After we initially scheduled to come out to fill the cracks, Ms *** then insisted that the seal coat was bad as wellWe performed a second inspection and once again determined seal coat was fine not failing on the warranty. ID *** ***.In response to complaint:Black Bear filled cracks that settled when driveway was originally sealed on 4/29/15. Very common in filling large or thick crack, there is a settling that occurs when the rubber may sink due to gravity or simply there is a larger area under the asphaltOn 9/15/15, Black Bear returned and filled the cracks as per the homeowners requestStriping effect is simply that the rubber fill and seal coat are two different materials and will not or can not match.Tire marks are result of landscaper's tractor and homeowner grinding their tires or turning tires while car not moving. We communicate three different times prior to seal coat instructions for tire marks. Attached is document emailed date of service. Tire marks will dissipate and go away over time...in fact on 9/15/15, there was evidence that tire marks were already less dark and were indeed dissipating.We seal coated at least one additional neighbor that day and did not receive any calls or complaint.Please let me know if there is any additional information needed.Thankyou. Steve F[redacted], partner, is going out tomorrow 11/22 to as the situation.  We were confident that the seal on the house would come off with no issue so we did not anticipate this situation.  Since seal coating, is a seasonal business we are only open couple days per week at this time.

I am rejecting this response because:
We are unsatisfied with the response given.  Black Bear did fill the cracks on 9/15/15 as stated in their recent response.  Now are driveway is striped!  The crack filler is a different (lighter) color than the blackseal coating.  The tire marks remain despite our following of all directions provided by Black Bear.  We are now over five months since the sealcoating was performed and they are still there.  I also did not know we were not permitted to have other trucks on our driveway ever once the sealcoating was put down.  The trucks were there months afterwards.The only way I can see solving the old problems (tire marks) and now the new striping problem is to reseal the entire driveway.

first Black Bear said they would come on Wednesday June 3rd and asked for my assurance that I would contact you that it has been resolved. I emailed back that I would connect with you on the 4th....I then received an email saying due to the weather that they would be here on Friday the 5th.....Unfortunately ,I feel that this will be a regular occurrence....if they actually do the work on Friday ..I will let you know
