The complaintant contacted our company and requested to take over the lease of a friend.  We allowed he and another individual to take over this existing lease, we explained the situation fully and they signed all paperwork including signing the original tenants move-in condition report, they...

were informed that when they moved out the unit was to be returned to us in the same condition that the original tenants received it.  This was not a new lease and therefor a new lease was not prepared.  A little over one month after taking over the lease there was a domestic disturbance at the residence and the complaintant was arrested for aggravated assault with a deadly weapon, we terminated the tenancy after learning of this incident.  Possession of the residence was returned to us on 9/29/14, the complaintant did not provide us with a forwarding address.  An itemization of charges and damages to the unit was mailed to the residence on 10/24/14, since they did not provide us with a forwarding address.  In the absence of a forwarding address, by law we are to send this documentation to the residence.  This notice mailed on 10/24 also included a demand letter to make payment of the amount owed for the damages.  On 11/17/14 the complaintant called our office stated that he did not owe those charges because we "evicted him", he informed my staff that he did not plan to pay and that we could send him to collections.I have documentation of all of the above.  The complaint is not accurate.  We received a call from a person claiming to be the complaintants mother a couple of weeks ago, she made some of these same inaccurate claims to my staff at that time and in a voicemail that she left for me, I returned her call the following day, a woman answered the phone and reported to be the woman's daughter I left my name and phone number and I never heard back from her.We have communicated throughout the process with the complaintant and most recently his mother, he obviously got the demand letter since he called to argue about it on 11/17/14, he knew that we planned to and he even suggested that we send this to collections.  He was not sent to collections until May of 2015, he had more than six months notice that he was going to be sent to collections prior to us doing so.We will not refund any portion of the payments that he has made.
