Client paid negotiated balance and receive final lien waiver The job is closed out in my system

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: [Your Answer Here] This business is being dishonest and inaccurate about what they have stated on their response and about their scope of workThey were not present during the most crucial times of the gut renovation, which caused a ripple effect of problems in our construction project.1)Their own employees opened the windows screens packaging before the installation of the windows were completedThe contractor and myself told them not to open the screens packaging but instead they didn't listen and proceeded to scatter the screens through out an active construction site Of course there will be damages to the screens, that is not our fault, as we instructed them to keep the screens in their boxes There is plenty of email evidence & correspondence to prove this IF I could attach more files, I would.2) A [redacted] Windows was supposed to come back and fix the inoperable windows long before they actually came to our home Because they took forever (months and months to address the window issues), we couldn't halt our renovation for them any longer, so we had to go ahead and move forward with our cabinetry work We lost money waiting around for them, so we had to move forward and complete our renovation because they wouldn't show up or get back to us.The "wall" they claim we placed in front or near one of the window is information The bedroom where these two inoperable windows are in, is a small bedroom We had to build a built in closet and bunkbeds for our kids to retain space in their bedroom Unfortunately, because they never came to fix the window issues in time, this became a problem because in order to fix the windows, they would have to tilt them, which they could no longer do once our cabinetry was completeThe locking system doesn't operate which is a separate issue.Again, there's plenty of email correspondence that shows our frustration and the loss of time, and the lack of prompt responses on issues that were time sensitive.3)As for the lies about the GC, how dare they make up stories when they weren't fully involved in our gut renovation!! They stated that multiple GC/contractors walked off the job???!!! That is a statement and total lie The first contractor was never our GC! He was just one of the contractors that we fired for good reasonsEven though I don't need to explain this I will to set the record straight : I fired our first contractor because he stole money from us and used inappropriate language & behavior towards me, which is a totally separate situation (this industry is awful with female homeowners, and a completely sexist industry) How dare A [redacted] make such accusations if they were not fully involved!The new contractor we hired and all other sub contractors that worked on our property, have all remained to be the same from day one and we have a great relationship with ALL OF THEM!TO BE QUITE FRANK, THE SITUATION WITH OUR FIRST CONTRACTOR IS NONE OF THEIR BUSINESS AND THEY SHOULD FOCUS ON THEIR CONTRACT WITH US, RATHER THAN STEER AWAY FROM THE PROBLEM By the way, two architects, a structural engineer, inspector and our 2nd contractor all stated that A [redacted] windows' work was not done properly from the beginning They were not attentive because they were Missing in action most of the time They didn't have a project manager handling our job properly and would only show up when it was convenient for their schedule They barely prioritized our immediate concerns, which delayed our construction!!!THEY WERE HIRED BY US, THE HOMEOWNERS, NOT THE CONTRACTORTHEY SHOULD FOCUS ON MAKING THEIR CLIENTS HAPPY BY INSTALLING WINDOWS THAT OPERATE PROPERLYEND OF STORY.AS OUR ARCHITECT EXPLAINED TO US, THE WINDOWS ARE SELF CONTAINED WINDOWS, SO EVEN IF OUR BUILDING HAD STRUCTURAL ISSUES (WHICH A STRUCTURAL ENGINEER CONFIRMED IT DOESN'T), IT HAS NOTHING TO DO WITH THE FUNCTIONALITY OF THE WINDOWS EVEN IF THE WINDOW OPENINGS WERE OUT OF PLUM OR SQUARE, THE WINDOWS SHOULD STILL OPERATE EVEN IF I TAKE THEM OUT OF THE OPENING AND HAVE THEM FREESTANDING IN THE LIVING ROOM, THEY SHOULD OPERATE!!! WE WOULD HAVE BEEN HAPPY TO PAY THE FULL BALANCE IF THEY WOULD HAVE SOLVED THE ISSUES WITH OUR WINDOWS AND SLIDING DOOR ! EVEN MARVIN, THE MANUFACTURER OF THE WINDOWS CAME TO OUR HOME AND CONFIRMED THAT THEIR INSTALLATION WAS DONE THE WRONG WAY & THEREFORE THE WINDOWS ARE NOT FUNCTIONING AS THEY SHOULD.WE HAVE TWO LICENSED ARCHITECTS THAT HAVE WORKED ON THIS PROJECT FROM THE BEGINNING AND CAN VERIFY ALL THIS INFORMATION ONE OF OUR ARCHITECTS SHOWED US LINKS ON HOW OUR WINDOWS ARE SUPPOSED TO OPERATE, AND CURRENTLY, OUR WINDOWS DON'T EVEN DO HALF OF WHAT THEY ARE SUPPOSED TO DO AS EXAMPLE OF HOW OUR WINDOWS SHOULD WORK, PLEASE SEE THIS LINK: [redacted] AT THIS LATE STAGE, SINCE THEY ARE NOT BEING COOPERATIVE WITH THE DISCOUNT WE REQUESTED (50% OFF OUR BALANCE), AND ARE STILL PUTTING US THROUGH THIS BY THREATENING US WITH A LIEN NOW, WE WILL ONLY ACCEPT 50% OFF THE CURRENT BALANCE, AND THAT IS A VERY GRACIOUS PROPOSITION.AS AN AUTHORIZED INSTALLER, THEY ARE SELLING US A PRODUCT THAT SIMPLY DOESN'T WORK PROPERLYBest, GiadaBelow are additional notes about the present matter at handAbout a week ago, they had offered us a 10% discount which is insulting based on all the time we wasted with their disorganization (years) and the fact that they are leaving us with windows that don't operate smoothly, INDEFINITELYTheir disorganization, lack of communication & physical presence from their project managers have caused these issues to spiral out of our control Sending random & different installers (especially during the first year), whom have no idea what's going on with the project, is NOT the way to work with clients Of course both parties are going to waste their own time & money! The way they operate their own business is not our responsibility!!! The current balance is 8k and I had asked for at least 50% off of our remaining balance, which my husband and myself found fair, given we will have to live with inoperable windows indefinitely Our defected windows (which are half of our windows and one sliding door locking system) will also affect the resale value of our property, as they don’t open smoothly (unless with force or if two people open it together) and the hardware doesn’t work either for both our windows and sliding doorWe cannot afford to hire a new company and fix the existing installation or buy new windows, so we are stuck in a bad situation and need the Revdex.com to make it better & help us come to a resolution with A [redacted] WindowsThere’s been some back and forth with emails between us and the company that are negative.They are very unorganized, so it’s very hard to work with their unpredictable scheduleThey are driving us mad with their unprofessionalism and the way they operateI had requested a meeting with one of their project managers about a week and a half ago, to come to an agreement, but last minute, they changed that plan and had one of their installers meet with us instead This wasn’t proactive at this fragile stage, because their installer is not a manager who can make valid decisions on the matter at hand or come to a conclusive deal.They should have just rescheduled the walkthrough with a manager if they couldn’t make itStill to this date, none of their managers or owners have even seen the problem with our windows and sliding door in person at this final stage or done a final walkthrough with usWe even sent them a video of their installer trying to operate a window & have provided them with detailed voice notes for each window because their project manager was missingHow are they supposed to understand us and our request for a discount if a manager or owner doesn’t come to as the problems in person??? As of today, there remains open items at the client’s residence. The first is a patio door screen which is on order, and a window that is malfunctioning in a bedroom. The client has built a wall in front of the opening disallowing us to service the window. It is our belief based
on other service calls to the property after the client had the windows cleaned that whomever cleaned the window during construction, dislodged the sash from the shoe. The clients GC then built a wall that does not allow the window to tilt in. Both A*** and the manufacturer have visited the window, and both have informed the client that it cannot be serviced based on the wall obstruction. The windows was in working order after installation. Please find below a summary of the project, timeline, and accommodation A*** Windows has made to date to appease the clientA*** Windows was engaged to pull a NYC landmark permit and install (14) windows and doorsProject Timeline: - Project Created: 8-**-- LPC Application and drawings submitted: 9-**-- LPC Permit received 1-**-- A*** Windows mobilizes to install a portion of the windows: 2-** and 2-**-16. The client and clients GC had not prepared all the openings. In a means to accommodate the client, we mobilized to install a portion of the work- At clients request, we remobilized to complete portions of clients work on 4-*-and 6-**-- At A***’s cost, we warehoused a door for the client until 9-**-16. At this time the client was ready for the door. Over the course of this project, the clients GC damaged and threw out screens and hardware which we repurchased at no cost to client. We mobilized multiple times at no additional cost, and also stored materials at no additional cost. The clients residence had major structural issues and the building was quite out of square. We worked closely with client to re-trim windows to minimize visual impact to client satisfaction. We have continued to spend time, money and energy to ensure the client is happy. To my knowledge, multiple GCs have walked off or been terminated from the project. And while this may not be a fair representation of the client and her dealings with trade contractors, A*** feels we have gone above a beyond to appease the client. As of today, the client has only paid roughly 85% of the contract and the only remaining item is a screen. We are prepaid to complete the punhclist and continue to warranty and service the client

The customer in question had marked up our standard form of Contract, including the removal of pertinent exemptions that voided the contractThe contract was emailed to our offices on 7-*-We received the customers deposit on 6-**-16, ahead of the signed contractUpon review of the project by
management it was determined that we would not counter-sign the contractThe client removed the exemption of a sidewalk bridge, which was determined would be required on the project to protect the publicWe would be removing and installing windows above a busy sidewalkI personally called the client to inform him of the situation on 7-**-16, explaining why we would not countersign the contractThe refund check was cut and ***'d to the clients offices on 8-*-It was delivered and signed for on 8-*-at 2pm

I am currently in Morocco for work with very limited WiFi.I just got connected to WiFi and saw a response from A*** windows, through the Revdex.com site, which stated they accepted my terms of the 50% off the balance (4K).Unfortunately, on their message they gave us a deadline to pay by the end of this weekSince I had no WiFi and traveling internationally there was no way I could make their desired request and payment deadline.They had plenty of time to respond to Revdex.com, but were taking too long and now they are giving me no time to pay the agreed terms of 50% off? Can you please help communicate that we will pay next week IF they give us a lien waiver?They will have to give us a lien waiver if they agree to our terms so we can protect our property from their previous threat of putting a lien on our property.Please ask them to give us a lien waiver ASAP and we will pay the 4K ASAP via credit cardIf they do this we can pay as soon as this coming Monday, or when I return 10/**. My husband *** CCD, can do a cc payment before I come back as long as we have the lien waiver and it’s a proper document.Thank you for all your help and cooperation!
