of ownership, value and weight. As a condition precedent, all outstanding monies due to the carrier must be paid in full before any claim can be made. Claims must be filed within 9 months of delivery or demand thereof is refused and must be limited to the destination descriptions of damages for each item on the inventory logs. All damages and missing items must be noted on the inventory logs. Damage indications must specify each item damaged at the time of delivery.”   The Household Goods Descriptive Inventory contains the following in close proximity to Mr. D[redacted] signature: “WARNING ->Before signing check shipment, count items and describe damage or loss on the right above.”   Based upon Mr. D[redacted] pictures ACM recommended coverage, despite the lack of damage notations on the inventory. Mr. D[redacted] was provided with two coverage options. One was free but limited carrier liability. The second option provided more coverage and was available for an additional fee. In the present case Mr. D[redacted] opted for the limited liability coverage which limited liability to $0.60 per pound for eligible items.    ACM’s work was consistent with the contract terms and applicable law. We offer the following response: I have attached some of the Descriptive Inventory pages, apparently signed by Mr. D[redacted] at the time of delivery. The Revdex.com software would not allow me to attach additional pageshowever they are all signed as well.Since Anthem Claim Management was not present during the move or part of that process, we are unable to address whether or not Mr. D[redacted] was provided with copies of the paperwork.  When we learned through the Revdex.com process that Mr. Da[redacted] did not have the moving documents we emailed copies to him.I have also attached the Relocation Estimate electronically signed by Mr. D[redacted], which contained information on the coverage options available for the move. We are sorry that Mr. Da[redacted] is not satisfied with the amount of compensation he is entitled to however our coverage recommendation was consistent with the contract terms and applicable law.

Thank you for forwarding this consumer’s rejection. We offer the following rebuttal: Ms. B[redacted] moving company is compliant with DOT requirements including adequate insurance coverage. Ms. B[redacted] was covered by Full Valuation Protection, which is not insurance or an insurance product. In most cases, valuation claims are paid directly by the moving company, however the moving company may, at its discretion, involve their insurance carrier. Regardless, the coverage terms and conditions are still applicable. The moving company has an established claim process which utilizes our services. Anthem handled Ms, B[redacted] claim as part of the claim process.   Ms. B[redacted] claim was reviewed by a qualified analyst. Anthem Claim Management emailed an acknowledgement letter, which included a request for additional information, the same day Ms. B[redacted] claim was received.  Ms. B[redacted] replied to that email the next day, with the information requested.    Anthem has a published toll free number and staff available weekdays from 7AM – 4:30 PM, MST. The automated phone attendant provides an option to speak with a live agent during business hours. Ms. Briscoe had every opportunity to call and speak with someone about their claim.   Contrary to her statement, Ms. B[redacted] did agree to accept a settlement offer made by the moving company. I am including a copy of the email, wherein Ms. B[redacted] agreed to accept the moving company’s offer to settle.   We strongly reject Ms. B[redacted] claim that she was in anyway wronged by Anthem Claim Management. The information provided by Ms. B[redacted] along with documentation obtained from the moving company was sufficient for our review. Our recommendations are consistent with the contract terms, the carrier’s tariff and applicable federal law. Ms. [redacted] has the right to pursue this in arbitration if she feels that our review is lacking, however we are confident in our ability to support our recommendations in any venue. Thank you.

The missing items were part of the damaged tv stand, and for claims purposes are considered to be the same item. The dresser was not noted as damaged during delivery and the pictures submitted in support of the claim were grainy making it impossible to evaluate the damage. Ms. S[redacted]'s claim was accepted for the damaged tv stand. If Ms. S[redacted] is still not satisfied, federal law allows intestate moving customers the opportunity to have their claim reviewed in arbitration.  Ms. S[redacted] claim adjustment is consistent with the contract terms and applicable federal law. I recently went to a Wyndham Resort Seminar in your Wyndham hotel located in [redacted]. I had a very demeaning experience with your sign in personnel. After three phone calls from your sales personnel located in [redacted] speaking to Supervisor Christine K[redacted](sp) and her worker who was my first contact I was supposedly all clear and vetted to attend the seminar in [redacted]. At the sign in procedure the man had a microphone in his mouth and was very hard to understand and asked I asked him me repeatedly what he was asking because I could not understand him. I kept asking him why and what was wrong with my application but he would never say why. He then said I was rejected and could not attend the session. I could not believe it and was so unfortunate because I really have been interested in a time share ( I own my own house- no mortgage and make over $60K a year so I was told I qualify) and was excited about this opportunity not to mention the promise of a dinner gift card and 4 airline tickets. It cost me &15.00 for the [redacted] Bridge toll and $7.50 for parking and the gas to get to this seminar. I am so disgusted with your company that I would never stay at any of your hotels. If your were a reputable company should be at least compensated for my expenses!

Management is not an insurance company and Full Valuation coverage is not an insurance product.  Ms. B[redacted] claim was reviewed by a qualified analyst, certified by the American Moving & Storage Association. The coverage recommendation was consistent with the contract terms, the carrier’s tariff and applicable federal law. Some of the items claimed by Ms. B[redacted] failed to meet the requirements established in the carrier’s Full Value Protection, Terms & Conditions, of copy of which Ms. B[redacted] should have at her disposal. Anthem’s review found the eligible amount did not exceed the claim deductible and no compensation was due.  Ms. B[redacted] had ample opportunity to speak with a representative from Anthem. We have a published toll free number which was also included on the claim acknowledgment notice, emailed to Ms. B[redacted] on July 7. We have staff available to answer phone calls weekdays from 7AM – 4:30 PM, MST.    Ms. B[redacted] contacted the carrier who, in an effort to achieve an amicable resolution, offered Ms. B[redacted] a not insignificant goodwill settlement, which Ms. B[redacted] accepted in an email dated August 18.  As the agreement included compensation Ms. B[redacted] was not contractually or legally entitled to, the carrier’s tariff required that Ms. B[redacted] sign a release agreement and waive her rights to pursue this further in other venues. Thank you.

Thank you for forwarding this consumer’s rejection to our attention.  Anthem Claim Management offers the following documents in support of our position: A copy of the email Anthem Claim Management sent to the moving company on April 21 with Mr. Williams’ signed settlement release attached.  A copy of the email Anthem Claim Management sent to the moving company on June 19th.  Contrary to Mr. Will[redacted] statement, the evidence shows Anthem Claim Management processed Mr. Williams claim and forwarded all documentation to the moving company in a timely manner.
