Revdex.com:
We are responding in reference to complaint ID [redacted] placed by [redacted] expressing that he is not satisfied with the services rendered. ADM Tree Services is rejecting this response because our crew member went to [redacted]’s property on June 28th, 2014 to re-grind the stumps. We wanted to let [redacted] know that our employees have extensive experience in dealing and providing a most efficient service to our valued customers.
We would also like to bring to [redacted] attention regarding his complaint in which he says that ADM Tree services only dug deeper holes without totally removing the stumps. We wanted to clarify that on the written contract, the estimator wrote: Grinding down few stumps, leave stump mulch. Again, clarifying and restating that we do not remove stumps, we only grind them. Our policy is stated on the back of the hand written proposal, it is #20, an excerpt from this discusses when stump grinding is contracted, the main tree trunk will be ground down to about 6 inches beneath the surrounding surface grade, unless otherwise agreed upon. We completed the work as stated in the contract, and as stated in our policy.
We also wanted to mention that our policy stated on the hand written contract, which is #9 states: Complaints must be received within 7 days of the work. Failure to provide notice within this time frame waives any right to an adjustment. Specifically, this complaint was received approximately two weeks after the work was completed, but we still went to re-grind the stumps on the date stated, even though it was no longer our obligation.
We have attached the contracts which specifically states stump grinding, not removal, (as the equipment that we have only grinds down the stump). Also, contained in the hand written contracts on the back contains the policies in which our company works under.
We hope this information is of assistance. Please feel free to email me back or contact our office for any questions or concerns.

May 28, 2014
class="MsoNormal">To whom this may concern:
We are responding for this complaint dated April 29th,
2014 from the client [redacted].
The services in which were stated in our contractual
agreement were divided into three contracts. Our client decided to accept the
first contract to have removal of five pine trees located at the back yard
(this includes removal of general wood haul away brush and debris from work
area) for the price stated of $3,150.00 on February 4th, 2014. The
specified work agreed on the contract was commenced on February 6th,
2014. Payment was made after the work was completed as stated on the contract
Moreover, a second contract was provided to [redacted] on February 7th, 2014 to remove two white pine trees
located in the back yard on the left side (cut all down to the base). This
includes hauling wood and brush away and clean-up debris from work area. The
portion of this work was for the amount of $525.00. Then we Grinded-down a few tree
stumps, leaving the stump mulch on the property for the amount of $375.00. [redacted] decided to accept the contract and when the job was completed payment
was made. [redacted] was satisfied with our services.
[redacted] then contacted us via-email on February
20th, 2014 to let us know that he was interested in having the
removal of the two last pine trees and ADM provide a quote for the two pines
tree and the stump grindings for the amount of $850.00. [redacted] contacted us
on February 22, 2014 via email regarding the price of this work and mentioned
that for this additional work, [redacted] would send another estimator for
comparison.  Which from our
understanding, he wanted an additional estimate from another company to compare
to our estimate.
However, [redacted] contacted us on March 10th,
2014 through email accepting the estimate made by the estimator to cut the last
two pine trees for the amount of $850.00. The specified work that was agreed
upon in the contract was commenced on March 14th, 2014. The two pine
trees removal were completed but unfortunately, the two stumps were not grinded
that day due to the inclement weather. Our Estimator returned to the property one
week later to proceed in grinding out the two remaining stumps.
The problem began when [redacted] send us email on
April 14th, 2014 of photos of roots, not stumps, as he mentioned on
the complaint. We took the opportunity to respond to him and let him know, that
the trunks were grinded up to where the stump grinding machine was capable of.
The photos that [redacted] sent us are of the roots, (remaining roots) and
those are pulled out, and we do not pull out roots.
We wanted to restate that all work was completed to
its entirety, but in order to resolve the matter we will be contacting [redacted] to reach in an agreement. We hope this information is of
assistance. Please feel free to email me back or contact our office for any
questions or concerns.

 Complaint: [redacted]
I am rejecting this response because:
ADM Tree Services in their response to Revdex.com did not address the main subject contained in my complaint, nor contacted me in writting the manner to reach an agreement.
My compliat is to remedy the extremely defective work, delivered by Mr Adan M[redacted] after attempting to grind down the STUMPS including all VISIBLE ROOTS. Mr M[redacted] assisted by another worker, proceeded to cover with chips the remaining stumps/roots appearing as work well done.
Afterwards another firm in charge to renovate the damaged yard left by ADM, was not able to work the area due to obstacles from the stumps.
I question if members involved directly with the business fully understand what is written in their own Contracts?
On each ADM MUTUALLY ACCEPTED Contract, PARAGRAPH No.20 States "When stump grinding is contracted, the main tree trunk will be ground down to about 6 inches beneath the surrounding surface grade(*), unless otherwise agreed upon. This is the industry standard for stump removals. Miscellaneous surface roots are not removed unless specified in the contract." (*) Photos available.
All I herewith state is the the truth, which ADM and myself mutually accepted to the terms clearly indicated in the various contracts. Therefore ADM legally breached the contract.

 Complaint: [redacted]Dear [redacted]:
I am rejecting the response because the content of ADM Tree Services LLC is totally vague, but at this time I am inclined not to pursue the case any longer with the kind assistance of Revdex.com.
Your electronic mail of July
28/2014, message from ADM Tree Services LLC was
inserted.
The message from said business related to
my complaint ID No.[redacted], April
29/2014 to
Revdex.com,
is nothing else but continued repetition of clauses from their pre- printed
“Contract” for works
done at my home located at
[redacted], VA[redacted], which unfortunately were and still are unfinished
as when
delivered.
I,
the Consumer, considered
ADM TS LLC -the
Contractor-, to be an honest and reliable firm, and
accepted their "Contracts" expecting to
receive completed and acceptable work.
Mr. Adan
M[redacted], the Estimator, orally assured me that the
contracted works "include removal of nine stumps,
and all visible roots". Therefore,
ADM as a firm, Mr M[redacted] the
Estimator or whoever the legal registered owner is, must accept
and understand that "oral statements", are
obligation or commitment, basic principle
legally accepted by civil law.
Persons with minimum common sense, know
that
oral statements imply that non
fulfillment of contracted obligations constitute a
breach
of contract punished by the law.
In my
complaint to
Revdex.com (ID No.
[redacted], April
29/2014), related excerpt reads:
"I kindly request to Revdex.com the necessary assistance that “ADM T
S LLC” either completes the work, as agreed, or refunds the total
cost for which another business will charge for the removal of the partially
left stumps and visible roots". The
estimated cost charged by other Tree service firms, oscillates between $275.00
- $300.00 to finish the defective, slovenly work done by
Mr Adan M[redacted], the
Estimator/Technician.
I strongly sustain and believe, If
Contractors deal honestly, fairly and in good faith with
customers, no problems of this nature would exist.
Technicians applying little creativity* to
remedy defects left behind, after demanding and accepting full payments after
delivering deficient works, with no remorse, will discover, that no brain effort is needed. I
repeat, injecting a little creativity* would keep us
away from status like the one we are in now.

[redacted], in view of the fact that ADM T S
LLC, the contractor, despite attempting once
again, failed to complete the contracted work, there is no
other alternative and following advice from legal
Counselors, to bring this minor case to civil tribunals.
Taking this step, damages from
breach will be worst, if contract had simply been
performed in the manner mutually accepted.
It is deplorable that some firms use terms as shield to refuse their
responsibilities.
Contractors, not
executing the terms of written agreements, create an opportunity in favor
of the aggravated party, proceed with demands before tribunals to obtain an
economic compensation and attorney honoraries for unfulfilling contractual
promises.
This action and conduct of contractors, once
again, I firmly state are in breach of contract.

To
conclude, I respectfully decline further assistance and take this opportunity
expressing to you, [redacted] and Revdex.com, my sincere gratitude for your arbitration
in trying to reach a peaceful solution outside the courts for this minor
case.

Regards,

Review: I hired ADM tree service to cut down 1 tree. They did not finish the job with 2 weeks after starting the job. Found out later the tree hit my home and has caused severe damage to my house ( 1 cracked truss, 5-6 sheets of cracked plywood, punctured my roof in 2 places, damaged 1 skylight, cracked my foundation, and racked and bowed walls, knocked down 10-12 other trees,) The owner was showed the damage and told me the damage was existing prior to him starting the job. However the roof was installed 5 days prior to install. I have hired a independent structural engineer and he has verified the impact damage.

I have filed a claim on his insurance however they are giving me the run around ( over 1 1/2 months ) because he will not admit to his responsibility has a business owner in this community. I realize mistakes happen however he is being cheap and wont admit fault so his insurance rates wont go up. the estimated damage is over 30k.Desired Settlement: I would like him to tell insurance company to honor the damage or pay me form the cost to fix my home.

Response:

To whom this may concern:

I am responding for this complaint dated September 19th,

2013 from our client. The services in which were stated in our contractual

agreement and our client accepted and signed to have removal of a tree for the amount

of $1,200.00. The work specified on the agreed contract was commenced on July,

15th 2013.

The job was completed as stated on the contract. When the

job was completed our client let us know by e-mail the following day, July 16th,

2013 that he was satisfied with the job completed using the expression “Thank

you your guys did a great job!”

Moreover, the problem began

when our client got upset because crew members were removing the tree noted in

the contract, in that process, a branch from another tree was broken. Proceeding

from this, there was a verbal agreement to remove the tree with the broken

branch and we also removed nine additional trees, free of charge, all in

order to satisfy our client. He was aware that we would not haul away the ten trees and that

they would be left at his property. Our

client offered us $500.00, for additional work on his property but we did not

accept it, so we did not complete it. Overall, our client was satisfied with

all work completed on the contract, as he expressed in his emails. However, when we asked for payment towards

the contracted work for the amount of $1,200.00, our client then told us first via

e-mail and then via phone that there was damages on his property. Nine days

after the tree removal job was completed, did we receive a complaint from our

client on July 24th, 2013 letting us know the house was damaged. The work was not close enough to incur those

types of damages as our client mentioned on the complaint and when we asked for

payment, he let us know that he has decided not to pay for the work that was

satisfactorily completed on the contract.

We wanted to mention, if there was damage incurred by our

crew members, they would immediately have told us and we would have contacted

the homeowner of what occurred. Why did our client wait nine days to put the

complaint of his damaged house? Our company has always been responsible in

assisting homeowners when any damages occur on our part and we will continue to

do so, as our customers are very important to us.

We hope this information is of assistance. Please feel free

to email me back or contact our office for any questions or concerns,

Thank you for your time,

Review: ADM was contacted to remove poison ivy on the property and to spray only in the back behind my shed, it is obvious other areas have been sprayed. I am a breast cancer survivor and specifically told this to [redacted] as the reason I didn't want the rest of my property sprayed as I intended to grow organic foods. Also, a quote was asked for and given to remove a tree but I informed [redacted] that I was not financially prepared to spend an extra 690.00 to remove a tree. This quote was given on June 6th. I was called and told on Saturday the 7th that they would arrive on Monday June 9th 2014 to begin work. Noone called to say they changed my day to Tuesday so I was not able to be home when they arrived to do the work, I had taken time off of work Monday to wait for them. On Tuesday I received a Text Message from [redacted] showing my tree taken down. He was aware that I wasn't ready to remove the tree but he did it anyway. The poison ivy was sprayed that day along with places they were not supposed to spray, including 2 small trees in the back that are now half dead. They also broke several branches on a bush out front I am assuming by dropping parts of the tree on it while cutting it down. I called [redacted] and he argued with me regarding our conversation, saying only that I signed the paper. Originally I was told they would come back the following day to remove the dead/dying ivy. I had to call and have [redacted] come back, when he did he did not remove all of the ivy as discussed. I am still trying to get them to complete the job as contracted.Desired Settlement: I would like them to eat the cost of taking down my tree without my permission and I want them to agree to never set foot on my property again. I will pay the full 575.00 for the ivy removal once it has been done completely. I would like others to be aware that this was not a reputalbe company to deal with, nor were they easy to contact after problems arose. I tried to contact the owner twice with no result.

Response:

Review: Filing this complaint is based on the failure of “ADM” to deliver a finished job in accordance with the terms of mutually accepted contract.

The contracted work in the amount of $4,900.00 (Four thousand nine hundred dollars) exactly was for the removal of 9 White Pine Trees from our backyard including removal of the stumps and all visible roots* and hauling away wood debris.

Mr. Adan M[redacted], "ADM Tree Services LLC" Associate, received cash payment on demand for the contracted work.

Mr. Adan M[redacted] and a co-worker left partially cut stumps and visual roots totally covered with wood chips after grinding, and not visible to the "naked eye".

* Exert from the mutual accepted Contract with "ADM Tree Services LLC", literally states:

“THIS INCLUDES STUMP TREES GRINDING WHICH INCLUDES THE REMOVAL OF VISIBLE ROOTS…….ALL WORK IS TO BE COMPLETED IN A WORK-MANLIKE MANNER ACCORDING TO NAA STANDARD PRACTICES“.

My contacts with ADM to complete the work as contracted have been ignored. Mr. M[redacted], failing to perform the Contract by leaving the work unfinished, legally is considered breach of contract.

I kindly request to Revdex.com the necessary assistance that “ADM TS LLC” either completes the work, as agreed, or refunds the total cost which another company will charge for the removal of the partially left stumps and visible roots. PHOTOS OF POOR JOB DONE WERE SENT BY EMAIL TO ADM ON APRIL 14 2014Desired Settlement: I want to avoid any legal action in order not to damage the image of the business as long as "ADM" performs strictly with the terms of Contracts.

Response:

May 28, 2014

To whom this may concern:

Thank

you for your time,ADM

Response:

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the response. If no reason is received your complaint will be closed Administratively Resolved]

Review: [redacted]I am rejecting this response because: ADM Tree Services in their response to Revdex.com did not address the main subject contained in my complaint, nor contacted me in writting the manner to reach an agreement. Afterwards another firm in charge to renovate the damaged yard left by ADM, was not able to work the area due to obstacles from the stumps.I question if members involved directly with the business fully understand what is written in their own Contracts? On each ADM MUTUALLY ACCEPTED Contract, PARAGRAPH No.20 States "When stump grinding is contracted, the main tree trunk will be ground down to about 6 inches beneath the surrounding surface grade(*), unless otherwise agreed upon. This is the industry standard for stump removals. Miscellaneous surface roots are not removed unless specified in the contract." (*) Photos available. All I herewith state is the the truth, which ADM and myself mutually accepted to the terms clearly indicated in the various contracts. Therefore ADM legally breached the contract.
