RE: [redacted] Revdex.com Complaint ID # [redacted] For clarity, we respond with the FACTS by the number without misleading embellishments: 1) Research of our email files clearly shows that neither “ [redacted] ***” nor “ [redacted] ***” attempted to contact us via email These are the names listed on the Bi-Lateral Sales Contract [redacted] dated October 6th 2) Customer purchased a discounted sales price queen mattress set and frame October 6th as follows: Queen “ [redacted] ***” Firm SET Regular Price $Discounted Sale Price $Savings $ Queen Steel Bed FrameRegular Price $Discounted Sale Price $Savings $ In addition, $was deducted from the discounted sales prices before taxes and added back in after taxes for delivery so as customer could also have a free delivery Total savings to customer as agreed was (-$375.00) Customer’s mattress set was “marked sold” on the store inventory during her presence at point of sale, pulled from stock same day, staged and made ready for delivery as agreedAnd, subsequently, a replacement set was ordered from corporate at days end Refunds do not apply for Sale Priced or Discounted Merchandise”Her bilateral sales agreement clearly shows she purchased discounted sales priced merchandise as outlined immediately above 3) “ [redacted] ***” clearly affixed her signature two (2) times at the point of sale acknowledging, understanding and accepting the “STORE POLICIES” as follows: “By signing this contract I acknowledge that I understand and accept all the policies listed in the Store Policies box and on the sales contract, including the warranty, delivery, payment, refund, cancellation and comfort guarantee policies.” Immediately following the above “A 25% Cancellation, Restocking and Handling Fee applies to all purchases canceled/restocked.” is clearly printed The STORE POLICIES are immediately below, and to the left of, customer’s signatures as affixed two (2) times on BWdated October 6th Although said customer has shown a haughty disregard to the facts, Best Mattress Buys, LLC continues to stand by [redacted] ’s previous offer and remains happy to reaffirm our previous offer to her of a credit in the amount of $toward the purchase of the King Size SET she said could fit in her room or offer her a credit in the amount of $toward the purchase of another mattress set equal to or greater than her original purchase price Please let us know how [redacted] would like to proceed Thank you for understanding Best Mattress Buys, LLC

I am rejecting this response because:Since I am not employed by your company, how would I know what "marked sold" on the store inventory means? You are right when you state that I DO NOT know the inner workings of your companyOtherwise I would have known that *** was lying when he told me AND my friend *** that there was no phone number available to reach a manager! I asked him on diffrent occasions! We WANTED to speak to a *** in person, or on the phone! We were told that the EMail was the only way. Furthermore, I came into the store other times and told him that I was getting no response to my EMails- that is when I asked again about a phone number for a ***! You may be legally or technically right, but your customer service is the worst I have ever encounteredYou got my money, and I got no product or services renderedHow dare you act so righteous!

Please read the customer’s sales contracts as she has signed and listed in her complaints, and the Revdex.com will then understand
that said customer is making fraudulent attempts to extort money not due her
Customer tried out several
mattress sets and subsequently purchased
a discounted sales priced FIRM MATTRESS set July 7th of her choosing. In this regard, customer re-visited our Palm
Coast store July 23rd, stating she had made a bad choice it was “much
to hard for me”Although her previous purchase DID NOT QUALIFY for a comfort
exchange as customer is well aware of, in good faith Best Mattress Buys granted
a 1-time comfort exchange, as customer knowingly agreed in writing “I
acknowledge that I understand and accept all the policies listed in the Store
Policies box and on the sales contract, including the warranty, delivery,
payment, refund, cancellation and comfort guarantee policies.”
In addition, customer WAS NOT charged the customary 25%
Restocking and Handling Fee that applies as she agreed to in writingFurthermore,
Best Mattress Buys refunded the initial delivery of $via Check # 2114, as
mutually agreed in writing prior to her now contacting the Revdex.com
Customer is FULLY aware of ALL transactions and was not
charged any amounts THAT SHE DID NOT AGREE.
The Revdex.com should be as deeply concerned as we are that someone like this
works as an officer of the courts with Flagler County Law Enforcement and
therefore, in this regard, she must be advised and know that any further
fraudulent attempts to extort money from Best Mattress Buys will be reported to
the Flagler County Sheriff’s Office for prosecution

The terms and conditions of a sales contract are not a "moot
point"Without waiver, we always stand behind sales contracts as mutually
agreed without argument; a reasonable customer would do the same as she agreedSaid customer is not employed by us; therefore she does not know
the inner workings of our company and should not mislead the Revdex.com as though she
doesCustomer knows firsthand that her mattress set was "marked sold" on the
store inventory during her presence at point of sale. At no time did we elude that it was "pulled
and tagged" in her presenceFacts speak without conjectureResearch of our email database files, again, clearly show that
we were not contacted via email by [redacted] as she statesOur store telephone
numbers are made readily available and can also be easily found online at
several websites and through the Revdex.com websiteOur [redacted] is usually
at one store or the other as scheduled, or a phone call away to answer
questions or concernsPlease know that we reaffirm our previous offer as outlined
with a store credit in the amount of $However, time has become of the
essence now and we must close our accounting at year endSubsequently any

1)  Research of our email files clearly shows that neither “[redacted]” nor “[redacted]” attempted to contact us via...

email.  These are the names listed on the Bi-Lateral Sales Contract [redacted] dated October 6th.
 
2)   Customer purchased a discounted sales price queen mattress set and frame October 6th as follows:
Queen “[redacted]” Firm SET.  Regular Price $999.00. Discounted Sale Price $699.00. Savings $300.00
Queen Steel Bed Frame. Regular Price $99.00. Discounted Sale Price $59.00. Savings $30.00
In addition, $35.00 was deducted from the discounted sales prices before taxes and added back in after taxes for delivery so as customer could also have a free delivery.
Total savings to customer as agreed was (-$375.00)
Customer’s mattress set was “marked sold” on the store inventory during her presence at point of sale, pulled from stock same day, staged and made ready for delivery as agreed. And, subsequently, a replacement set was ordered from corporate at days end.
Refunds do not apply for Sale Priced or Discounted…Merchandise”. Her bilateral sales agreement clearly shows she purchased discounted sales priced merchandise as outlined immediately above.   
 
3)  “[redacted]” clearly affixed her signature two (2) times at the point of sale…acknowledging, understanding and accepting the “STORE POLICIES” as follows:
“By signing this contract I acknowledge that I understand and accept all the policies listed in the Store Policies box and on the sales contract, including the warranty, delivery, payment, refund, cancellation and comfort guarantee policies.”
Immediately following the above “A 25% Cancellation, Restocking and Handling Fee applies to all purchases canceled/restocked.” is clearly printed.
The STORE POLICIES are immediately below, and to the left of, customer’s signatures as affixed two (2) times on BW5055 dated October 6th.
 
Although said customer has shown a haughty disregard to the facts, Best Mattress Buys, LLC continues to stand by [redacted]’s previous offer and remains happy to reaffirm our previous offer to her of a credit in the amount of $189.50 toward the purchase of the King Size SET she said could fit in her room or offer her a credit in the amount of $189.50 toward the purchase of another mattress set equal to or greater than her original purchase price.
 
Please let us know how [redacted] would like to proceed.

I am rejecting this response because: I am offended that they regarded MY version of the facts as haughty, for starters. Any "freebies"or discounts on that contract are a moot point.  And there was NO mattress set pulled and tagged in my presence. In fact, it was less than an hour before they closed & [redacted] was alone. And, he told me that the mattress had to come from a warehouse anyway! How could it be pulled in my presence?  I was waiting for him at the front door when he arrived the next morning, so it wasn't done then either.  As for the EMails, I signed my legal name, [redacted]. And my friend [redacted] sent 2 also since he was there in the store with me. EMails sent Oct.7 5pm,  Oct.9 appx 3pm, & Oct.15 9am. All 3 EMails from [redacted].  Just don't understand why we could not get a phone number for a [redacted] or [redacted] from [redacted] at the time of the incident.  It seemed kind of shady, actually. Then no response to the EMails. That is why we contacted the Revdex.com. I just want my money back and to wash my hands of the whole thing. I would not DREAM of  doing business with Best Mattress Buys now, or in the future. There just is no excuse for a customer to not be able to speak to a manager or owner on the phone, or in person, when they are not happy. I DID Email immediately. And 3 other times. And got absolutely no response.
