Thank you for the opportunity to respond
to the complaint submitted by this customer.
Mr. [redacted], owner of [redacted],
purchased a MaxAudience “Foundation” package for local search engine placement
and internet marketing on November 28, 2012. Mr.
[redacted] paid $249.00 by credit card for this service.
The payment is a one time fee that covers placement on a variety of
local internet search engines and internet search directories. We are not aware of any other payments made to our office for any further services.
When a customer
purchases a MaxAudience Foundation package, they agree to the terms and
conditions found on our website and on the page at the time of purchase. Specifically, it states that any fees paid
are non-refundable. The terms and
conditions provide that a customer has the right to cancel a purchase, but that
they must provide our office with a written intent to cancel prior to the
charge being processed. Here, the
customer never provided our office with any intent, oral, written, or
otherwise, of his intent to cancel the service.
Importantly, our service on this package begins almost immediately upon
purchase. In Mr. [redacted]’s case, the
uploading for the local search engine directory work was completed by December
7, 2012, only
ten days after purchase. All of these
directory listings exist as of the date of this response, so the customer is
enjoying the fruits of our service.
On top of the
local search engine directory information that is uploaded directly to the
search engine servers, this service also calls for our office to set up
listings on national search engines like [redacted] Places, [redacted] listing, and Bing
Listing. After these listings are created,
the respective search engines send PIN numbers to the listed company. We then request our customers forward the PIN
to our office so that we can finalize and manage the listing as part of the
service. All three of these listings were created, but when requested, no PIN
numbers were transmitted to our office from the customer.
We feel, given
the facts listed above, that we have performed the service that Mr. [redacted]
purchased in November 2012. In
combination with the terms and conditions that Mr. [redacted] agreed to on our
website, we do not feel that a refund is due at this time.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
It appears that I have paid for air, because I have nothing in writing, print, or email to show that they have done anything. I did not receive any requests for anything, did not receive any pin numbers, and have no idea what services they are referring to as I did not sign for any of that and have no proof that anything was done. The salesperson they assigned to me is gone and he provided me with nothing for my money that I am aware of. Right now they could say they gave me jello and I would be expected to believe it.

Thank you for the opportunity to try to resolve this complaint.
Because we have already completed the work that leads to the online directory listings, there is nothing that we can offer as it relates to that matter. Additionally, that work and those listings comprise the standard Foundation package that Mr. [redacted] purchased. As such, we still do not believe that he should be afforded a refund. However, we will make sure that Google, Bing, and Yahoo resend the confirmation numbers to Mr. [redacted] to insure that he gets that part of the specialized package that he purchased finalized.
