2/4/ RESPONSE TO COMPLAINT ID [redacted] In response to the homeowner’s desired settlement of finishing or repairing the remaining items, we offer the following information about the items she has brought to our attention: Master bathtub RenuBath contacted the homeowner, and scheduled the afternoon of Wednesday, February 3, 2016, to make necessary repairs Fireplace starter Nix Door & Hardware will schedule repair Mismatched fence Youngblood Fencing is scheduled to inspect the fence for color match Island marble The marble was repaired as requested Marble was discussed and accepted during the walk-through Paint vanity door The painter will schedule painting appointment Carpet in master bedroom Flooring Services contacted the homeowner, and scheduled Wednesday, February 3, 2016, to make necessary adjustments to the carpet All items have either been completed, scheduled for completion, or to be scheduled by the contractor / [redacted] Style Definitions */

J Thanks, [redacted] Assistant Operations Manager Apex of Texas Homes2)One more recent example of their refusal to honor their warranty happened last weekWe received an email dated February 5th, stating that their plumber/sub contractor was not going to fix our propane fireplace starter The plumber installed all of the propane lines throughout the house as well as the fireplace starterBut Apex argued that the company who set the propane tank outside should fix the fireplace staterThe propane company had NO involvement whatsoever with the propane starter By the way, the fireplace starter is a huge safety concern The starter initially did not workSo, the plumber came in and cut many large slits into the pipe to allow propane to escape The first time it was used so much propane came pouring out that a ball of flame singed my husbands eyebrows, eyelashes, and eyelidsSince that incident we have been told by several individuals that Apex used a shoddy cost saving tactic on the fireplace starter But refuse to make it right.Apex and its president stated in their latest response that we had added items to the list of things needing repair Surprisingly, this is factual These are the items that were added:1)the master bathroom bathtub has a NEW leakIt is the 4th different water leak we have had.2)the cabinet maker delivered a unpainted replacement cabinet door for the bathroom vanity We believe the was broken by a Apex subcontractorThe door needed to be painted.3)last week we discovered a crack in the faux brick at the back of the fireplaceNo doubt caused by the extreme heat generated by the problem with the propane starterApex claimed our initial complaint was not factualWe find this laughable due to the used car dealership mentality exhibited throughout our nightmarish year of dealing with ApexWe challenge Apex to disprove any of the that initial post Lastly, we keep praying that they will eventually do the right thing, but we are into our second year and they still have NO concept of customer satisfaction Regards, [redacted]

I have received the second response from the Bridges. This is a situation where we could keep going back and forth. Much of what she stated in her original complaint was not entirely factual. We made the decision to respond only to her desired outcome, instead of arguing Everything on her original list has been completed. She daily adds things to be done. For example, after I sent in my response to you yesterday, she added more things. I find it curious that she chose to not put an exact list in her complaint, which will make this an ongoing issue. She also expects immediate results, which is often not possible We are choosing not to respond at this time, and keep working to get her issues resolved Thanks, *** *** Assistant Operations Manager

After the house was completed, tree trimmers were sent to trim trees in the back of the house. While the trees were being trimmed, pickets were damaged along the back fence. On 11/22/16, these pickets were replaced
