and vow renewal event for June 3rd, This event was to take place in Cheyenne, WyomingOut of appreciation for the client's prior military service, I also offered our customary military discountWhen the price was agreed upon, filled out a standard contract for services, (included in this envelope), and the client signed the contractAt this point, I would like to mention that between February 7th,and March 27th, 2017, I was contacted by other couples that were interested in hiring my services for June 3rd, 2017, but were referred to other DJ companies as , at the time, my calendar was full with client's eventPlease note that the contract paragraph immediately before the deposit amount clearly states that the deposit is non-refundable within days of the eventBy their own admission, client contacted me to cancel services on March 27th, With the most generous accounting of days, this was only days, or just over two months, before the eventI did tell the client that I would return the deposit IF I was able to fill June 3rd, At this point in time, I have been unable to do soI want to make it very clear that I immediately posted my availability for June 3ra on my business and personal Facebook pages as well as on my website and Twitter accountI also contacted several DJs in the immediate area, venue directors, and the national president of the *** *** *** *** to inform them of my availability and to look for leadsIf by some chance I do fill June 3rd with a paying event that matches or exceeds the one I lost, I will certainly return client's deposit as I consider myself an honest and fair businessman. There are certain realities to be considered hereThe clause in my contract is there to protect my business from EXACTLY this type of abuseThis is my businessIt is my only source of income and I make a living as suchMy days are my inventoryUnlike the airlines, I can only book one event per DJ per day and at this time I have only one DJAnother reality is this, I am still out the other half of what I would have earned, (if not more if I had been hired by a client who wanted a larger event), had I been able to work as I was scheduledAnother reality is that once a potential client is informed that I am unavailable to perform at their wedding or event, that they will make efforts to locate another DJPeople who are planning weddings, or proms, or birthday parties do not wait around for a month or more to see ill just happen to become availableThe last reality I will point out is this: I have been running Carry On Celebrations for over yearsI have been a professional DJ for almost yearsThis is the first time that anything like this has ever happened and it is the result of being hired by people, (who knew my family years ago), have seen me perform at weddings and enjoyed my talents, but failed to take my business, my contract or my industry seriously. I am rejecting this response because:  In answer to Mr. I[redacted]'s eloquent statement, which is not exactly as stated and we need to recount a few key noted items. First after we agreed to what we wanted for our celebration and what he was able to provide for us, he filled out the contract and handed to me to sign, he failed to mention the fact that the deposit was non-refundable and we were not provided a copy of it either.   The copy included in his statement is only the 2nd time I have seen it.   The only copy of any documents we have in our possession is the request for services and songs we wanted played, on which he hand wrote and left behind.    I too, trusted him and didn’t feel I needed to read the contract before signing it, for I considered him to be an honest and fair businessman. We also cancelled, as he states 69 days prior to the scheduled event, with enough time to where he would certainly be able to book another event. I would concede that a portion of the deposit would be appropriate for the time we took from his business time. However keeping the whole amount would certainly not be fair.  I also, would not be taking this route in resolving this matter if he had only responded to my calls and messages where I suggested to him to call us so we could work out an acceptable resolution to this matter. Totally ignoring my calls was not a very good way of dealing with a customer or a friend.  Also, not good ethical business practice. Also, it is not true that he said he would return the deposit if he was able to fill June 3rd, 2017. He never said one word about this.  I would have been more understanding if he had actually said this on the first and only time he talked to me on the phone. You to must consider that my wife and I are retired and on a fixed income and $475.00 is also a lot for us too.  The fact that we have been friends with his parents had nothing to do with any of this matter, and also it was not intentional or meant to cause harm or abuse to his business. We unfortunately had to cancel the ceremony because it just got to expensive and we could not afford it. My suggested resolution to this problem is to have the whole deposit returned to us if he in fact does book another event on the June 3rd.  We are most willing to recommend his services to friends and acquaintances, as we do want to see him succeed in his business endeavors.  Regards,
