A Real Estate ***t from Eagan Real Estate came into my apartment that I lease without my knowledge.
I came home from a six day vacation to find a letter on my kitchen counter that I did not place there.
The letter was a "24 hour notice" that the real estate ***t would be showing my property to prospective buyers (per the request of the owner of my building).
Legally, the letter should have been posted on my door. Why did I find it on my kitchen counter?
I gave no verbal or written consent that I received the notice. The letter was not posted on my door. The real estate ***t from Eagan (Curtis S) came into my apartment and placed the letter on my kitchen counter without my knowledge.
I have no legal obligation to tell the owner of the building, or Curtis S, that I am on vacation.
There are also things missing from my apartment.
Curtis S broke the law when he did not place a 24 hour written/typed notice on my door. There is also no way I would have ever received this notice in such a manner, because I was out of the country. I have documents and photos to prove I was not home during the days he showed my apartment to prospective buyers.
Ethically, I should have at least received a text, call, or email from the real estate ***t that he would be entering my home with other strangers. Legally, the note should have been at least placed on my door.
It is standard and state law to post a notice to show a property 24 hours prior to showing it when their is a tenant occupying the property. We not only post notices to show prior to showings we also call or text to leave messages. The person making this complaints has no grounds for the complaint. Not only do we post notices 24 hours prior to showings, call or text, we also have mailed letters to the tenants that their unit is being put up for sale. Thank you for your mesage.

I'm rejecting this response because there was never a call made to my number or a text, or a letter in my mailbox from the business.
The only letter I got is the one I found sitting on my island after I got back from Mexico.
If they could show proof that they texted OR called OR left a voicemail, OR posted a notice on my door before they entered my apartment, then I would accept the businesses response.
The business never texted or called me or left a voicemail. I have no records of them ever contacting me in such a manner, and they don't either.
They left the notice on top of my kitchen island.

I'm not really sure what else to say. We post notices or have phone calls or texts prior to any showings. Montana State law requires at the minimum of posting a notice 24 hours prior to showings. Notice was posted and then the unit was shown. IT seems like the tenant does not understand Montana landlord tenant law. We don't have to have permission to show a unit but at a minimum we have to post notices. We do way more than just post notices. It seems the tenant was out of town at the time and when the unit was shown the ***t removed it from the front door when they got there and set it inside which is normal. The tenant may prefer to not have her unit shown but she needs to communicate that prior.
I was also told by the ***, Curtis S, that he has had conversations with the tenant since she returned and how the process goes and that she was initially upset but understood and even expressed interest in purchasing the unit. I have been a licensed real estate ***t in the State of Mt for 28 years and have never any type of complaint filed against by the Revdex.com. I am sorry that the tenant is unhappy with her unit being shown but proper protocol was followed.
