Complaint: ***
I am rejecting this response because:
Copy of lost Money order
due file a police report
also money order was not cashed but now they said someone cashed it at *** Bank *** Bank said on one cashed or deposit it in Harrisburg called
Regards,
*** ***

Per the attachment that *** *** included with his most recent response, the copy of the money order clearly shows that the money order was cashed as there is a bank stamp on the back of the money order and MEMO was charged for and paid out on the money order. Otherwise, there would be no copy to provide to *** ***. Whoever deposited the money order deposited it into an account at *** Bank. This could have been done directly at the bank or through a check cashing location, or via remote deposit. Unfortunately, MEMO has no way to know where or by what means the money order was deposited.
Again, per our previous response, *** *** has no proof that he purchased this money order. We provided as much assistance as we could based on the information he provided as far as purchase date and time, however, this may not be the money order that he purchased. The fact that *** *** has no proof of purchase and he is not the owner of the account into which the money order was deposited may prevent the bank from providing any information to him, as this information is private and not accessible by anyone other than the owner of the account.
We are very sorry that our response does not satisfy *** ***'s desired outcome of his money being refunded to himHowever, only the purchaser of the money order has control of the receipt which is the proof of purchase, so the responsibility does fall on the purchaser to retain this receipt. Because there is no receipt available, there is nothing more MEMO can do to assist in this matter. *** *** may try to contact the police to file a report, but again, he has no proof that the money order in question belongs to him, so there is no guaranty that this course of action will be successful. Unfortunately, in most cases, losing a blank money order with the receipt attached is the equivalent to losing cashAs always, I am available if further discussion is neededI can be reached at ###-###-####Sincerely,

[redacted] contacted MEMO Financial Services on 10/26/15 and stated that he had purchased a money order, but did not have possession of the money order or the purchaser's receipt, nor did he know the serial number of the money order.  He was provided with a  money order number based on...

the purchase date, amount, time and store location that he provided to our customer service representative, and a "Lost Receipt Form" was sent to him so that he could file a claim on the money order, and could be refunded in the event that the money order did not become cashed.  The money order was cashed and cleared the bank on 10/27/15 and MEMO did release funds as required, so a copy of the cashed money order was provided per our normal procedure.Because the money order was cashed, there is no reimbursement available to [redacted], as the funds have already been paid out on this money order.  Additionally, [redacted] has no proof that he is the purchaser of the money order as the receipt was lost with the money order.  The money order was blank (not made payable to anyone), so there is no alteration or forgery involved.  All of these things being the case, MEMO has no recourse available for [redacted].
I have attached a copy of the money that was also previously sent to [redacted].  If he wishes, he can try to pursue collecting the funds from whoever cashed the money order based on the information on the back of the money order.  However, because he has no proof that he is the purchaser, and MEMO has no way to know if he is the purchaser, it is unlikely that he will be successful in doing so.
The $15.00 fee that [redacted] is referring to is the normal fee charged to either replace an un-cashed money order or to provide a copy of a cashed money order.  As we did provide a copy, this fee cannot be refunded.
If any further information is needed regarding this situation, please feel free to contact me at ###-###-####.
Sincerely,

Response:

In response to complaint #[redacted], [redacted] contacted Merchants Express Money Order Co., Inc & subsidiaries (MEMO) on 2/19/13 regarding the status of her money order #[redacted]. At that time she was informed that her money order had cleared the bank and the procedures to receive a copy were explained to her. The copy request was received in our office and a photocopy of the cashed money order was forwarded to [redacted] on 2/22/13. The photocopy of the money order did not contain a signature, however, there were some numbers on the back of the money order. While MEMO is not familiar with the coding that different companies place on items that they deposit for payment, the company who deposited the money order can usually determine that they did deposit it by viewing a photocopy of the cashed item. (I have attached a copy of the cleared money order to this response.) [redacted] called our office again on 2/25/13 after receiving the copy and she was advised that she would need to forward a copy of the cashed money order to the payee so they could verify receipt of the money order. There is nothing in the customer's complaint indicating that she did, in fact, forward the copy of the cashed money order to the payee, so it is impossible for us to know if her situation has been resolved with her insurance company. If, after forwarding the copy to the payee, the payee responds that they did not cash the money order, the is another avenue that can be taken to attempt to recover the funds. This would involve filing a sworn affidavit completed by the payee that they did not cash the money order. This, however, is a very unlikely scenario, and cannot be pursued without input from the payee.

It is very likely that the payee did cash the money order in question but credited an incorrect account, so [redacted] is not seeing the credit on her account. In almost all cases, forwarding the cashed copy will resolve the situation. At this point, it is necessary for the customer to forward the copy of the cleared money order to the payee. If she does not receive satisfaction from the payee after they receive the copy, she can contact MEMO again to determine if further action is applicable.

Sincerely,
