Tell us why here...To whom it may concern:Contrary to *** ***'s statements, Your Weigh has not received any unsealed and unused supplements and/or the manuals he was providedOur system of receiving packages at our Melville office is very controlled and everything including *** *** ***, etconly goes through the front deskWe have no record of receiving any package from *** ***.In addition, *** *** claims he sent the package via *** and he indicates that they (***) said they delivered the package. He also claims that he has proof of that delivery and has forwarded that to us. We have not received the proof of delivery from *** *** either. If what *** *** says is true then he must have sent the package "Proof of delivery with a return receipt", which is the only means of shipping that would provide proof of delivery with the ***. If this is the case then we would like to see the *** documentation of said delivery, which is a little green card. One last note, *** *** indicated that he contacted the *** and they told him that the package was delivered. Even if he used return receipt with proof of delivery, the *** would not give him confirmation of said delivery over the phone. The shipper is provided the documentation via the mail post delivery and it is the shipper that has the documentation/proof of delivery not *** As indicated, if Your Weigh receives the requested documentation, we will be happy to reimburse *** ***

I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
No one at Health Savers, LLC has yet to reach out to me directly as they claim they have "continually" done to help me continue I would be more than happy to accept a prorated refund of the $less $for the weeks I was on the program before asking for a refund; that would provide me with a refund of $1, At the time I signed up, the lady Kayenne, who I worked with, NEVER provided the option of 'opting' out once she had my money and had gone through everything with me, and I expressed my concerns to her about the food options and the fact that I was never informed until that moment I was also expected to go out and purchase brand new "approved" personal hygiene items If I had been given the option of not continuing with the siprocess and been able to take back my $1,that day, I would have I have all email responses I received from the business and many of their responses were vague and not helpful I followed the program exactly for four full weeks in total, and during two of those weeks I did not lose pound I told the nutritionist I would have liked to set up a diet plan to complement my crossfit workouts, so I was very specific with what I needed, but she did not provide a diet plan or even help me determine what macros I should consume Ultimately, I was not provided the services they claim to offer, which is why I no longer wish to work with them as I have already tried and did not receive truly individualized, and guided, assistance

This complaint was originally filed on May ***, 2017, after the conflict originated on April *** No one at Health Savers LLChas contacted me directly since then in an attempt to resolve this issue Therefore they cannot in good faith say that I have been utilizing, or even been offered to continue with their services since April *** 2017, when I initially contacted them requesting a refund They can also not claim they should be able to retain their fee in full since they have made no attempts to 'assist me on my health journey' since that date as well, and their response to my complaint was not filed until October ***, 2017, over five months later MsO*** also reported statements supposedly made by me regarding not being willing to give up "beer, pretzels and nachos", and I am quite incensed at her audacity They essentially put their clients on a day fast, which is highly unrecommended in the medical community and I was told to discontinue the program by two MD's I sought consult withHealth Savers LLC does not provide clients with the full scope of the program until after they have received payment, and therefore I was unable to make a fully educated decision regarding this program Once I saw what the program entailed, I knew immediately it was not for me, but they already had my payment and I did not have the option of changing my mind I stand by my claim that I was hooked by their company through very misleading advertising, and a very strong sales pitch in which their staff did a very good job of convincing me to do something that I did not actually want to I also stand by my claim that they do not provide the individual diet plans they advertise due to their neglect to assist me in planning my meals based on my daily routine (which I requested multiple times), nor do they support their diet plans well, as when I contacted them seeking assistance at times I did not get a response I do not feel their services provided to me warrant them charging me in full for the program due to their neglect

In response to the above complaint, Your Weigh categorically denies that the Your Weigh weight loss and wellness plan is a scam. The program was developed by physicians, nutritionists, naturopathic doctors and other healthcare professionalsYour Weigh has had thousands of
people successfully complete the program with a percentage of our clients being doctors and nurses who have recommended the Your Weigh program to numerous friends and family members. In fact, over 20% of Your Weigh clients are referralsIn addition, Your Weigh has a 98% success rate with people who follow the program. The information in the complaint is also erroneous, inaccurate as well as assumptive since the individual didn't proceed with the program (therefore how could the individual decide the program is a scam)The complaint implies that the cost for the program is $2,but in actuality the cost was for the individual and his significant other (two people). The program is for one year and includes the initial consultation, body analysis, complete review of the plan, initial supplement regimen, blood work analysis that includes additional specific supplements based on the blood work, weigh ins and progress review every weeks at one of Your Weigh locations, program manuals, 24/healthcare professional support and coordination with client's physician if necessary. In addition, the individual did not call the Your Weigh office within business daysDuring the initial phone conversation, the individual was provided a complete outline of how Your Weigh would proceed with his situation....no run aroundThe back and forth was only due to the individual's unwillingness to accept Your Weigh's solution to the situation, which was more than fair and in accordance with the paperwork/agreement the individual signed initiallyYour Weigh has helped thousands of people reduce their weight and improve their overall healthWe stand by our product and our staff

As indicated in our initial response, the information provided by [redacted] is incorrect. As an example, the client signed up on July [redacted] not July [redacted].  Proof of the start date is the credit card receipt, which we will be happy to post. In addition, the charge for our one year program equates to $1,222.50 per individual not the amount that [redacted] claims.  This too can be confirmed by the paperwork that he signed and the credit card receipt. We could go on and on disproving [redacted]'s claims.  Bottom line, Your Weigh has been in business for years, guided thousands of clients through the program successfully, almost 25% of our new clients come from prior client referrals and this complaint is the first Revdex.com complaint that we have had to respond to since the company started doing business. We believe the facts speak for themselves. In addition, [redacted], by his own admission, started the program, never came in for his first appointment and obviously decided he could do the weight loss plan on his own with the information he received. He is still in possession of our proprietary books outlining the weight loss plan and meal plans along with the supplements he was provided. Your Weigh stands by our product, our agreements and we have done everything we can for [redacted] based on his actions. We wish [redacted] all the best.

October *, 2017To whom it may concern:Regarding [redacted]’s complaint, Your Weigh refutes the entire complaint based on the following information.[redacted] indicated that he canceled the plan 3 business days after signing up.  In fact, our policy is to fully refund a client if they...

cancel within 3 business days of signing up with Your Weigh and return all supplements (unopened) along with the weight loss manuals. However in [redacted]’s case, [redacted] signed up on September **, 2016 (based on his [redacted] receipt, which is on file) and as of today, we have not received the supplements or the manuals.  The Your Weigh office called [redacted] on 10/**, 10/** (left message), 10/** and 10/** to facilitate the return of the Your Weigh supplements and materials.  On the 10/** call, our office manager spoke to an individual who claimed they weren’t [redacted].  Our office manager then asked if he knew of [redacted] and the response was “no”.  The office manager then dialed the number again, assuming she dialed a wrong number, but ended up speaking with the same individual that wasn’t [redacted] and had no recollection of an [redacted].  Your Weigh has made reasonable attempts to contact [redacted] regarding the return of said merchandise with no success. [redacted] claims he sent the supplements and the manuals back to our office but we have not received anything.  Our policy when receiving returned merchandise is to save the envelope, label, etc. as proof of the return, which also indicates the date of the return..  Once again, our office has no record of ever receiving the merchandise [redacted] claims he returned.  Since by contract a reimbursement is predicated on the return of said merchandise and materials, which we have not received, we have not reimbursed the Your Weigh fees.  Your Weigh has adhered to all obligations outlined in our company/client agreement.Sincerely,Ashley O[redacted]Office ManagerEmail: [redacted]Office  Phone: ###-###-####

October *, 2017To whom it may concern:In response to the complaint filed by [redacted] Your Weigh provided all services and support necessary for [redacted] to be successful on the program.  In fact [redacted] was initially successful based on the plan, which included personal modifications...

supplied to [redacted] by our healthcare professionals and our nutritionist. After being on the program and having some difficulty losing additional weight, [redacted] admitted, in our office, that she didn’t want to give up beer, pretzels and nachos during the weight loss portion of the plan.  Obviously beer, pretzels and nachos are not included in the Your Weigh eating guide especially during the weight loss portion of the plan. This unfortunately is a simple case of [redacted] not willing to give up the unhealthy foods that caused her weight gain in the first place. The following outlines the key events that took place during [redacted]’s time with Your Weigh and dispels the claims [redacted] made in her complaint.[redacted] had her initial consult, in our office, with a Your Weigh healthcare professional on February *, 2017.  At that time she received; a body analysis, review of her current health status as it relates to being overweight, a thorough review of the plan and what [redacted] would be expected to do short term, mid term and long term while on the plan. (NOTE: the plan is a 1 year program).  [redacted] then left the office and returned on February [redacted] to start the program.  At this second meeting, [redacted] was once again provided with an overview of the program and specifically the diet during the weight loss portion of the plan.  The Your Weigh Healthcare professional also reviewed the manuals that we provided to [redacted], which included what she would be consuming during the weight loss portion of the plan. At this point in time [redacted] was well aware of what comprised the Your Weigh weight loss and health plan. In addition, on March [redacted], Your Weigh processed [redacted]’s blood work and subsequently sent [redacted] additional supplements specifically for her based on the analysis of her blood. On March [redacted] had her first official weigh-in ([redacted] visit to our offices) and at that visit [redacted] had lost 8 lbs. in 8 days.  All metrics that Your Weigh tracks with each and every client had improved in [redacted]’s case including but limited to; overall weight loss, body fat, visceral fat, body water and BMI.  [redacted], as most clients, required some guidance and customization of the plan to circumvent some issues she was having with the diet. On various occasions [redacted] emailed and called our professionals to deal with the issues she was having on the diet. Our staff gave [redacted] options and workarounds to help her, which is our standard practice.  At [redacted]’s next office visit she did not show any improvement based on all metrics, which was expected once [redacted] admitted that she had not given up the foods that we had told her were not on the plan and would definitely impede her meeting her goals.  At this stage we moved [redacted] into Phase III of the plan, which was less restrictive in terms of food options.  [redacted] still didn’t want to give up beer, pretzels, nachos and who really knows what else.  At this point in time Your Weigh had done everything we were obligated to do by contract, and more, to help [redacted] meet her weigh loss and health goals.  [redacted] was unsuccessful due her blatant disregard in following even the less restrictive diet that Your Weigh provided her.  As per our agreement, [redacted]’s plan is still in effect and she can restart the program at anytime through March, 2018.  Going forward we will be happy to modify the plan for [redacted] but we cannot be held responsible for her, or anyone else’s, lack of success when she completely disregards the plans and advice of Your Weigh’s healthcare professionals. We hope to see [redacted] back with a renewed interest in losing weight and improving her health.Sincerely,Ashley O[redacted]Office Manager

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[Your Answer Here]
First and foremost I signed up on July [redacted] (wednesday) and called to cancel on july [redacted] (monday) the third business day before midnight. For them to call my claim "erroneous" is only because they refused to cancel my package that day and every day forward. And the "resolution" that I refused to take was that nothing changes with no refund and I continue with the plan. Clearly this is not a resolution. This company IS a scam because it is 1995 per person so my nunbers were accurate. I of course paid more due to having two people. While what you get I  return is $70 worth of non proprietary supplements with a ketosis diet that is common knowledge online. And "guidance". But of course the company keeps that gem a secret until you've already paid. My complaint isn't that the plan didnt work, my complaint is that there's no possible way a company should be charging 2000 for a Google search. I did try said program for the first few days I had the packet but again, it all doesn't matter. I canceled this package within 3 business days and this company not only denies that obligation but is claiming that I didn't even call! SCAM

Re: Case # [redacted] – [redacted] 2nd response   To whom it may concern: Your Weigh has continually offered [redacted] the ability to proceed with the program and that offer still stands today.  The issue is that [redacted] will only discuss a full refund, which as we pointed out is not possible due to the amount of time that has passed, her success on the program and ultimately her failure to lose additional weight due to her not following the plan or the Your Weigh healthcare professionals’ guidance.   Your Weigh's statement regarding [redacted]’s inability, or unwillingness, to give up beer, pretzels and nachos is 100% accurate.  [redacted] had a meeting with Peter Faulisi at our Melville office and discussed her situation. In that meeting with Peter, [redacted] admitted that she did not give up beer, pretzels and nachos.  Your Weigh cannot be held responsible in anyway when someone completely ignores the plan and/or guidance from a Your Weigh professional. To prove the point even further, initially [redacted] lost 8 pounds in 8 days but was frustrated. She reached out to us and we assured her that amount of loss was above average for a woman at that point in the program (a pound of loss per day). Had [redacted] followed the plan as it is written, her loss could have continued, but she neglected to do so. Our clients have full access to all of our professionals via phone, email or text.  Clients are also seen for follow up visits every 10-14 days (and more often if necessary). Your Weigh worked with [redacted] to resolve her issues via email and phone calls as well as with follow up visits. Based on subsequent meetings and conversations, [redacted] was doing better losing another 1.6 lbs.  With each follow up, [redacted] admitted to not following the plan as it was outlined. [redacted]’s issues began when she stopped losing weight, which was obviously due to her eating habits that were completely counter productive to losing additional weight and creating a healthy lifestyle. The Your Weigh plan is completely safe, was developed by a doctor and is not a “fast”. We have worked with many doctors coordinating the Your Weigh plan with specific client’s health issues and not one doctor ever indicated that the Your Weigh plan was unhealthy.  None of our Your Weigh doctors, nurses, nutritionists or healthcare professionals ever spoke to any of [redacted]’s doctors, so they do not have accurate information to base their evaluation on. If [redacted] would like to continue the plan, we would be happy to coordinate her plan with any or all of her doctors. As a point of information, Your Weigh has and continues to modify Phase II (weigh loss portion of the plan) based on each client’s particular situation. However, Your Weigh cannot and will not modify the plan to the extent that [redacted] would have liked since failure would be the only outcome….as [redacted] found out. [redacted] claims that after receiving the details of the plan, she knew that it was not for her.  If that were the case, [redacted] could have opted out right then and there and she would have received a full refund. She was not “hooked” into anything but decided to go forward with the plan and was successful, as we have indicated.  All of [redacted]’s claims about neglect or lack of support are completely unfounded as our primary directive is to support the client in anyway possible.  We offered support and modifications to the program to try to help her through but [redacted] did not follow through with any of the suggestions our staff offered. To emphasize that point, we have a 98% success rate, have helped thousands of clients meet their weight loss and lifestyle goals. Finally, ¼ of our new clients come to Your Weigh via client referrals, which indicates the high level of customer satisfaction. As we indicated before, [redacted] is welcome to restart the program and we will modify the plan to it’s fullest extent possible to help her meet her goals.    Sincerely, Ashley O[redacted] Office Manager   [redacted]
