Complaint: [redacted] I am rejecting this response because: Though we closed on the house CBH Homes refused to honor the initial terms of the agreement, or their own community standardsThe contract was closed on because CBH Homes refused to negotiate further and we were at the end of our lease and were not able to find another place to rent on such short notice to continue addressing this issue CBH Homes went so far as to issue another addendum, and deleted the NHO when it was signed stating that contractural and community standard obligations were not metSincerely, [redacted]

See attachments - These attachments were presented, reviewed and agreed to by buyers/owners initials and signatures at New Home Walk Through prior to closing Landscaping and watering though the sprinkler system is not covered by warrantyIt is a maintenance item and is the OWNERS RESPONSIBILITY to care for and maintain It is summerThe temperatures outside are in the high to mid 90sIt is hot outside and there has been rain fall for many months Any saturated soils, puddling or standing water would come from OVER WATERING FROM THE SPRINKLER SYSTEMS especially in these very hot temperatures during the summerThis is the owners responsibility to correct through understanding the sprinkler timer and adjusting watering timesDrainage systems for OVER WATERING are NOT NECESSARY OR NEEDED if desired to are an optional cost if desired by owner at custom cost quote only and are not included in the purchase price of any home Thank you,

The community sidewalk was poured over when to community was developed over years agoIce melt applied to the driveway by owner or other voids the builders warranty

CBH Homes has reviewed and made adjustments to the exterior door to help improve the performance and is committed to thisWith all exterior doors it is not uncommon to experience some moisture at this point as the door is opened/closed and person(s) entering or exiting with wet shoes or weather potentially entering during this actOwner is responsible to maintain this and prevent damage and not let water collect or sit for prolonged amount of timeThis area also has additional caulking/sealing to help prevent any damage from occurring should some moisture to be present As admitted in fact by the owner in the complaint and to CBH in personThe Owners Tower Garden was placed in the corner and had been leaking and caused the damage to the floor and made it bubble The tower garden leaked so much it went under the baseboard in the corner behind the tower garden and it soaked into the particle board sub-floor and caused the all damage or bubbling to the flooringYou could see that water/moisture had been in the corner on the framing members for a prolonged amount of timeThe exterior door did not cause any of the damage incurred to the [redacted] 's home nor did it cause for an insurance claim to be filed by the [redacted] 'sTherefore no refund will be given Thank you, CBH Homes

This was a Build Job CBH Homes built specifically for [redacted] In this process CBH Homes owns a home site that Ms [redacted] selected along with her desired CBH Homes story home plan The selected home plan was drawn using auto-cad computer design by a professional home designer of the specific home plan on the desired home siteMs [redacted] did indeed select to have the home pushed further back on the lot at an agreed priceThe work to be done to push the home back on the lot is extensive as all of the utilities and city sidewalk are at the front of the lotThis work would include ALL utilities (water, sewer,power) separate trenching for each utility, compacting of all trenches,inspections, concrete labor prep, 3/4" sub-base,compaction of sub-base, concrete labor, concrete and haul-off The plan was redrawn with the home pushed back on the lot as desiredThis plan was reviewed Ms [redacted] and approved in writing by Ms [redacted] on 12-2-(buyer copy available if needed)The rest of home selections were made and approved by buyer and CBH Homes proceed into construction of the home to completion The home is built exactly as the plan shows on the the plan approved by Ms[redacted] No refund will be given Thank you, CBH Homes

CBH Homes does not approve and will not condone of this behaviorIn fact we go to great lengths and cost to provide toilets for all worker to use as needed through construction in all communitiesThere are many workers that come and go as work starts and finish from day to dayThe contractor on site have been contacted and warnedSorry for the hassle,CBH Homes

CBH Homes visited the home and reviewed the driveway in April and responded to owner May 5, 2017.Surface of the driveway was pitted and had spalling across entire drivewayThis is caused by the use of de-icer/ice-melt by the ownerThe use of these products voids home-builder warranty and is the homeowner responsibilityWinter - January, February & March were EXTREMES & RECORD BREAKINGThe Freeze-Thaw-Freeze-Thaw from these weather extremes WITH THESE UNWARRANTED CHEMICALS (de-icer/ice-melt) caused the surface damageNo replacement or cash settlement with be offered Tell us why here

I emailed numerous times and nobody cared to get back to me with that shows me it's a lack of responsibility when you do something wrong and don't care to even follow up to see if the victim is OK or notThis was the only way somebody would even acknowledge meThis should stay on their permanent record so other people can see how they are at customer service [redacted] ***

Complaint: [redacted] I am rejecting this response because: We have already dug a drainage ditch along the back fence line, as our yard was being consistently washed out from the uphill neighbors lawn watering, as your warranty supervisor was also shown when he came to inspect the issue prior to this complaintWhile that worked for a short time, the consistent onslaught of water running downhill has saturated it to the point that is no longer running the ditch and going out, but building up on our back fence line like a swampAs was also previously stated, I meticulously programmed the sprinkler system so that it runs for the CBH recommended time, and even less as I will often turn it off because of the water build upThe solutions you are providing are all things that have already been done or attempted, yet the issue is still thereThis further proves that it is not a homeowner problem, it is a poor landscaping/site overseer problem when the area was developed and homes were builtI will gladly put in a drain pipe to take the water all the way down the street, however I cannot dig through other peoples back yard to burry it and despite being promised by the warranty supervisor that he would attempt to make this work and speak to the neighbors, who are also having yard issues because of this by the way, we simply got a "no can do" answer because it was easier to blow smoke up our as when face to face and not to squat about it after getting back to the office than to actually utilize integrity and do what was said would be doneTruly, that is what makes me the most angryDo not promise me that you will do everything you can to help then turn out to be a liar Thank you for the further proof that this agency cares about nothing more than the almighty dollar and will allow inexperienced home buyers to suffer with something that could never have been foreseen by them but should have been known and prepared for by such a well known companyI didn't realize $was the going rate for an Idaho swampI will bear that in mind for future reference.Sincerely, [redacted]

Making contact with owner to review

I review the home and the back yard issue on July 15th, 2015. Back yard did have standing water approx 70'x12' CBH Homes recommends a sprinkler water schedule ofWatering days a week MAX Watering 2x a day MAX (once to am & to 7pm)Minutes on psprinker heads - MAX
Minutes on gear driven sprinkler heads - MAX. At buyer home walk through before closing CBH Homes reviews this with buyer and has the buyer sign an agreeing to this scheduleWe can supply the signed buyer document if needed. Owner was watering times a day days a week with minutes at or above MAXIMUMBuyer set these watering times and is responsible for OVER WATERING of and half times the MAXIMUM watering agreed to in writing. CBH Homes set time to recommened times on 7-15-In a little over week and the area has dried and is now maintainable. With time and regular scheduled maintenance, fertilization and proper watering the grass should return to it healthy stageat last review it looked to be recovering well The fencing is vinyl fencing and did not appear to be damagedNo replacement of the items by CBH Homes due to buyers over watering Thank you,

CBH Homes would be happy to repair the yard where damaged in the power easement and are truly sorry for any inconvenience we may have caused during construction nearbyWe would like to have work completed by 5-10-
