Our goal is always to meet or exceed our clients’ expectations and based on Ms [redacted] complaint below, we missed that goal I apologize that we did not meet that mark in Ms [redacted] ’ case Property taxes can be challenging, especially with the circumstances which Ms [redacted] outlined of two condos being merged and then split out again but the tax bill remaining combined as one bill [redacted] ***, the Escrow Officer, initially understood from the county appraisal district that the bill would be re-split (one for each condo) prior to the final tax bill being sent out Unfortunately, the appraisal district has now made it clear that information was incorrect and that although they realize each condo unit now has a separate owner, they cannot split this tax bill into two tax bills until January 1, With that said, [redacted] has spoken with the other condominium owner who assured [redacted] she has recently given Ms [redacted] a check for her ½ of the tax bill for the property taxes We understand the frustration this tax bill issue has caused and while we do not have control over how the appraisal district or tax office splits accounts, we apologize for the misunderstanding and incorrect communication from our office indicating the taxes would be billed separately for

Complaint: [redacted] I am rejecting this response because:The contract was not honored by the seller in responding to the release of earnest money when originally requestedThey have avoided & discontinued all contactThe sellers also went through another title company to hide closing on the home with another buyer and keep my earnest money to keep me from moving on Regards, [redacted]

It is my understanding there was a PEC easement filed post closing. Title companies are not responsible for filings or recordings of documents that take place post closing that were not a part of the closing itself. If Mr. [redacted] believes he has suffered a loss in connection that may be covered by title insurance he may wish to contact the Underwriter reference on the Title Policy and file a claim with said Underwriter. The Title Policy jacket covers information about Covered Title Risks, Coverage Statements, Making a Claim, and more. The phone # for the Underwriter will also be included in this section of the jacket. We can also provide contact information for the Underwriter to Mr. [redacted] if that would be helpful.Tell us why here...

I am rejecting this response because: These are two different issues, first the seller signed a t saying NO easements were added since if you compare the survey and the survey you will see there is a new line on the north side of the property and the easement was NOT filled till after we closed on the propertyThe pec easement listed on both surveys and recorded is NOT a PEC easement this is what the title company should of researched

Independence Title has reviewed the complaint and determined that this is not a title agencyissue. The Seller for the transaction disclosed an electrical easement onthe T-Affidavit and our title commitment noted the existing line traversingthe property and made an exception as to the
existing electric utility easementrecorded in Volume 687, Page 433. This same easement was shown on thesurvey dated 2-2- All of this information and documents werepresented to the buyer before or at closing. It is also our understandingthat the buyer was in contact with PEC prior to closing about obtainingelectric serviceIndependence is not responsible for electrical or otherutility service to real estate, and made no warranty or statement as topotential cost for new service. While it is regrettable that thepurchaser did not further explore the viability or cost of electrical serviceto the property prior to their completion of the purchase, the matter is simplybeyond Independence’s role in closing a transaction and issuing policies oftitle insurance

Our role as the title company does not allow us to disburse disputed earnest money funds without both parties being in agreement as to how those funds are to be disbursed

I have reviewed the response made by the business in reference to complaint ID *** and find that it was due to me reaching out to the owner of and asking her if she would be fair and offer her part of the taxesI alone have been trying to resolve this issue and not Independence Title who initially ignored me and was only forced to reach out to her after my complaint, by which time I had already spoken to the owner of Independence title have only offered their explanation for their mistake and not resolved it.No one should ever be put through this stress or be forced to try and solve an issue themselves that was caused by a company who refused respond initially.I have received the check from but I have yet to cash it so I am hoping it will be honored or we will still have this problem

particular case, both the Seller and the Buyer feel theEarnest Money is rightfully theirs and each has made conflicting demand for thefunds.  Independence Title will continue to hold the Earnest Money untilall parties agree as to how the funds should be disbursed or the funds areinterplead to a Court of suitable jurisdiction for the Court to decide to whomthe funds belong.   This procedure is common to settlement agents inTexas and consistent with our duty of neutrality.Tell us why here...
