My name is [redacted] ***I am the owner of the restaurant House of ChinaOn our menus, we print at the bottom of each page that we charge a 15% gratuity on parties of five or more, so it shouldn't have come as a surprise at all to the customer because they were informed prior to ordering their food With our restaurant, as with other restaurants across the nation (excluding fast food restaurants), the percent gratuity tip is always included in the bill for large parties; although it varies in percent and with how many people in a party this percent is applied to, this rule is still used in restaurants, including oursI have been in the restaurant business for about years, and no one has ever complained about the gratuity ruleThe customer complained that she did not want to pay the 15% charge because there was a so-called "new law" that had been passed stating that you did not have to pay the included tip charge if you did not want to; however, I would strongly like to know which law and when it was passed that specifically stated this remarkIn her complaint, the customer stated that I said that we got enough business to where it would not matter if her and her party wanted to return; however, in reality, she herself stated that she would never come back to my restaurant, to which I replied "After you, it's your choice"I never forced her to pay the 15% gratuity tip charge; when she came up to pay, I told her if she didn't want to pay, she didn't have to because it was her choice; however, her husband agreed to the charge and paid for it--so, the tip is not "mandatory", like she claimedSince the amount was agreed to, we can't refund it, especially since we have already given the tips from the 15% charge to the waitressThis all happened on May 9, Regards, [redacted] House of China

I have been in the restaurant business for about 30 years, and no one has ever complained about the gratuity rule.
