dictates when we list homes for sale and when they are placed into production
At this time, ** *** holds a contract for a home in a building that has not
yet been listed for sale and is not released for constructionStipulations
related to buying a home in an unlisted building should have been made crystal
clear at the time ** *** signed his contract with usHowever, within the
contract there are estimated delivery dates that were clearly provided to **
***We are taking internal steps to ensure that nothing like this occurs in
the futureUnfortunately we are simply unable to overcome this timing issue
and deliver his home by the date noted no his sales agreementWe are able to
provide their options for ** *** to consider.All me to emphasize that ** *** may choose any one of the following
three options, presumably selecting one that best suits his needs:Option 1, we will honor the existing contractThe cost of
the home to ** *** will be the one stated in the contract with no charge for
the errors made regarding the stairs or the foyer.Option 2, We will void the existing contract and refund all
of ** *** money.Option 3, We will void the existing contract, refund **
*** money, and give him the first right of the refusal to p purchase the
home once release for sale.We believe that the foregoing options are reasonable and

attempt to deal fairly with him in light of the errors we’ve made and the miscommunication
